Abridged report
A. FOREWORD
The European Commission for the Efficiency of Justice (CEPEJ) held its 21st plenary meeting in Strasbourg on 20 – 21 June 2013. The meeting was chaired by Mr John STACEY (United Kingdom), President of the CEPEJ.
The agenda appears in Appendix.
B. LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ
The CEPEJ:
1. Information by the President of the CEPEJ, the CEPEJ members and the Secretariat
§ welcomed in particular Morocco as a new observer state with the CEPEJ, as well as Tunisia specially invited to participate in this meeting;
§ took note of the information given by its President, its members and its Secretariat who had participated in various fora where the work of the CEPEJ was presented and discussed;
§ took note of the information given by the representatives of Belgium, Denmark, Estonia, France, Georgia, Germany, Ireland, Malta, the Netherlands, Norway, Serbia, Ukraine, United Kingdom on recent domestic developments in the judicial field and invited its members to forward to the Secretariat written information and useful references which could be included in the area "country profiles" of its web site;
§ welcomed in particular the intervention of Turkey showing to what extent judicial reforms underway were based on the work of the CEPEJ, including the evaluation report on judicial systems, and invited the member states to make full use of the work of the CEPEJ within the framework of the reforms of their judicial systems;
§ regretted that, in spite of previous discussions, including with the Committee of Ministers, it had not been possible to find a solution to appoint a permanent statistician within the CEPEJ Secretariat to ensure the durability of the CEPEJ’s role in evaluating the functioning of European judicial systems; nevertheless, it welcomed the strengthening of the Secretariat through the appointment of an additional lawyer;
2. Innovation in the organisation of judicial systems and involvement of external staff
§ took note with interest of the report presented by the scientific expert Daniela PIANA (Italy) on “Innovation in the organisation of judicial systems and involvement of external staff”;
3. Evaluation of the European judicial systems
§ adopted the amendments proposed by the CEPEJ-GT-EVAL to the new Evaluation Scheme (CEPEJ(2012)12Rev);
§ reminded its members to appoint national correspondents entrusted with responding to the evaluation Scheme and to indicate their details to the Secretariat as soon as possible;
§ took note that an improved electronic version of the evaluation Scheme, including the explanatory note, was opened, to be completed by the national correspondents before 31 December 2013, and urged the national correspondents to comply with such a timeframe, in order for the data to be processed from January 2014 and the report to be adopted by the CEPEJ at its 23rd plenary meeting (mid 2014) ;
§ agreed to pursue the cycle of peer evaluation visits on judicial statistics in 2013 in Latvia, in Ukraine and possibly in Estonia; took note that an evaluation visit will take place in Lithuania at the beginning of 2014;
§ agreed on the principle of having Israel participating as an observer state, at their request, in the forthcoming evaluation cycle, according to the provisions proposed by the Bureau (CEPEJ-BU(2013)1) and subject to the agreement of the Committee of Ministers as regards the specific modalities of such cooperation, including financial modalities;
§ welcomed the concrete use by the OECD of the CEPEJ findings for evaluating the situation of the judicial systems in their European member states and of the CEPEJ methodology for extending such evaluation to non-European members, took note that the results of this work would be published in November 2013 and confirmed its willingness to further cooperate with OECD in this field;
Cooperation with the European Union within the framework of the “EU Scoreboard Justice”
§ discussed the invitation to tender by the European Commission to establish with the Council of Europe / CEPEJ a “Multi-annual contract for services to support the EU Justice Scoreboard”, giving to the CEPEJ the task of providing statistical and numerical data on the functioning of the justice system in each EU member state and providing country specific information, analysis and trends on the functioning of the justice system for each EU member states, according to the CEPEJ methodology and in a spirit of partnership between the European Union and the Council of Europe;
welcomed the fact that the European Commission thus acknowledged that the CEPEJ was the reference point as regards the evaluation of the functioning of European judicial systems and stressed the necessary complementarity of tasks and that there should be no duplication in this field ;
noted that there was no consensus at that stage as regards the CEPEJ participation in this exercise;
decided to appoint an ad hoc working group composed of the CEPEJ members in respect of Austria, France, Germany, Netherlands, Norway and entrusted it i) to further discuss the possibility of such a partnership with the European Commission before mid-July 2013, ii) to communicate through the Secretariat the results of this discussion to all the CEPEJ members, enabling them iii) to discuss their position with the relevant authorities in their countries so that a final position may be taken by the Committee of the Ministers’ Deputies at a relevant meeting;
4. Quality of justice
§ adopted the “Guidelines on the creation of judicial maps to support access to justice within a quality judicial system” (CEPEJ(2013)7) and decided to forward it to the Committee of Ministers so that it can take note of it, as well as to the relevant Committees and bodies of the Council of Europe so that they can make use of it when appropriate; invited its members to organise the translation of these Guidelines into non-official languages and to ensure a wide dissemination among the relevant political and judicial authorities in their countries;
§ took note of the on-going work of the CEPEJ-GT-QUAL as regards the role of judicial experts and the organisation of court premises; instructed the CEPEJ-GT-QUAL and the CEPEJ-GT-EVAL to further work together on the definition of indicators for the quality of justice;
§ reiterated its invitation to the volunteer courts in the member states to indicate to the Secretariat their candidature for organising a coaching programme aimed at organising user satisfaction surveys based on the CEPEJ Handbook and invited its members to inform widely the courts in their states of this opportunity;
5. Judicial time management
§ took note of the work carried out by the Steering group of the SATURN Centre, in particular in order to facilitate the concrete use of the Guidelines on judicial time management; it encouraged the member states to forward to the Secretariat, before the end of July 2013, possible comments on the last report on lengths of proceedings within the courts of appeal and the supreme courts; it instructed it to pursue its work according to its strategic action plan;
§ reiterated its invitation to the volunteer courts in the member states to indicate to the Secretariat their candidature for organising within the court a coaching programme aimed at implementing the SATURN tools for judicial time management based on the CEPEJ Guide and invited its members to inform widely the courts in their states of this opportunity;
6. CEPEJ co-operation programmes
§ welcomed the on-going Joint Programmes with the European Union:
- for Court Management in Turkey, enabling to develop in particular court coaching programmes on the implementation of the SATURN tools on a large scale, involving several pilot courts;
- for strengthening democratic reform in the Southern Neighbourhood enabling to support judicial reforms in Morocco and Tunisia by using the CEPEJ methodology and tools, in particular as regards the evaluation of the judicial system, judicial time management and the CEPEJ quality tools;
- for enhancing judicial reform in the Eastern Partnership countries enabling to evaluate, through the CEPEJ methodology, court performance in Armenia, Azerbaijan, Georgia, the Republic of Moldova and Ukraine;
and noted with satisfaction that the CEPEJ work can thus be promoted and concretely and successfully applied on large scales in European states and beyond ;
§ took note that CEPEJ cooperation could be further developed in the near future with Albania and Jordan, within the framework of new Joint Programmes;
7. Relations between the CEPEJ and the other bodies of the Council of Europe
§ took note of the information on the activities of the Consultative Council of European Judges (CCJE) and the European Committee of Legal Cooperation (CDCJ);
§ approved the document “Proposed amendments to some recommendations – comparative table” (CEPEJ(2013)4) prepared at the request of the CDCJ as a follow up to Resolution N°1 of the 30th Conference of the Ministers of Justice on a modern, transparent and efficient justice, to provide it with technical guidelines on the revision of various Council of Europe recommendations on court management and e-justice and decided to forward it to the CDCJ; it confirmed its availability to cooperate with the CDCJ when appropriate within the framework of the CDCJ's drafting group(s) entrusted with the revision of the recommendations;
8. Other cooperation with the European Union
§ took note of the information given by the representatives of Ireland and Lithuania, speaking on behalf of the outgoing and incoming presidencies of the European Union, on the recent and foreseen developments within the Union in the field of justice;
9. Observers with the CEPEJ
§ took noteof the information given by its Observers, thanked them for their concrete contribution to its activities and invitedthem to further contribute to the implementation of its activity programme;
