Appendix

Discussion on agenda item 4a:

Possible establishment of a certification mechanism for artificial intelligence tools and services in the legal and judicial field

Document CEPEJ(2021)5 is a Roadmap describing the option recommended by the CEPEJ-GT- QUAL for the possible setting up of a certification mechanism for artificial intelligence tools and services in the legal and judicial field[1].

This Roadmap presents a progressive approach starting with the setting up of a labelling mechanism and the different steps for its implementation within the CEPEJ.

The document will be made available to you about 15 days before the plenary meeting.

We invite you to take note of this Roadmap which will be submitted to the examination of the CEPEJ on Wednesday morning 16 June 2021 with a view to its adoption.

The Secretariat suggests that the discussion preceding the vote is organised around the following questions:

1.         Does a certification/labelling mechanism for AI solutions already exist in your State? If so, in what form?

2.         If not, do you think it is necessary to set up a certification/labelling mechanism? At national or European level?

3.         The labelling proposed here concerns the ethical aspects of AI solutions and is dedicated to the protection of human rights and fundamental freedoms. In your opinion, is such a mechanism useful at European level? Could it be complementary to existing mechanisms or those under construction at national level?

4.         Do you think that the CEPEJ is the competent body to set up such a mechanism?

5.         Are you willing to support the setting up of this mechanism with your national authorities, in particular with a view to presenting this project to the Committee of Ministers of the Council of Europe in September 2021?

Please let us know in advance if you wish to speak on these issues and/or on the document at the plenary meeting. It will of course be possible to take the floor spontaneously during the meeting.
