Summary of the debates

Introduction

1.         A high-level meeting of ministries of the Interior, organised by the Council of Europe (hereafter “CoE”) jointly with the Ministry of the Interior of Poland, within the framework of the Cooperation Programme, was held in Warsaw on 17-18 March 2005.  The topic was “Fight against terrorism and organised crime to improve security in Europe”.  The list of participants, the programme and the adopted resolution can be found in Appendices I to III of this report.

2.         The opening session was chaired by Mr. Rysard KALISZ, Minister of the Interior and Administration of Poland, and speeches were presented by: Mr. Terry DAVIS, Secretary General of the Council of Europe, Mr Jan TRUSZCZYNSKI, Secretary of State, Ministry of Foreign Affairs of Poland, on behalf of the Committee of Ministers of the Council of Europe, Mr Michel HUNAULT, member of the Parliamentary Assembly of the Council of Europe.

Mr Aleksander KWASNIEWSKI, President of Poland, addressed the participants in the morning of Friday 18 March, on the need to fight terrorism and organised crime at European level, stressing the importance of European co-operation among competent national authorities to defend democracy and human rights against the threats that represent these criminal phenomena.

The meeting was closed by Mr Ryszard KALISZ, Minister of the Interior and Administration of Poland, and Mr. Terry DAVIS, Secretary General of the Council of Europe.


Summary of the working sessions

3.         Five working sessions took place and were chaired by: Mr Ryszard KALISZ, Minister of the Interior and Administration of Poland, Mr Zdzislaw GALICKI, Director of the Institute of International Law, University of Warsaw, Mr Pawel DAKOWSKI, Undersecretary of State, Ministry of the Interior of Poland, Mr Antonio CAMACHO VIZCANO, Secretary of State for Security, Spain, Mr Andrej KALWAS, Minister of Justice of Poland.

4.         The following participants acted as rapporteur of the working sessions introducing discussions by a presentation as follows:

Ms Gertude KABELKA, Chair of the Council of Europe Committee of Experts on Terrorism presented the Council of Europe legal instruments, both existing ones and those currently under elaboration, in the field of the fight against terrorism.

Minister Giorgios VOULGARAKIS, Ministry of Public Order of Greece, spoke about national measures to be taken against terrorism, while defending Human Rights, in particular in the light of the recent Olympic Games organised by his country.

Mr Emmanuel BARBE, French liaison Magistrate in Italy, illustrated bilateral judicial cooperation on the basis of the Franco-Italian experience and the advantages of bilateral agreements and exchange of liaison magistrates.

Mr Nigel BURROWS, Chairman of the Council of Europe Committee of Experts on Special Investigation Techniques spoke on the role they play in fighting organised crime.

Resolution

Participants adopted a resolution (Appendix I) which expresses concern at the threats that terrorism and organised crime represent for human rights and democracy, calls upon the Committee of Ministers to adopt the legal instruments currently under preparation in the field of the fight against terrorism and organised crime, namely the draft Convention on the Prevention of Terrorism, the draft Convention on laundering search, seizure and confiscation of the proceeds from crime and on the financing of terrorism, the Draft Convention of the trafficking in human beings and the draft Recommendations on Special Investigative Techniques, the Protection of Witnesses and Collaborators of Justice, and on Identity Documents ad Terrorism.  

They also invited member States which have not yet done so to become party to the existing Council of Europe instruments contributing to the fight against terrorism and organised crime as well as other international instruments and to speed up the ratification process of new instruments.

The Resolution also requests the Council of Europe to continue its efforts in the fight against terrorism and organised crime, in particular by standard setting and monitoring activities and through its programmes to enhance capacity of member States to fight terrorism and organised crime.

In particular, paragraph 21 states that Ministers and Heads of Delegations “COUNT on the Third Summit of Heads of State and Government

- to support the strengthening of the role of the Council of Europe in the prevention and control of terrorism, organised and other forms of serious crime through standard setting, monitoring and technical co-operation, and

- to give impetus to the early signature and ratification of the new Council of Europe conventions on terrorism, trafficking in human beings, money laundering and financing of terrorism.”

Action

The Ministers’ Deputies might wish to include this Resolution in the file of the Third Summit of Heads of State and Government.

APPENDIX I

Third High-level multilateral meeting of the Ministries of the Interior

Fight against terrorism and organised crime to improve security in Europe

Warsaw (Poland), 17 -18 March 2005

Resolution

1.         Ministers and Heads of Delegations participating in the Third high-level multilateral meeting of the Ministries of the Interior on the fight against terrorism and organised crime to improve security in Europe (Warsaw, Poland, 17-18 March 2005);

2.         Concerned by the threats posed by terrorism and organised crime to the core values on which Europe is based, namely pluralist democracy, the rule of law and the protection of fundamental rights and freedoms;

3.         Appreciating the efforts undertaken by the Council of Europe to fill gaps in the international legal framework against terrorism, and noting that several conventions and recommendations are about to be completed;

4.         Recalling the successful work carried out by the Council of Europe within the field of crime problems, including organised crime, money laundering, cybercrime, corruption and trafficking in human beings;

5.         Underlining the need to fight terrorism and organised crime while ensuring the protection of human rights, and recalling the Guidelines on Human Rights and the Fight against Terrorism (adopted in 2002), the Guidelines on the Protection of Victims in Terrorist Acts (adopted in March 2005) and the Declaration on “Media and Terrorism” (adopted in March 2005);

6.         Noting the importance of the Third Summit of Heads of State and Government of the Council of Europe, which will be held in Warsaw in May 2005, also in view of the impetus which it will add to the future work of the Council of Europe in the fight against terrorism and organised crime;

7.         APPRECIATE the pro-active response of the Council of Europe towards increasing threats and their impact on European societies, such as terrorism, financing of terrorism, money laundering, trafficking in human beings, cybercrime, and corruption;

8.         PLEDGE to cooperate fully with the Council of Europe in a coherent and systematic approach, consisting of the setting of European standards through treaties and recommendations, monitoring compliance by countries with these standards, and building capacities through technical co-operation programmes;

9.         CALL UPON the Committee of Ministers to adopt the following instruments as soon as possible:

- the draft Convention on the Prevention of Terrorism

- the draft Convention on laundering, search, seizure and confiscation of proceeds from crime and on the financing of terrorism

- the draft Convention on trafficking in human beings

- the draft Recommendations on Special Investigative Techniques, the Protection of Witnesses and Collaborators of Justice, and on Identity and Travel Documents and Terrorism;


10.        PLEDGE to make every effort in their countries to ensure signature, ratification and implementation of these new treaties;

11.        REMIND member States of the need to ratify and implement existing United Nations instruments on terrorism;

12.        INVITE those States which have not yet done so to become Parties to instruments of the Council of Europe which facilitate measures against terrorism and organised crime, in particular the Amending Protocol to the Convention on the Suppression of Terrorism (ETS 190), the Convention on Cybercrime (ETS 185 and its Protocol), the Conventions on Corruption (ETS 173 and ETS 174) and the 2nd Additional Protocol to the European Convention on Mutual Legal Assistance in Criminal Matters (ETS 182), and CALL UPON member States to implement fully treaties of the Council of Europe which are already in force;

13.        CALL for widest possible geographical adherence to the Convention on Cybercrime, given that information and communication technologies are exploited by organised crime and terrorism globally;

14.        REQUEST the Council of Europe to continue its work in the field of terrorism, including the development by CODEXTER of country-profiles on counter-terrorism capacities, the follow-up to activities concerning victims of terrorism, monitoring compliance with the treaties, and to strengthen its co-operation with other organisations and institutions active in the field of the fight against terrorism and organised crime, notably the United Nations, OSCE, the European Union and INTERPOL;

15.        REQUEST the Council of Europe to ensure that its different bodies contribute as much as possible to the prevention and control of terrorism;

16.        SUPPORT the continued preparation of the organised crime situation reports by the Council of Europe, and APPRECIATE that it intends to pay particular attention to the issue of economic crime, also in view of the inadequacy of existing European standards with regard to a rapidly changing phenomenon;

17.        UNDERLINE the need for continued monitoring of compliance by Parties with the requirements of treaties related to terrorism, organised crime, corruption, money laundering and other forms of serious crime, in order to enhance the effectiveness of these treaties;

18.        INVITE all Parties to fully co-operate with existing monitoring mechanisms on corruption (GRECO) and money laundering (MONEYVAL) and to support the creation of the monitoring mechanisms foreseen under the conventions on trafficking in human beings and terrorism;

19.        UNDERLINE the need for comprehensive and integrated training of law enforcement officials involved in measures against organised crime and terrorism, preferably on the basis of common European training standards, and ENCOURAGE Ministries of Interior to develop specific proposals to this effect;

20.        CALL UPON the Council of Europe to support the widest possible implementation of relevant European and other international standards through capacity building programmes, in particular in the fields of financing of terrorism, money laundering, trafficking in human beings, corruption and cybercrime;

21.        COUNT on the Third Summit of Heads of State and Government

- to support the strengthening of the role of the Council of Europe in the prevention and control of terrorism, organised and other forms of serious crime through standard setting, monitoring and technical co-operation, and

- to give impetus to the early signature and ratification of the new Council of Europe conventions on terrorism, trafficking in human beings, money laundering and financing of terrorism.
