A. FOREWORD
The Council of Europe’s European Commission for the Efficiency of Justice (CEPEJ) held its 33rd plenary meeting in Strasbourg on 5-6 December 2019. The meeting was chaired by Mr Ramin GURBANOV (Azerbaijan), President of the CEPEJ.
The agenda and the list of participants appear in the Appendix.
At the opening of the plenary meeting, Christophe Poirel, Director of Human Rights at the Council of Europe, representing the Secretary General of the Council of Europe, Marija Pejčinović Burić, gave the Pro Merito medal to Jean-Paul Jean (France) for his valuable contribution in setting up and enhancing the evaluation exercise of the CEPEJ's judicial systems from 2002 to 2018.
B. LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ
The CEPEJ
took note of the information provided by its President, its members and its Secretariat who had participated in various fora where the work of the CEPEJ was presented and discussed, contributing to the promotion of public policies aimed at ensuring the efficiency and quality of judicial systems;
took note of the information provided by the representatives of Azerbaijan, Italy, France, Greece, Mexico, Monaco, Morocco, the Russian Federation on recent developments in the judicial field; invited its members to forward to the Secretariat written information and useful references which could be included in the area "country profiles" of the CEPEJ web site.
adoptedits 2020-2021 activity programme (CEPEJ (2019)19) and decided to forward it to the Committee of Ministers so that it can take note of it;
invited the member States, through the CEPEJ members, where appropriate, to propose to the Secretariat before 15 January 2020 qualified experts to participate in the working groups and entrusted its Bureau to appoint the members of these working groups, taking into account the proposals received;
suggestedthat the chairpersons of the working groups, once designated, meet in order to ensure the necessary coordination and coherence of the themes on which the CEPEJ will work.
recalled that, according to the new timetable implemented for this cycle of evaluation of judicial systems (2018-2020 cycle), the deadline for replying to the evaluation questionnaire ended on 1 October 2019 and urged the national correspondents who have not yet replied to the questionnaire to do so, so the CEPEJ can process the data as quickly as possible and to adopt the report at its 34th meeting (June 2020);
instructed the CEPEJ-GT-EVAL to prepare for the 2018-2020 evaluation cycle a new way of presenting and analysing the data collected, through:
- a general report, focusing on European trends and including relevant graphical representations to assess the situation of judicial systems and their evolution;
- individual sheets for each country participating in the evaluation cycle summarising key quantitative and qualitative data;
- new dashboards in CEPEJ-STAT;
and to submit it to the 34th plenary meeting, so that it can be officially published in November 2020;
welcomed the continuation of the cooperation with the European Commission for an annual Study on the functioning of judicial systems in the EU member states, based on the CEPEJ’s own methodology; welcomed the cooperation with the European Commission in the framework of a specific programme for an annual evaluation of the functioning of the judicial systems in the States and entities of the Western Balkans; instructed the CEPEJ-GT-EVAL to pursue this cooperation which strengthens the CEPEJ’s preeminent role as regards justice evaluation, as well as the synergies between the EU and the Council of Europe in this field;
welcomed the cooperation with professionals in the context of the specific studies on legal professions based on data collected as part of the 2016-2018 evaluation cycle ;
invited the member Statesto propose to the Secretariat applications for peer evaluation visits;
reiterated its availability to strengthen its cooperation with the OECD as regards the evaluation of the functioning of the judicial systems in European States and other OECD member States;
adopted guidelines to improve judges’ skills and competences, strengthen knowledge-sharing and collaboration, and go beyond the culture of judicial isolation (CEPEJ(2019)15); noted that Germany indicated that it had not been able to consult the document before the meeting;
adopted a preliminary feasibility study on the possible establishment of a mechanism to certify tools and services of artificial intelligence (CEPEJ(2019)6);
took note of the on-going work of the CEPEJ-GT-QUAL on videoconference, gender equality within the judiciary, on users as the centre of civil procedures and simplification of court language;
took note of various actions which are being undertaken by the CEPEJ-GT-QUAL to ensure the promotion, follow-up and implementation of the “European Ethical Charter on the use of artificial intelligence in judicial systems and their environment” (CEPEJ(2018)14), and in particular the development of operational standards on the principles of the Charter;
took note of the work carried out by the Steering group of the SATURN Centre, in particular concerning:
o a methodology available to the judicial systems willing to set up a process of case weighting,
o a follow-up of the indicators as regards judicial procedures,
o draft guidelines on the data, tables and graphs that could be contained in a model dashboard,
o the timeframes for criminal cases under Articles 5 and 6 ECHR,
o the role of the parties and practitioners in preventing delays in proceedings;
agreed to work as a priority on case weighting, dashboards and the role of the parties in preventing delays, with a view to developing concrete tools on these issues.
adopted the Mediation Awareness Programme for Judges (CEPEJ(2019)18);
adopted the Mediation Awareness and Training Programme for notaries (CEPEJ(2019)20);
adopted the Training Programme for lawyers to assist clients in mediation (CEPEJ(2019)21);
took note of the progress made in the development of a network of contact points for mediation;
agreed to continue the development of mediation tools and to promote the development of the network of contact points for mediation within the CEPEJ-GT-QUAL.
adopted the draft Glossary of terminology used by the CEPEJ (CEPEJ(2019)5REV1), subject to modifications made to certain definitions during the discussions; noted that this document may be updated on a regular basis.
recalled the insufficient level of involvement of some pilot courts; agreed to focus cooperation on the collection of good practices, which remain a unique source of information on the day-to-day work in European courts, and invited its members to play an active role in ensuring that the courts representing their countries actively participate in the work of the Network.

invited its members and expertswishing to participate in such programmes to contact the Secretariat;
took note of the results of the study which has been carried out by the Secretariat on the references made to the CEPEJ's tools in the judgments of the European Court of Human Rights (ECtHR) andinvited the Secretariat to continue its efforts to ensure a strengthened cooperation and regular exchange of information between the CEPEJ and the ECtHR;
took note of the information about the activities of the Consultative Council of European Judges (CCJE), and the Consultative Council of European Prosecutors (CCPE), as well as the European Committee on Legal Co-operation (CDCJ).
thanked the judicial institutions of the 20 member States which had organised 43 specific events on the occasion of the European Day of Justice on 25 October 2019; invited its members to promote initiatives for the next edition in 2020.
thanked the Norwegian authorities for having invited the CEPEJ to organise the award ceremony of the 2019 “Crystal Scales of Justice” in Oslo on 25 October 2019.
welcomedthe success of the European Prize: "the Crystal Scales of Justice" and congratulated the winner “Improving the quality of justice” (IQ Justice), Supreme Court of Slovenia, as well as the three institutions which were granted a special mention by the jury: “Harmonization of processes: a response that reconciles the efficiency of the public service of Justice and well-being at work”, 1st instance court of Luxembourg, Belgium; “Mediation in criminal justice; referrals by prosecutors in the prosecutorial phase and referrals by judges in the presentencing phase”, National Coordinator on Mediation in Criminal Cases, Netherlands; “Digital Justice”, Sub-directorate-General for New Technologies, Directorate General of Justice Modernization, Technological Development, Recovery and Asset Management (Ministry of Justice), Spain;
welcomed the organisation of the first edition of the Junior Crystal Scales of Justice Prize in partnership with the Strasbourg Law Faculty, which complements the main “Crystal Scales of Justice” Prize.
took note of the information given by its Observers, the European Association of Judges (EAJ), the European Expertise and Expert Institute (EEEI), the European Union of Rechtspfleger and Court Clerks (EUR), the International Union of Judicial Officers (UIHJ), and the OECD, thanked them for their concrete contribution to its activities, and invited them to further contribute to the implementation of the CEPEJ activity programme.
thanked the Secretariat for the modifications made on the CEPEJ website allowing easier access to the CEPEJ tools;
took note that the 34th and 35th plenary meetings of the CEPEJ could take place on 11-12 June 2020 in Paris and 8-9 December 2020 in Strasbourg respectively.
