Welcome to the Chisinau Office Newsletter!

Thank you for signing up to keep in touch with the Council of Europe Office in Chisinau. October was an intense month, full of events, meetings, trainings, launching of new platforms in the media field and great exchanges with our national key stakeholders.

This month, the Council of Europe, jointly with the national public broadcaster “Teleradio-Moldova” launched a new media product on the market - the first multimedia digital platform in the Republic of Moldova for children aged 5-10 years old.

The Council of Europe High Level Working Group on Justice Reform and the President of the Venice Commission visited the Republic of Moldova, meeting the representatives of the Moldovan authorities. The President of the Venice Commission, Gianni Buquicchio and the Director General of the Directorate General Human Rights, Christos Giakoumopoulos, held a press briefing.

In October, the Parliament of the Republic of Moldova ratified the Council of Europe Convention on preventing and combating violence against women and domestic violence. Visit the page dedicated on the 10th anniversary of the Istanbul Convention to see more information about the Convention, what are the key myths and facts, and to hear the voices of experts, multidisciplinary teams, practitioners, artists, journalists, or athletes who have advocated for the ratification of the Convention.

The team of the Council of Europe Office in Chisinau engaged key partners and beneficiaries in activities in the electoral field, prevention of torture, combating hate crime and discrimination etc. Read our newsletter to know more about this month’s highlights.

Zuper.md - the first multimedia platform for children in Moldova, developed with Council of Europe support

Educative, friendly, and interactive, the new platform of the public broadcaster, zuper.md can be easily and safely accessed anywhere and anytime. Multimedia products, such as night stories, podcasts, video shows, tales, audio lessons, quizzes and games are created in an accessible manner, ensuring the children’s access to an assortment of multimedia services that meet their informational, educational and recreational needs.

Zuper.md represent a new media product on the market - the first multimedia digital platform in the Republic of Moldova for children aged 5-10 years old. The platform was launched on 21st of October, by the Council of Europe, jointly with the national public broadcaster “Teleradio-Moldova”.

A comprehensive analysis of the International Election Observation Missions and the Venice Commission’s recommendations and opinions presented for the first time
About 50 representatives of the electoral management bodies, Parliament, Ministry of Justice and civil society from the Republic of Moldova were provided for the first time with a comprehensive analysis carried out by an international and a national experts, indicating the level of implementation of the relevant International Election Observation Missions and the Venice Commission of the Council of Europe recommendations and opinions issued between 2014-2021.

ALTERNATIVE VOTING METHODS FOR THE REPUBLIC OF MOLDOVA

More than 50 participants, representatives of national authorities, international organizations, civil society organizations were familiarized with the main alternative voting methods during the Round table “ALTERNATIVE VOTING METHODS: best practices towards the Republic of Moldova”.

The aim of the event was to bring in the international good practices and the Council of Europe standards on alternative voting methods more specifically on electronic voting, as well as and advantages, disadvantages, and associated risks.

Training of youth workers on the Reference Framework of Competences for Democratic Culture

22 youth workers have been trained on the way to apply the Council of Europe’s Reference Framework of Competences for Democratic Culture (RFCDC) in non-formal education during a 3-day online seminar organised by the Council of Europe Project “Education for Democracy in the Republic of Moldova”, in cooperation with the United Nations Population Fund in Moldova.

The event was organised in the context of wider efforts to ensure coherence between the formal and non-formal civic education in the Republic of Moldova, and to support the application in practice of the Methodological guidelines on the organization of the educational process in the discipline Education for society for the years 2020-2021 and 2021-2022 adopted by the Ministry of Education and Research to facilitate the cooperation between schools and youth centres.

Meeting with decision makers on the Committee of Ministers Recommendations on the Guidelines to respect, protect and fulfil the rights of the child in the digital environment

The Council of Europe project Combating violence against children in the Republic of Moldova organised an online event on presenting and discussing the Committee of Ministers Recommendations on the Guidelines to respect, protect and fulfil the rights of the child in the digital environment.

The purpose of the guidelines is to assist states and other relevant stakeholders in their efforts to adopt a comprehensive, strategic approach in building and containing the complex world of the digital environment. Ensuring children’s interaction and safety in this environment is paramount.

International Conference on Safe Sport for Children: International Practices for Child Protection in Sport for sports coaches and teachers

Around 80 professionals working with children in sport participated in the International Conference on Safe Sport for Children: International Practices for Child Protection in Sport for sports coaches and teachers.

The Conference main purpose was to exchange experiences and practices for the prevention of violence against children in sports, especially the child sexual exploitation and abuse in sport, as well as to present and discuss the measures to address the risks of violence in sports activities with children.

Clerks from Moldovan courts consolidate their knowledge on combating discrimination

Clerks from Moldovan courts participated in an online training course on how to deal with cases of discrimination, through the perspective of the European Convention for Human Rights and the national legislation. 

The training focused on the prohibition of discrimination under the European Convention for Human Rights, Moldovan legislation, and elements of discrimination in the European Court of Human Rights case law.

Prosecutors and judges further enhance their knowledge on the application of constraint measures

On 13 October 2021 a seminar on the procedure for the examination of motions on the application and extension of constraint measures was organized by the Council of Europe Project “Strengthening the human rights compliant criminal justice system in the Republic of Moldova” in cooperation with the National Institute of Justice (NIJ) of Moldova.

The seminar brought together judges and prosecutors, who built their skills in applying and reasoning the concept of reasonable suspicion in the procedures for the application of pre-trial detention and house arrest. The participants updated their knowledge on the recent European Court of Human Rights (ECHR) standards and case-law related to Article 5 in the context of Covid-19 pandemic situation.

Electoral management bodies from Gagauzia were trained how to organise elections of People’s Assembly in line with European standards
During July-September 195 members of three district electoral councils and sixty-six precinct electoral bureaus took part in the online and offline trainings for electoral management bodies (EMBs) in the context of the People’s Assembly of Gagauzia elections. The first round took place on September 19 and the second - on October 3, 2021.

As a result, electoral management bodies were prepared and dealt in professional manner with the organisation and conduct of the above-mentioned elections. The positive indicator to this regard is the Court of Appeals Comrat’s decision on validation of the elections results and all 35 members of the regional representative authority received their mandates.

Improving cooperation between Central Electoral Commission and other electoral stakeholders

The Council of Europe expert presented to the Central Electoral Commission of the Republic of Moldova (CEC) the main findings of the study (assessment) mapping obstacles and conditions for the improvement of cooperation/communication between the CEC and electoral stakeholders.

The assessment has been realised based on the Communication Plan and Strategic Plan for 2020-2023 of the CEC, questioning and interviewing the stakeholders such as political parties, women, youth, civil society, media.
This activity is funded and implemented by the Council of Europe Project Improving Electoral Practice in the Republic of Moldova, Phase II.

Council of Europe HELP online course on Alternative Measures to Detention is now available to lawyers

50 lawyers have been enrolled into the HELP course “Alternative Measures to Detention” launched online on 15 October 2021  for Moldovan lawyers in cooperation with the Bar Association and the Training Centre of the Bar Association of the Republic of Moldova.

The course is part of the Council of Europe’s extensive Programme of Human Rights Education for Legal Professionals (HELP) that supports Council of Europe member states in implementing the European Convention on Human Rights at the national level.

Republic of Moldova: the PACE monitoring co-rapporteurs welcome the authorities’ determined action to reform the judicial system and fight corruption

At the end of a fact-finding visit to the Republic of Moldova (12-15 October), the monitoring co-rapporteurs of the Parliamentary Assembly of the Council of Europe (PACE), Inese Lībiņa-Egnere (Latvia, EPP/CD) and Pierre-Alain Fridez (Switzerland, SOC), welcomed the determination of the Moldovan authorities to reform the judiciary to strengthen its independence and to fight corruption, creating a momentum for change aimed at addressing the concerns of the population.

PACE rapporteurs congratulate the Parliament of the Republic of Moldova for adopting the ratification law on the Istanbul convention

The monitoring rapporteurs of the Parliamentary Assembly of the Council of Europe (PACE), Inese Lībiņa-Egnere (Latvia, EPP/CD) and Pierre-Alain Fridez (Switzerland, SOC) congratulated the Republic of Moldova for the progress achieved on the ratification of the Istanbul Convention: “The Moldovan parliament took today an historical and decisive step to better protect women, combat domestic violence and build a society that values the respect for fundamental human rights in all spheres of life”.

The first steps for accreditation of Electoral Training Centre as an educational institution started

The Council of Europe, in co-operation with the Centre for Continuous Electoral Training within the Central Electoral Commission of the Republic of Moldova (CCET), is working on a roadmap for accreditation of the CCET as an educational institution in line with the relevant legislation of the Republic of Moldova.

The Council of Europe Project Improving Electoral Practice in the Republic of Moldova, Phase II will aid the CCET in the self-assessment process and quality of its training programmes. Finally, the experience on the accreditation will be analysed in the countries with similar electoral training bodies.

Mechanisms to consolidate the activity and performance of the Judicial Inspection in the Republic of Moldova discussed at an online roundtable with justice sector institutions

The Action against Corruption in the Republic of Moldova presented the results of the assessment of the national framework and internal practices of the Judicial Inspection during an online roundtable on 13 October 2021. The event was attended by representatives of the Superior Council of Magistracy and its professional boards, the Ministry of Justice, development partners and civil society organizations.

The event facilitated an exchange of opinions between the national authorities and Council of Europe experts on possible mechanisms to further consolidate the national framework and existing practices on the activity of the Judicial Inspection in line with GRECO recommendations and international good practices.

Round table – principles of humanisation and liberalisation of criminal policies and criminal law

On 5 October 2021 the Council of Europe Project “Strengthening the Human Rights Compliant Criminal Justice System in the Republic of Moldova” held an online round table to discuss the principles of humanization and liberalization of criminal policies and criminal law.

The humanisation of criminal law and criminal justice and the promotion of human rights compliant criminal justice system has been among key priorities within the reforms of the justice sector in the Republic of Moldova since many years. Numerous amendments introduced to the Criminal Code and the Criminal Procedure Code over the last years emphasize the commitment of the country to establishing a more humane approach to criminal sentencing.

Judicial assistants, registrars and prosecutors’ consultants from the Republic of Moldova increased their knowledge on the thematic of combating hate crime

More than 40 participants, including judicial assistants, registrars and prosecutors’ consultants from the Republic of Moldova participated in a one-day training course on combating hate crime. The training was carried out by the regional project “Strengthening access to justice for victims of discrimination, hate crime and hate speech in the Eastern Partnership” in co-operation with the National Institute of Justice of the Republic of Moldova.

The training aimed to increase the knowledge and abilities related to cases of hate crimes, including the national regulation and international practice in the field, and to develop specific competences in working with victims of hate crimes.

Good practices of the Council for the Prevention of Torture during the implementation of their mandate

On 8 October 2021 members of the National Preventive Mechanism and representatives of the People’s Advocate Office participated in an online round table on presentation of good practices by the members of the Council for the Prevention of Torture of the Republic of Moldova achieved during the implementation of their mandate.

The round table gathered human rights lawyers, representatives of the civil society and international organisations, representatives of the Ministry of Justice and Parliamentary Committees for human rights and inter-ethnic relations and Legal Committee for appointments and immunities, and other stakeholders.

Professional development course for medical and non-medical staff of the penitentiary system of the Republic of Moldova

A fourteen-weeks’ professional development course for medical and non-medical staff of the prison system of the Republic of Moldova has started on 19 July and finished on 27 October 2021, when, as a result of the course, an overall number of 121 accreditations were issued to medical and non-medical professionals from the prison system.

The added value of the course is that it has been delivered by an educational institution accredited to provide continuing education based on a curriculum agreed with the Ministry of Education, Youth and Spots as well as with the Ministry of Health. Therefore, the academic credits issued on the grounds of the courses are in line with the national regulations. This factor constitutes a step forward towards aligning the healthcare services provision in prisons to the requirements of the public healthcare services as well as to the Council of Europe recommendations in the field.

Consultation meeting on the progress in piloting the Risks and Needs Assessment tool in selected prisons and probation offices

The first consultation meeting on the progress in piloting the Risks and Needs Assessment (RNA) tool for prisoners and offenders ARIC (Assessment of Reintegration, Intervention and Conclusion) in 4 selected prisons and 4 probation offices was conducted online on 04-05 October 2021.

This meeting allowed prison and probation staff to provide comprehensive feedback on the completed questionnaires of the RNA tool. The purpose of the RNA tool is to ensure a smooth transition of prisoners released from prison to probation supervision.

Lawyers learn using the standards of Article 5 ECHR in the application of preventive measures

On 1 October 2021 an online seminar on standards of Article 5 of the ECHR during the application of preventive measures was organized for free legal aid lawyers in cooperation with the National Institute of Justice of the Republic of Moldova.

The seminar focused on pre-trial detention and aimed to build the free legal aid lawyers’ skills in interpreting and applying the standards of Article 5 of the ECHR during the application of the preventive measures. The participants also got acquainted with the relevant requirements of ECtHR standards and case-law in regard to medical treatment of persons in pre-trial detention.

Workshops for sports coaches and teachers
In the period of 5-6 October 2021, the NGO Association for the Empowerment of Children and Families “AVE Copiii” under the grant agreement with the Council of Europe project Combating violence against children in the Republic of Moldova organised two workshops on Child protection in sport activities. The activity was organised in cooperation with the National Olympic and Sports Committee.
Workshops for sports coaches and teachers

During both events participants were familiarized with the theoretical and practical aspects on child protection, international and national regulations, basics of an internal child protection procedure and examples of good practices.
