Execution of the judgments of the European Court of Human Rights

Eighty cases against Romania

(see Appendix for the list of cases)

(Adopted by the Committee of Ministers on 8 June 2016
at the 1259th meeting of the Ministers’ Deputies)

The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Having regard to the final judgments transmitted by the Court to the Committee in these cases and to the violations of Article 6, paragraph 1, and of Article 13 of the Convention established therein on account of the excessive length of civil or criminal proceedings and the absence of an effective remedy in this respect; having regard also to the other violations of the Convention and/or of Protocol No. 1 established in the cases of Riccardi, Gheorghe, Dan Cristian Ionescu, S.C. Apron Dynamics SRL Baia Mare and Abramiuc;

Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:

-       of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum; and

-       of general measures preventing similar violations;

Having noted that the just satisfaction, where awarded, has been paid by the government of the respondent State and that the proceedings at issue in these cases are now completed; having also noted that, where required, all individual measures were adopted in response to the other violations established in some of these cases;

Noting with satisfaction the wide-ranging measures adopted in the context of the recent judicial reform to resolve the problem of excessive length of civil and criminal proceedings as well as the mechanisms set up by the Romanian authorities to monitor the impact of the measures adopted so far and to adopt rapidly any additional and/or corrective measure which may be required;

Noting that the Committee will assess the impact of these measures and will continue to supervise the questions related to the setting up of effective remedies in this field in the context of the remaining cases of the groups of Nicolau and Stoianova and Nedelcu, and in particular Vlad and Others;

Noting finally that the general measures required in response to the other violations of the Convention and/or Protocol No. 1 established in some of these cases are or were examined in the group of cases Săcăleanu, the case of Weissman and others (closed by Final Resolution CM/ResDH(2011)249) and the Calmanovici group (closed by Final Resolution CM/ResDH(2014)13) as well as in the case of Albina (closed by Final Resolution CM/ResDH(2010)181);

DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in the cases listed below and

DECIDES to close the examination thereof.
