Developing Mediation Practices in Civil Disputes in Turkey (VC 3186)

Objectives
1) To present and analyse the current situation of Mediation in Turkey.
2) To up-date project work plan and working schedules; experts, project staff, MoJ
3) To review and finalise performance indicators of the Project
4) To decide about mediation curriculum strategy working with international experts
5) To review and comment on selection criteria for the pilot courts (5 courthouses)
6) To identify study visit countries
7) To inform participants about reporting and reporting requirements in the Project and set out expectations and decide about contributions from the experts.
8) Review of the Fact-Finding Mission report and working principles in line with amendments of the current mediation legislation.

Ms Özlem Demirel will briefly recall Project objectives and activities, outline key issues which will be dealt with during the meeting and present any recent developments in the field of mediation in Turkey (40’). Questions will follow (20’)

A. Review of the Project
1. Presentation of the situation of Mediation in Turkey by the MoJ Department Head.
2. Review and finalisation of the Project Work Plan
- Review project work plan and make comments on it.
- Identify methodology for baseline survey including target groups to be surveyed, role of beneficiary, project stakeholders and consultants (national and international)
3. Amendment of legislation: Use of fact-finding mission report developed by the CEPEJ expert and feedback from the MoJ; Calendar of events for legislation WG; applying CEPEJ /European Mediation Rules and methodology for amending existing legislation.
4. Training Component : Presentation of the problems as regards the training on mediation by the MoJ
a. Review of existing curriculum samples and definition of a methodology for the development of the standardised curriculum guidelines in line with the Project Work Plan and indicators.
b. Decide about sample range of general and specialized mediation training curriculum to be developed under the project.
5. Review and comment about selection criteria for 5 pilot mediation courthouses in which the mediation scheme will be applied
6. Identification of European countries which could be considered as suitable destinations for the Study Visits (2) (each for 5 workdays/10 participants)
B. Final Review of the performance indicators that will be used in mid-term and final evaluation of the Project, and revise them if necessary.
