Invito a presentare esempi di buona prassi sulle procedure relative all’immigrazione adattate ai minori rifugiati e migranti
Il Consiglio d’Europa si impegna ad assistere i propri Stati Membri per sviluppare strategie per rispondere ai problemi che riguardano i minori rifugiati e migranti, con un’attenzione speciale per i minori non accompagnati o coloro che sono stati separati dalle proprie famiglie. Il Piano d’azione del Consiglio d’Europa sulla protezione dei minori rifugiati e migranti in Europa (2017-2019) descrive le azioni concrete che il Consiglio d’Europa si impegna a intraprendere, raggruppati attorno a tre pilastri. Per quanto riguarda il primo pilastro, le azioni mirano a garantire l’accesso ai diritti e a procedure a misura di bambino.
In questo contesto, l’Ufficio del Rappresentante Speciale per le migrazioni e i rifugiati preparerà e pubblicherà una raccolta di ‘good practices’ sulle procedure a misura di bambino inerenti all’immigrazione. Il Consiglio d’Europa desidera dunque raccogliere degli esempi di buona pratica e pratiche promettenti, di mezzi e metodi usati per rendere le procedure maggiormente adeguate ai bambini. Gli esempi ricevuti aiuteranno alla preparazione di un manuale indirizzato agli Stati Membri e a tutti gli attori coinvolti nell’elaborazione e messa in atto delle procedure per rifugiati e migranti a misura di bambino. Inoltre, contribuendo all’elaborazione del manuale, gli Stati e gli altri attori interessati avranno la possibilità di far meglio conoscere le loro buone pratiche, e di diffonderle e valorizzarle tra gli Stati Membri del Consiglio d’Europa.
Le pratiche possono concernere le procedure che coprono ogni stato del procedimento relativo all’immigrazione in Europa, in particolare:
1. Identificazione
2. Registrazione
3. Valutazione e determinazione del migliore interesse del minore
4. Determinazione dell’età
5. Relocation interna ed esterna
6. Protezione del bambino e accesso ai diritti fondamentali (alloggio, educazione, salute, assistenza)
7. Supporto speciale per bambini particolarmente vulnerabili, in particolare i bambini vittime di sfruttamento e abuso
8. Nomina tutori
9. Rappresentanzione legale
10. Domanda d’asilo e domande relative ad altri status d’immigrazione
11. Ricongiungimento familiare
12. Ritorno al paese d’origine
13. Soluzioni a lungo termine, come ad esempio integrazione locale e transizione verso l’età adulta
14. Altre procedure in applicazione della legge (restrizione della libertà personale, procedure penali, controllo di frontiera etc)
15. Ricorsi amministrativi e giudiziari (sulle domande d’asilo e altri status d’immigrazione)
Coloro che risponderanno a questo invito dovranno dimostrare come le loro pratiche siano adattate ai bambini e rispondenti a criteri, tra cui: considerazione del migliore interesse del minore, rispetto per la dignità, integrità, identità e vita privata; inclusione; non-discrimazione ed eguaglianza di genere; partecipazione; informazioni comprensibili ai bambini; assistenza/rappresentazione adeguata; accessibilità; ambienti appropriati; un approccio multidisciplinare etc.
Le persone che rispondono a questo invito sono pregate di compilare il formulario in allegato e di inviarlo a [email protected]. E’ importante fornire informazioni più dettagliate e concrete possibili riguardo le buone pratiche, preferibilmente accompagnate da documentazione, come ad esempio siti web, report, video, account social media etc. Preferibilmente, si prega di fornire traduzioni in inglese o francese dei documenti allegati (o un riassunto di questi). Il Consiglio d’Europa ha discrezione riguardo alla scelta delle pratiche che verrano incluse nella raccolta.
