3rd meeting

DRAFT MEETING REPORT

1.         The Committee of Experts on the Council of Europe Strategy for the Rights of the Child (DECS-ENF) held its 3rd and final meeting on 20 to 21 October 2015 in Strasbourg, chaired by Ms Ina Verzivolli (Albania), Vice-Chair of the Committee. The agenda, as adopted, appears in Appendix I. The list of participants appears in Appendix II.

Item 1: Opening of the meeting

3.         Mr Gianluca ESPOSITO, Head of the Equality and Human Dignity Department opened the meeting, expressing his satisfaction with the draft implementation report and draft Strategy prepared by the DECS-ENF. Mr Esposito informed participants of the support of many delegations in the Committee of Ministers to set up, directly under its authority, an Ad hoc Committee on the rights of the child for 2016-2017 to guide and evaluate the implementation of the Strategy. He informed the DECS-ENF that the Secretariat would prepare draft terms of reference which would be submitted to the Committee of Ministers together with the draft Strategy early 2016.

Item 4: Implementation report on the Strategy for the Rights of the Child 2012-2015

6.         The Secretariat presented the draft report on the implementation of the 2012-2015 Strategy, which would be finalised by mid-November 2015. The DECS-ENF held an exchange on the report and provided comments.

7.         Following the exchange, the DECS-ENF

-          decided that members would have the possibility of submitting concrete results of the Council of Europe’s standards and work at national level, to be included in the report, by 6 November 2015.

-          instructed the Secretariat to finalise the report based on the comments made at the meeting and to submit it to the Steering Committee on Social Cohesion, Human Dignity and Equality (CDDECS) for approval at its plenary meeting on 9-11 December 2015.

Item 5: Draft Council of Europe Strategy for the Rights of the Child 2016-2021

8.         The DECS-ENF examined in depth the text of the draft Strategy.

9.         During the exchange, Mr Valeriu GHILETCHI, Chairperson of the Committee on Social Affairs, Health and Sustainable Development of the Parliamentary Assembly, shared his satisfaction that the comments by his Committee had been integrated into the Strategy in one way or another. Mr Ghiletchi informed the DECS-ENF of reports currently being prepared in the areas of oversexualisation, radicalisation and migration and that the Network of Contact Parliamentarians on the ONE in FIVE campaign to stop sexual violence against children would pursue its work in 2016.

10.     In the framework of that exchange, the DECS-ENF took note of a presentation by Mr Ansgar EUSSNER, Director of Internal Oversight at the Council of Europe. He noted the importance of ensuring that the Strategy could be effectively evaluated; as such, it would be part of a pilot project which aims at introducing risk management within the activities of the Organisation. The DECS-ENF welcomed the fact that the Strategy clearly defines expected output, outcome and impact as well as potential risks and mitigating actions.

11.     Following that exchange, the DECS-ENF

-          approved the draft Strategy for the Rights of the Child for 2016-2021;

-          entrusted the Vice- Chair of the Committee, in cooperation with the Secretariat,  to finalise the wording of the chapter on violence and on migration in line with the discussions of the DECS-ENF during the meeting; 

-          took note that the bureau of the CDDECS would hold an exchange on the draft Strategy on the following day, 22 October 2015;

-          instructed the Secretariat to circulate the revised draft of the Strategy, including eventual comments by the CDDECS bureau, to the DECS-ENF as soon as possible for information, and to transmit it to the CDDECS for approval at its next meeting in December 2015, and thereafter to the Committee of Ministers for adoption in early 2016.

Item 6: Co-operation with member States and NGOs

12.     The DECS-ENF held an exchange on co-operation with member States and NGOs. As regards member States, many delegations welcomed the support in the Committee of Ministers of the Council of Europe to set up an Ad-hoc­ Committee on the rights of the child to guide the implementation of the Strategy.

13.     Several delegations stressed the importance of being able to rely on comparable and reliable data on the implementation of the Strategy in the future. There was strong support for the suggestion that one of tasks of the future Ad-hoc Committee would be to develop indicators to measure the implementation of the Strategy.

14.     The exchange on co-operation with NGOs was introduced by Ms Camille MASSEY, evaluator in the Directorate of Internal Oversight of the Council of Europe. Ms Massey shared the preliminary results of the evaluation of the co-operation of Council of Europe steering and monitoring committees with NGOs. The DECS-ENF welcomed the information provided.


Item 7: High-level conference to launch the new Strategy

15.     The Secretariat made a presentation on possible themes and working methods of the high-level conference to launch the new Strategy, to be held on 5 and 6 April 2016 in Sofia.

16.     Following a short exchange, the DECS-ENF

-          welcomed the fact that the conference would be hosted by Bulgaria in the framework of the Bulgarian Chairmanship of the Committee of Ministers;

-          expressed interest to be kept informed and involved in the further development of the programme;

-          took note that the Secretariat would ask national delegations in the DECS-ENF in due course for the names and contact details of the respective minister to be invited to the conference.

Item 8: Exchange on children’s rights in the context of current migration challenges

17.     The DECS-ENF held an exchange of views on challenges faced by international organisations and member States in protecting the rights of children on the move or otherwise affected by migration, and in particular of unaccompanied children. The aim of the exchange was to align the response of the Council of Europe to the challenges member States face in respect of this crisis, to be reflected in the Strategy.

18.     The exchange was opened by Mr Christos GIAKOUMOPOULOS, Director for Human Rights and Migration Coordinator of the Council of Europe. He referred to the information document issued by the Secretary General of the Council of Europe entitled Migration Challenges for Europe: need for collective action (SG/INF (2015)33).  He stated that migration challenges are not a new phenomenon in Europe and recalled that many of the Council of Europe institutions have confirmed the challenges of member States in upholding the human rights in this area. He mentioned the work of the Council of Europe Human Rights Commissioner, the case law of the European Court of Human Rights, the recommendations of the Committee for the Prevention of Torture (CPT) and the Group of Action against Trafficking in Human Beings (GRETA), as well as decisions of the European Committee on Social Rights (ECSR) and the Secretariat of the European Commission against Racism and Intolerance (ECRI). However, Mr Giakoumopoulos underlined that in the present crisis the competent state mechanisms in the affected member States are manifestly overwhelmed by the present flow of refugees and asylum seekers into Europe and are therefore at a breaking point. Some of the human rights shortcomings encountered in member States are the conditions of detention of irregular migrants, ineffective status determination procedures, forced return, absence of consideration for particular individual situations, lack of access to fundamental social rights such as shelter, food, health care or education, and often lack of access to justice. The issue of guardianship of children is also a key concern for the Council of Europe. The crisis has therefore placed governments under stress, challenging their capacity to fulfil their national and international commitments and respect existing legislation. The number of migrants entering the European borders is increasing daily and the living conditions of the migrants are extreme. Moreover, the absence of safe and legal routes for asylum seekers into the EU and ambiguity of international responsibilities for search and rescue of people in distress at sea continue to cause tragic losses of thousands of lives.

19.     In the above mentioned information document, the Secretary General recalled member States their key human rights obligations, demanding states to respect them in these times of crisis. Mr Giakoumopoulos explained that the relevant Council of Europe monitoring bodies have a pre-determined work plan which does not allow them to deal effectively with situations of extreme urgency. The Council of Europe does however stand ready to provide assistance to member States, upon request, through co-operation programmes and projects in upholding the rule of law and protecting the human rights of migrants and in particular children.

20.     Ms Jutta SEIDEL, Senior Legal Associate, UNHCR Representation to the European Institutions in Strasbourg, reminded the DECS-ENF that about 1 in every 5 persons arriving in Greece is a child, with a significant increase of unaccompanied and separated children. The main risks to asylum-seeking and refugee children are related to health, well-being and psychological distress, detention and being separated from their parents and caregivers, becoming victims of violence and sexual abuse as well as smuggling and exploitation. At present the main response of the UNHCR has been to cater for the basic needs and to provide adequate transit and reception facilities. Many reception facilities for unaccompanied children are overwhelmed and face challenges to cope with the registration of unaccompanied children, the weak referral mechanisms, and insufficient psycho-social, legal and interpretation support provided by the authorities. The children have very limited access to information on how to apply for asylum and have no or limited access to legal counselling. Other challenges which member States face and which are important to children include access to education, the need for support in family reunification and solidarity as regards relocation and settlement.

21.     Ms Olga KOSTENKO, Secretary to the Committee on Migration, Refugees and Displaced Persons of the Parliamentary Assembly of the Council of Europe, presented the Global Campaign to end administrative detention of unaccompanied minors. She emphasised the importance of the campaign in generating change and providing support to parliamentarians at national level.

22.     Ms Michaela BAUER, Partnerships Manager, UNICEF Regional Office for Central and Eastern Europe and Commonwealth of Independent States (CEE/CIS) referred to the advocacy tool of UNICEF in the refugee and migrant crisis in Europe and encouraged the Council of Europe to support its Governments in organising their response.

23.     Mr Giakoumopoulos furthermore informed the DECS-ENF that the Council of Europe could provide assistance to member States, upon request, by providing legislative expertise and capacity building exercises with exchanges of good practices. He also informed the Committee that the Council of Europe Development Bank had set up a special Fund to support member States in building shelters.

24.     A member of the European Network of Ombudspersons for Children (ENOC) also informed the DECS-ENF of a study that ENOC would be developing in the coming months on the state of play of children on the move or otherwise affected by migration.
