A SURVEY ON THE WORK PRIORITIES FOR CDDECS MEMBERS

Background

In its 2nd meeting on 25 and 26 September 2014 the Bureau of the CDDECS decided to send out a questionnaire to the members of the CDDECS in order to

1.    select short term and long term priorities for the work of the CDDECS

2.    receive proposals for activities relating to the selected priorities.

3.    receive proposals for possible themes and subjects to exchange of views in the future CDDECS meetings.


THE ONLINE SURVEY CAN BE REPLIED TO LATEST ON FRIDAY 31 OCTOBER 2014.

Each national CDDECS member is invited to

- EXAMINE the attached list of specific themes from the Work Programme of the CDDECS for 2014-2015.

- CONSULT his/her national colleagues in DECS-RPD, DECS-ENF and DECS-GEC to have their input on the priorities.

- SELECT one or two subject areas in each subcategory for either as a short term (2014-2015) or long term priority (2016-2019).

- PROPOSE one or two possible activities within the CDDECS for each priority subject you selected

- PROPOSE themes for possible exchange of views in the future CDDECS meetings

The replies are to be sent to the Secretariat latest on Friday 31 October 2014.

Only one reply per member State is accepted.

Austria feels that all points are important. However, the focus should  not only be on additional seminars or workshops and monitoring of existing standards but also on recommendations (instruments) in the field of  Gender equality, e.g. concerning equal access to justice. Anyhow, decisions in the field of gender equality should not be taken without consulting the GEC.

les sujets des priorités semblent suffisants et il s'agit de bien se conformer au mandat du Comité des Ministres. Vis-à-vis des sujets et actions qui seront retenus, il serait bon de : 1) proposer une méthode de travail efficace (méthodologie ayant fait ses preuves) 2) résoudre les problèmes d'application et de non application des droits de l'homme pour une meilleure effectivité, notamment sur la base de peer-reviews ou de best practices

It is need to develop a comprehensive strategy to prevent and address all forms of violence against children.

In this context should be proposed to research and collect good practices how to encourage children and their representatives to report cases of abuse and violence in the family or care institutions to competent authorities and raise awareness of children of their rights and establishing complaints mechanisms within care institutions.

It is important to deal with in each member States what kind of services are provided in institutional care for child victims of neglect, abuse and exploitation for their effective rehabilitation.

It is                                                             need to work out training to professional staff to care for children with behavioural problems.

The Russian Federation reaffirms the commitment to support the initiative of The Republic of  Azerbaijan, presented in the course of recent conference in Baku (10-11 September 2014) "Social cohesion - achievements and challenges in times of crisis", to hold the 3rd Council of Europe Conference of Ministers responsible for Social Cohesion, which will review The CoE New Strategy for Social Cohesion (Baku, 2015). We are ready to make our own input regarding, first of all, a conceptual paper and preliminary agenda of this event.  We propose to take due account of declarations and outcomes of two ministerial conferences - in Moscow (2009)  and in Istanbul (2012) "Building a secure future for all".

We also need to take into consideration the recent activity of CoE Committees on social cohesion issues - The Committee on Social Affairs, Health and Sustainable development, The Committee on Rules of Procedure, Immunities and Institutional Affairs, which presented in PACE reports on social policy issues - "Social exclusion - a danger for Europe's democracies", "Europe's public administration  in flux: public service under threat", "Towards a new European Social model", " Measuring and fostering the well-being of European citizens".

With regard to panel-discussions of the 2nd Bureau meeting in Paris (25-26 September 2015) we support a concrete proposal of Bulgaria to create the Working group for revising The Strategy and Action Plan for Social Cohesion in CoE member states.

For the purpose, we propose to hold international consultations on protection of children’s rights in family conflicts including issues of parental rights execution by a parent with whom the child does not live; cross-border removal of a child by one of the parents without consent of the other parent; exercise of a visitation right.

Under the present social and economic conditions it becomes a matter of priority for governments to provide necessary conditions to ensure child’s rights to all-round and harmonious development (in a family, school and other child care establishments and in the society at large) and to ensure access of a child to cultural establishments and values. For the purpose we propose to draft questionnaires for Member States on their activities, challenges, problems and achievements in this sphere. On the survey outcomes and the national replies analyses a report with recommendations on improvement of relevant legislation and practices will be prepared and forwarded to the CDDECS for consideration.

b)      the violence against and abuse of  children, and

To ensure strict compliance with international humanitarian law in the context of escalation of the armed conflicts in various regions of the world, the Russian Federation proposes to accept development of effective organizational and legal mechanisms to protect and restore rights of the children involved in internal and international armed conflicts and to provide their rehabilitation as one of the priorities for the CDDECS activities. 

Drafting recommendations on observance and restoration of rights and legal interests of children in armed conflicts and improvement of international monitoring mechanisms in this sphere will contribute to  fulfilment in good faith of generally recognized rules of international law as applicable to prevention of harmful and wide-scale impact of armed conflicts on children;

non-admission and denunciation of military attacks against civil targets usually with lots of children inter alia schools and hospitals;

promotion of physical and psychological recovery and social reintegration of child victims of armed conflicts in an environment which fosters the health, self-respect and dignity of the child (in accordance with Articles 38 and 39 of the UN Convention of the Rights of the Child, the Optional Protocol to the Convention on the Rights of the Child on the Involvement of Children in Armed Conflict, the Hague Convention on the conducts of warfare and protection of civilian population; in part 3 of Article 4 of Protocol Additional to the Geneva Conventions of 12 August 1949, and Relating to the Protection of Victims of Non-International Armed Conflicts (Protocol II).

c)      access to justice by children, and by child victims of violence and abuse in specific

To study effectiveness of implementation of restorative justice in regard to children, the Russian Federation proposes to summarize experience of Member States applied in criminal legal proceedings concerning mediation procedures and professional support with respect to children including minor victims and juvenile delinquents under the age of criminal responsibility.

Equal and effective access to human rights by persons with disabilities

a)      the rights of persons with disabilities,

National Programmes «Accessible environment» (2011-2015) and (till 2020) contain measures to eliminate prejudices and to form tolerant attitude towards people with disabilities.

Federal law on Social services № 442 FZ (entries into force on January, 1-st 2015) improves legal regulation of rehabilitation process in social institutions of people with disabilities.

Draft law making changes of 25 legal acts of different spheres provides authorities with powers to create conditions of accessibility of social infrastructure and services and to help them enjoy their rights on the basis of non-discrimination. (Entries into force on January, 1-st 2016)

Taking into account the Council of Europe Disability Action Plan 2006-2015 The Russian Federation is ready to join our efforts with DECS-RPD and CDDECS' Secretariat to hold a conference in Sankt-Petersburg on September 2015 to approve and submit the draft disability work frame (Strategy and Action Plan 2016-2020).

b)      violence against persons with disabilities (see above with regard abuse in the institutionalized setting), and

c)      access to justice by persons with disabilities, and as victims of violence in specific.

Federal Law № 324-FZ "On free legal assistance in the Russian Federation" provides certain categories of the disabled and disabled children with  the right to receive all kinds of free legal aid.

Measures taken to ensure effective access to justice for all persons with disabilities at all stages of the judicial process is their participation by the guardianship (Articles 31-33, 41, Civil Code) or participation in judicial sittings with video-conference equipment (Code of Civil Procedure and Arbitration Procedure Code)

In accordance with the Tax Code the disabled of  categories I and II and NGOs of persons with disabilities are exempted from payment of state fees if their cases are tried by regular courts and magistrates, as well as arbitration courts. The amount of the state fee for notarial actions for the disabled of  categories I and II is reduced by 50 %.

National strategy of actions on the interests of children (2012 – 2017) provides children (including disabled children) with access to justice whatever their procedural capacity or status are.

Draft law aimed at granting NGOs of people with disabilities the right to participate in elimination of discrimination on the basis of disability with respect to persons who are in detention and have disabilities. (entries into force on January. 1-st 2016).
