ABRIDGED MEETING REPORT
A. FOREWORD
1. The Consultative Council of European Prosecutors (CCPE) held its 13th plenary meeting in Strasbourg on 22-23 November 2018. It was chaired by Peter McCORMICK (Ireland), President of the CCPE. The agenda and the list of participants are appended.
B. ITEMS SUBMITTED TO THE COMMITTEE OF MINISTERS FOR DECISION
2. The CCPE invited the Committee of Ministers:
a. to take note of Opinion No. 13 (2018) on “Independence, accountability and ethics of prosecutors”;
and to note that this document would be forwarded to the relevant bodies in the member States, which would be encouraged to have it translated if need be, and to the relevant bodies of the Council of Europe in order that they may take account of it in their own work;
b. to take note of this report as a whole.
C. LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CCPE
3. opened its meeting by a minute of silencein tribute to Mr Harald RANGE, former President of the CCPE in 2007 and 2008, who had passed away. Mr RANGE remained active after his retirement, following closely the work of the CCPE. He had been entrusted by the CCPE with preparing the draft Opinion for 2018. The CCPE underlined Mr RANGE's outstanding contribution to the work of the CCPE;
4. took note of the information given by its President and its members and observers who had participated in various fora where the work of the CCPE had been presented and discussed;
5. agreedthat the Bureau would prepare the next "Situation report on the independence and impartiality of the prosecution services in the Council of Europe member States" in accordance with the CCPE’s terms of reference for 2019 and contributing to the implementation of the Council of Europe Plan of Action on strengthening judicial independence and impartiality;
6. adopted its Opinion No.13(2018) on “Independence, accountability and ethics of prosecutors” (CCPE(2018)2), subject to possible amendments on the form by its Bureau, which was entrusted to do so if needed, in order to ensure the necessary consistency between the English and French versions;
decided to submit it to the Committee of Ministers to take note of; invited member States to ensure its distribution as widely as possible among decision-makers and professionals of justice, including its translation where needed; decided to transmit it also to the observers to the CCPE as well as to the CEPEJ, the CCJE, the CDPC and its subordinate committees, so that they may take it into account in the course of their work;
7. decided to address in its 2019 Opinion the topic of the role of the prosecutor in the fight against corruption and economic and financial crimet and instructed its Bureau and the Working Group appointed for 2019 to define the exact title and to prepare a draft Opinion on this topic to be adopted at the CCPE’s 14th plenary meeting;
8. took note of the Committee of Ministers’ request addressed to the CCPE in particular for comments on PACE Recommendation 2142 (2018) on “Deal-making in criminal proceedings: the need for minimum standards for trial waiver systems” and decided to send comments, if any, to the Secretariat before 3 December 2018;
9. appointed Milica ANDJELIĆ-MANDIĆ (Montenegro), Erkin ALIKHANOV (Azerbaijan), David MELKONYAN (Armenia), Han MORAAL (The Netherlands), Peter McCORMICK (Ireland), Antonio MURA (Italy), Ali RIZA ÜLKER (Turkey), Cédric VISART de BOCARME (Belgium), Vladimir ZIMIN (Russian Federation) as members, and Jana ZEZULOVA (Czech Republic) as substitute member of the Working Group (CCPE-GT) responsible for preparing the 2019 draft Opinion to be submitted to the 14th plenary meeting of the CCPE;
10. elected José Manuel SANTOS PAIS (Portugal) as President and Antonio VERCHER NOGUERA (Spain) as Vice-President for 2019; elected Alessandra GIRALDI (Denmark) and Robert GELLI (France) as members of the Bureau for 2019 and 2020;
11. designated Gordana BOSILJCIC (Bosnia and Herzegovina)as the Gender Equality Rapporteur for 2019;
12. proposed to hold its 14th plenary meeting on 21-22 November 2019 in Paris;
13. proposed to hold the meetings of the Working Group (CCPE-GT) on 5-6 February 2019 and 6-7 June 2019; thankedthe member of the CCPE in respect of Italy for his invitation to hold, if necessary, one of the two meetings of the Working Group in Venice, at the Prosecutor General's Office; noted that the decision on the meeting venues would be taken later, in accordance with the rules of the Council of Europe.
