MODEL FORM FOR THE EXCHANGE OF JUDICIAL RECORDS

According to its Terms of Reference for 2020-2021, the first specific task of the PC-OC is to improve the efficient functioning of the European Convention on Mutual Assistance in Criminal Matters and the Additional Protocols thereto, including by the development of practical tools such as the present model form designed to facilitate the exchange of information from judicial records.
During its meeting in January 2020, the PC-OC Mod examined the replies to a questionnaire on the exchange of judicial records as foreseen by Articles 13 and 22 of the Convention and, noting the difficulties encountered by the Parties, supported the proposal to develop a standard form to facilitate the sending of these records on the basis of Article 22.
This standard form, prepared in collaboration with Mr Yann Taraud, Head of office for specialized files and international exchanges of the French Ministry of Justice, was discussed in the 78th plenary meeting of the PC-OC and finalised during their 79th meeting in May 2021.

En vertu de son mandat pour 2020-2021, la première tâche spécifique du PC-OC est d'améliorer le fonctionnement efficace de la Convention européenne d'entraide judiciaire en matière pénale et de ses protocoles additionnels, notamment par l'élaboration d'outils pratiques tel que le présent formulaire standard conçu pour faciliter l'échange d'information de casiers judiciaires.
Lors de sa réunion en janvier 2020, le PC-OC Mod a examiné les réponses à un questionnaire sur l’échange des casiers judiciaires tel que prévu par les articles 13 et 22 de la Convention et, notant les difficultés rencontrées par les Parties, a soutenu la proposition d'élaborer un formulaire standard pour faciliter l'envoi de casiers judiciaires sur la base de l’article 22.
Ce formulaire standard, préparé en collaboration avec M. Yann Taraud, Chef du bureau des fichiers spécialisés et des échanges internationaux du ministère de la Justice français, avait été discuté durant la 78me réunion du PC-OC et a été finalisé durant sa 79me réunion en mai 2021.
