Abridged report

A.         FOREWORD

The Council of Europe’s European Commission for the Efficiency of Justice (CEPEJ) held its 34th plenary meeting online on 8 December 2020. The meeting was chaired by Mr Ramin GURBANOV (Azerbaijan), President of the CEPEJ.

The agenda and list of participants appear in the Appendix.

The Director of Human Rights at the Council of Europe, recalled the challenges and work to be examined during this meeting. He informed the CEPEJ that Mrs Hanne JUNCHER, Head of the Department for Legal and Judicial Cooperation and the authority under which the Secretariat of the CEPEJ is placed, will leave the Department to take up the functions of Executive Secretary of GRECO and Head of the Department of action against crime. The Director thanked Mrs JUNCHER for her contribution which had enabled the CEPEJ to gain in importance and visibility.

B.         LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ

The CEPEJ:

1.            Evaluation process of European judicial systems

§  welcomed the presentation of the Evaluation report of the CEPEJ “European judicial systems”, 2020 Evaluation cycle (2018 data) in its new design splitting it into three parts (Tables, graphs and analyses – Country profiles – CEPEJ-STAT Database) and noted with satisfaction the excellent reception of the report by the Committee of Ministers, the Conference of European Ministers of Justice where it was presented, as well as during the Press Conference and across the European media;

§  decided to launch the next evaluation process on the basis of data of the year 2020, with a view to publishing the results in 2022 and adopted the revised Evaluation Scheme (CEPEJ(2020)16) for this purpose, subject to any additional amendments that may be proposed by the CEPEJ-GT-EVAL during its meeting in January 2021, and instructed the CEPEJ-GT-EVAL to adapt the explanatory note accordingly; agreed that the electronic Scheme should be opened for reply by national correspondents as from March 2021 until 1 October 2021; 

§  welcomed the continuation of the cooperation with the European Commission, based on the CEPEJ’s own  methodology as regards evaluation, concerning: (i) an annual study on the functioning of judicial systems in EU member States; (ii) an annual evaluation of the functioning of judicial systems in the States and entities of the Western Balkans; (iii) starting in January 2021, an annual evaluation of the functioning of the judicial systems in the Eastern Partnership countries(Armenia, Azerbaijan, Belarus, Georgia, Republic of Moldova, Ukraine) and instructed the CEPEJ-GT-EVAL to pursue this cooperation which strengthens the CEPEJ’s preeminent role as regards justice evaluation, as well as the synergies between the European Union and the Council of Europe in this field;

2.            Quality of justice

§  adopted a feasibility study on the possible introduction of a mechanism for certifying artificial intelligence tools and services in the sphere of justice and the judiciary (part 2 of document CEPEJ(2020)15) and decided to submit it to the Committee of Ministers for it to take note of it;

§  noted that such a mechanism for certifying artificial intelligence tools and services would be one of the possible follow-ups given to the European Ethical Charter on the use of artificial intelligence in judicial systems and their environment, adopted by the CEPEJ in December 2018;

§  instructed the Secretariat to submit, as soon as possible, part 1 of document CEPEJ(2020)15 containing the options for the deployment of such a mechanism, for comments, to all CEPEJ members and observers by 20 January 2021, and instructed the CEPEJ-GT-QUAL to take these comments into account, at its meeting in February 2021, in order to propose a Roadmap to the CEPEJ to be examined at its plenary meeting in June 2021; this Roadmap, which should also elaborate on the legal basis for such a mechanism, could be, if appropriate, submitted to the Committee of Ministers in September 2021;

§  took note of the on-going work of the CEPEJ-GT-QUAL on (i) diversity in the careers of judges, (ii) the centrality of the user in legal proceedings in civil matters, (iii) the simplification and clarification of language with litigants and (iv) mediation;

3.                        Judicial time management

§  took note of the ongoing work of the CEPEJ-SATURN on (i) dashboards for courts, (ii) the modification of the existing guidelines on judicial time management (CEPEJ(2018)20) in order to include lawyers, court staff, judicial experts and enforcement agents, and (iii) the case-weighting system, for which guidelines will be prepared in order to facilitate its implementation, following the Report on case-weighting in judicial systems recently adopted by the CEPEJ;

§  took note of the future work to develop a tool to set out as precisely as possible the stages of civil proceedings in order to better pinpoint delays and thus better combat them, which would be based on the replies to a questionnaire on civil proceedings which will be sent to the CEPEJ's Pilot Courts;

4.            Cyberjustice and Artificial Intelligence

§  adopted the roadmap and the work plan of the CEPEJ-GT-CYBERJUST (CEPEJ(2020)14REV) concerning the judicial e-file, online dispute resolution, online enforcement of court decisions, as well as the use of videoconferencing during hearings, and recalled the priority to be given to this latter work in order to meet the needs of the European courts that had emerged during the COVID 19 health crisis;

§  agreed that the CEPEJ-GT-CYBERJUST will prepare, for the CEPEJ, tools to use new technologies and/or artificial intelligence mechanisms in judicial systems in order to improve the efficiency and quality of justice, as other CEPEJ working groups do in the fields of quality, evaluation and timeframes of proceedings, underlined the specificity of these missions compared to the competence to develop general norms and standards, and in this context, recalled the need to ensure appropriate coordination with Council of Europe bodies such as the European Committee on Legal Co-operation (CDCJ) and the Ad hoc Committee on Artificial Intelligence (CAHAI);

5.            CEPEJ’s participation in Council of Europe cooperation programmes

§  took note of the current co-operation programmes (Albania, Azerbaijan, Spain, Georgia, Kosovo*, Latvia, Malta, Republic of Moldova, Slovak Republic, Morocco, Tunisia and South IV Programme) which were presented, through a video, featuring the managers responsible for these programmes based in Strasbourg and in the field, on the ongoing activities and the achieved results;

§  welcomed the progress and adaptations that were made during implementation to meet the needs of beneficiaries, particularly following the closure of courts, and encouraged all stakeholders to continue their efforts to carry out these programmes despite the delays caused by the COVID 19 health crisis;

6.            Relations between the CEPEJ and other bodies of the Council of Europe

§  took note of the ongoing work of the CDCJ and the CAHAI and welcomed the fact that the presidents of these Committees are members of the CEPEJ and CEPEJ-CYBERJUST, respectively, thus facilitating a good coordination of the work;

7.            European Day of Justice

§  thanked the judicial institutions of the 17 member States which organised 23 specific events on the occasion of the European Day of Justice on 25 October 2020, despite the restrictions on access to courts due to the health crisis;

8.            Crystal Scales of Justice Prize

§  invited its members to promote applications to the next edition of the "Crystal Scales of Justice" prize in 2021, whose award ceremony could take place in Slovenia, at the invitation of the Slovenian authorities, on 1 October 2021;

§  took note of the results of the first edition of the Junior Crystal Scales of Justice Prize in partnership with the Faculty of Law of Strasbourg, congratulated the team of the Faculty of Law of Strasbourg (France) and agreed to invite the participating teams to present their projects at the plenary meeting of the CEPEJ to be held in December 2021;

9.            Observers to the CEPEJ

§  because of the lack of time due to the online format of the meeting, invited the observers to send to the Secretariat the relevant information on their current activities of interest to the CEPEJ for inclusion on the CEPEJ website, and recalled the importance of their involvement in the implementation of the CEPEJ activity programme;

10.          Election of the Bureau

§  re-elected Mr Ramin GURBANOV (Azerbaijan) as President for a period of two years, elected Mr Francesco DEPASQUALE (Malta) as Vice-President of the CEPEJ for a period of two years, elected Ms Nino BAKAKURI (Georgia) and Mr Juan Fernando ARMENGOT (Spain) as members of the Bureau for a period of two years;

§  expressed its warmest thanksto Ms Ivana BORZOVÁ (Czech Republic) and Ms Laetitia BRUNIN (France) for their commitment as, respectively, Vice-President of the CEPEJ and member of the Bureau;

11.          Any other business

§  thanked all members, members of the Working Groups, national correspondents and experts for their constant involvement in the various activities of the CEPEJ in 2020, despite the constraints of online meetings in particular, having thus enabled the CEPEJ to accomplish its tasks almost without delay despite the COVID 19 health crisis;

§  recalled in particular, the importance of ensuring an appropriate follow-up to the Declaration on lessons and challenges faced by the judiciary during and after the COVID 19 pandemic, which the CEPEJ adopted on 10 June 2020 during an ad hoc meeting, by fleshing out, if a need is expressed by the judicial systems, the principles contained therein;

§  welcomed the work which has started in the different Working Groups aiming at identifying and developing training modules on CEPEJ tools, in particular to reinforce the impact of the CEPEJ co-operation programmes;

§  took note that the 35th and 36th plenary meetings of the CEPEJ could take place, respectively, on 16-17 June 2021 (Malta, TBC) and on 8-9 December 2021 (Strasbourg), and that all the meetings of the Working Groups and Networks are indicated in the calendar on the CEPEJ website.

The member of the Bureau, Francesco DEPASQUALE (Malta), is coming to the end of his term of office. He can be re-elected for a period of 2 years.

The member of the Bureau, Laetitia Brunin (France), is coming to the end of her term of office but will no longer be a member of the CEPEJ in 2021. The position of member of the Bureau is vacant.
