A. FOREWORD
The Council of Europe’s European Commission for the Efficiency of Justice (CEPEJ) held its 31st plenary meeting in Strasbourg on 3-4 December 2018. The meeting was chaired by Mr Georg STAWA (Austria), President of the CEPEJ.
The agenda and the list of participants appear in Appendix.
B. LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ
The CEPEJ
1. Information by the President, member States and the Secretariat
§ took note of the information provided by its President, its members and its Secretariat who had participated in various fora where the work of the CEPEJ had been presented and discussed and noted with satisfaction that this concerned 60 events (including cooperation activities) in 22 member States and 5 non-European States in 2018, contributing to the promotion of public policies aimed at ensuring the efficiency and quality of judicial systems;
§ took note of the information provided by Armenia, Azerbaijan, Cyprus, Finland, Greece, Latvia, Russian Federation Slovenia, Spain, “the former Yugoslav Republic of Macedonia”, Ukraine, United Kingdom, and Israel, on recent developments in the judicial field ; invited its members to forward to the Secretariat written information and useful references which could be included in the area "country profiles" of the CEPEJ web site;
2. Evaluation process of judicial systems
§ noted with great satisfaction the excellent reception by the Committee of Ministers of the report “European judicial systems – Edition 2018”, as well as the positive responses received as regards this process in many member States, from policy makers, justice practitioners (see specifics on the tour de table) and the media (see the press review);
§ invited its members to disseminate the reports widely to the competent authorities and judicial professionals of their countries, in particular by facilitating their translation (at least the translation of the overview), where appropriate, and to forward as soon as possible to the Secretariat information on the way the reports are used by the State authorities and any press articles at national level concerning this work;
§ decided to launch the next evaluation process in 2019 on the basis of data of the year 2018, with a view to publishing the results in 2020; instructed the CEPEJ-GT-EVAL to propose that the structure of the report be further developed, relying more on the possibilities offered by the interactive database CEPEJ-STAT, focusing more on the main trends, and including synthetic country-fiches;
§ adopted for this purpose the revised Evaluation Scheme (CEPEJ(2018)16), subject to any additional amendments that may be proposed by the CEPEJ-GT-EVAL and approved by written procedure, and instructed the CEPEJ-GT-EVAL to adapt the explanatory note accordingly;
§ agreed that the electronic Scheme should be opened for reply by national correspondents as from March 2019 until 1 October 2019 and urged the national correspondents to comply with such a timeframe, in order for the data to be processed from October 2019;
§ reiterated its agreement so that Kazakhstan could participate in this evaluation exercise as an Observer and took note of its invitation to the CEPEJ-GT-EVAL for a working visit to Astana to explain the process;
§ took note of the information provided by its experts on the peer evaluation visit to “the former Yugoslav Republic of Macedonia”, agreed to pursue the cycle of evaluation in Andorra on 10-11 December 2018 and invited the member States to propose to the Secretariat candidatures for further visits;
§ welcomed the continuation of the cooperation with the European Commission in providing it annually with a Study on the functioning of judicial systems in the EU member states, based on the CEPEJ’s own methodology; instructed the CEPEJ-GT-EVAL to pursue this cooperation which strengthens the CEPEJ’s preeminent role as regards justice evaluation, as well as the synergies between the European Union and the Council of Europe in this field;
agreed to strengthen such cooperation with the European Commission in the framework of a specific programme for an annual evaluation of the functioning of the judicial systems in the States and entities of the Western Balkans, based on indicators partially reflecting the indicators already used by the CEPEJ and new indicators, and instructed the CEPEJ-GT-EVAL to finalise this with the agreement of the States concerned;
§ thanked warmly the outgoing President of the CEPEJ-GT-EVAL, Jean-Paul JEAN (France), for his long-standing commitment to the Group and welcomed the appointment of Jaša VRABEC (Slovenia) as Chairman of the Group;
3. Quality of justice
§ adopted the “European Ethical Charter on the use of artificial intelligence in judicial systems and their environment” (CEPEJ(2018)14) which provides, for the first time in Europe, a framework of principles that can guide policy makers, legislators and justice professionals in addressing the rapid development of Artificial Intelligence in national judicial processes,
decided to forward the Charter to the Committee of Ministers so that it may take note of it and encourage member States to disseminate it to interested circles and to apply it, and to forward it to the relevant Committees and bodies of the Council of Europe in order that they may make use of them when appropriate; instructed the Secretariat to ensure a wide dissemination of these documents and organise the appropriate communication strategy;
§ adopted the “Guide on courts’ and public prosecution services’ communication with the public and the media” (CEPEJ(2018)15);
decided to forward this document to the Committee of Ministers in order that it may take note of it, as well as to the relevant Committees and bodies of the Council of Europe in order that they may make use of it when appropriate and instructed the Secretariat to ensure a wide dissemination of this document and organise the appropriate communication strategy;
§ took note of the on-going work of the CEPEJ-GT-QUAL on supporting the implementation of the Cyberjustice Guidelines and strengthening judges’ knowledge and skills through better knowledge-sharing among the judges in order to reduce judges’ isolation;
§ reiterated its invitation to the volunteer courts in the member States to indicate to the Secretariat their candidatures for organising a coaching programme aimed at organising user satisfaction surveys based on the CEPEJ Handbook and invited its members to signal this opportunity widely to the courts in their countries;
4. Judicial time management
§ adopted the Revised Guidelines for Judicial Time management (3rd revision) (CEPEJ(2018)20);
§ adopted the Update of the length of court proceedings in the Member States of the Council of Europe – 3rd edition based on the case-law of the ECtHR (CEPEJ(2018)26);
§ took note of the work carried out by the Steering group of the SATURN Centre, in particular
o thepreparation of a methodology available to the judicial systems wishing to set up a process of weighting cases and thanked in this context the Supreme Court of Israel for its invitation for a study visit in February 2019,
o the preparation of draft guidelines on the data, tables and graphs that could be contained in a model dashboard,
o the timeframes for criminal cases under Articles 5 and 6 ECHR,
o the role of the parties and practitioners in preventing delays in proceedings;
§ decided, following the Opinion sent in December 2014 to the European Committee on Legal Co-operation (CDCJ) which proposed consideration of the possibility of updating Recommendation Rec (86) 12 “concerning measures to prevent and reduce the excessive workload in the courts”, to forward to the CDCJ the synthesis prepared by the EUR on the non-judicial tasks performed by judges in certain member States and by other judicial professions in other member States, and expressed the wish that the CDCJ would undertake as soon as possible the revision of the Recommendation with a view to improving the efficiency and quality of justice;
§ reiterated its invitation to the volunteer courts in the member States to indicate to the Secretariat their candidature for organising a coaching programme within the courts aimed at implementing the SATURN tools for judicial time management based on the CEPEJ Guide and invited its members to signal this opportunity widely to the courts in their countries;
5. Mediation
§ adopted the Baseline Grid for Mediation Performance Indicators (Baseline Mediation Statistics) (CEPEJ(2018)23), the Code of conduct for mediation centres (CEPEJ(2018)24) and the Standard mediation forms (CEPEJ(2018)25) as elements to complete the existing Mediation Development Toolkit (CEPEJ(2018)7);
decided to forward these documents to the Committee of Ministers in order that it may take note of them, as well as to the relevant Committees and bodies of the Council of Europe in order that they may make use of them when appropriate;
§ agreed to work on a feasibility study to assess the interest of proposing to the relevant bodies of the Council of Europe to draft a Convention on Mediation and instructed the CEPEJ-GT-MED to organise the preparation of this study;
6. Harmonisation of the definitions used by CEPEJ
§ took note of the on-going work of the ad hoc working group, in particular to draft a Glossary of the terminology used by CEPEJ;
7. CEPEJ’s participation in Council of Europe cooperation programmes
§ welcomed the on-going cooperation programmes:
§ agreed to cooperate within the framework of its Activity Programme to support judicial reforms through new programmes:
§ agreed to cooperate with the Supreme Judicial Council of Armenia on drafting and developing justice management rules;
§ invited its members and expertswishing to participate in such programmes to make it known to the Secretariat;
8. Relations between the CEPEJ and other bodies of the Council of Europe
§ took note of the information about the activities of the Consultative Council of European Judges (CCJE), the Consultative Council of European Prosecutors (CCPE) and the European Committee of Legal Cooperation (CDCJ);
9. Latest developments within the European Union in the judicial field
§ took note of the information given by the representatives of Austria and Romania, on behalf of the outgoing and incoming presidencies of the European Union, on the recent developments within the Union in the field of justice;
10. European Day of Justice
§ thanked the judicial authorities in the 17 member States which organised 41 specific events within the framework of the European Day of Justice on 25 October 2018; invited its members to promote initiatives for the 2019;
11. Crystal Scales of Justice
§ invited its members to promote candidacies for the next edition of the “Crystal Scales of Justice” in 2019, whose award ceremony could take place in Oslo at the invitation of the Norwegian authorities;
§ took note of the information given by its Observers, and in particular the OECD, the EU Fundamental Rights Agency, the European Association of Judges (EAM), the European Union of Rechtspfleger and court clerks (EUR), the International Union of Bailiffs and Judicial Officers (UIHJ), the Council of the Bars and Law Societies of the European Union (CCBE),the International Institute of Expertise and Expert (IIEE), the Association of European Administrative Judges (AEAJ), thanked them for their concrete contribution to its activities, in particular in the drafting of the report evaluating judicial systems, and invited them to further contribute to the implementation of the CEPEJ activity programme;
§ noted with interest the proposal of the UIHJ to hold in 2019, in cooperation with the CEPEJ, a one day forum devoted to the CEPEJ Guidelines on the execution of court decisions, in particular in the field of digitization and artificial intelligence;
§ elected Ramin GURBANOV (Azerbaijan) as President and Ivana BORZOVÁ (Czech Republic) as Vice-President of the CEPEJ for a two year period; elected Laetitia BRUNIN (France) et Francesco DEPASQUALE (Malta) as Bureau members for a two year period;
§ expressed its warm thanks to Georg STAWA for his four years as President of the CEPEJ and for his leading action towards further developing the Commission and endowing it with a preeminent role in the debate regarding the functioning of judicial systems in Europe and beyond;
14. Calendar
§ took note that the 32nd and 33rd plenary meetings of the CEPEJ could take place on 13-14 June 2019 and 4-6 December 2019.
