Abridged report

A.   FOREWORD

The European Commission for the Efficiency of Justice (CEPEJ) held its 17th plenary meeting in Strasbourg on 28 – 29 June 2011. The meeting was chaired by Mr John STACEY (United Kingdom).

The agenda appears in the Appendix.

B.   LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ

1.   Information by the President of the CEPEJ and the Secretariat

The CEPEJ

§  took note of the information given by its President, its members and its Secretariat who participated in various fora where the work of the CEPEJ was introduced and discussed;

2.   Recent developments in the judicial field in the Council of Europe member states

§  took note of the information given by representatives of member states on recent domestic developments in the judicial field (Austria, Croatia, Cyprus, Czech Republic, Greece, Latvia, Lithuania, Montenegro, the Netherlands, Poland, Romania, Spain, Sweden, the former Yugoslav Republic of Macedonia, Turkey) and invited its members to forward to the Secretariat written information and useful references which could be included in the area "country profiles" of its web site;

§  thanked the Ministry of Justice of Finland and the University of Technology of Lappeenranta for their presentation of the project: "New way of systematic management of delay reduction projects in courts - combining external expertise and internal participation", entrusted the Steering Group of the SATURN Centre to make good use of this practice for its further work and agreed to post the presentation on the CEPEJ's web site;

3.   2010 Activity Report of the CEPEJ

§  adopted the 2010 Activity Report of the CEPEJ (CEPEJ(2011)1) and decided to forward it to the Committee of Ministers for approval;

4.   Implementation of the cycle: "Gathering around CEPEJ"  

§   agreed to pursue the organisation of sessions aimed to raise awareness and train justice professionals on CEPEJ's tools and collect experiences from justice professionals ("Gathering around CEPEJ") and invited its members to indicate to the Secretariat their willingness for organising such sessions, as Italy has already done;

5.    Quality of justice

§   approved the report "Contractualisation of judicial processes in Europe" (CEPEJ (2010)10) and decided to forward it to the Committee of Ministers, the CCJE, the CCPE and other relevant committees of the Council of Europe so that they can make good use of it;

decided to publish the Study within the framework of the Series "CEPEJ Studies";

invited its members to ensure a wide dissemination of the Study among the relevant national institutions and organisations;

instructed the CEPEJ-GT-QUALto organise the use and the follow up of this report;

§   invited the courts in the member states to make good use of the Handbook for conducting satisfaction surveys aimed at court users in Council of Europe’s member states (CEPEJ(2010)1) and confirmed it is available to assist volunteer courts in organising such surveys and analysing results through the CEPEJ-GT-QUAL;

§   took note of the other on-going works within the CEPEJ-GT-QUAL and invited the Group to pursue its works accordingly;

6.     Judicial time management

§   instructed the SATURN Steering Group to complement the existing SATURN Guidelines on judicial time management with an explanatory note including best practices;

§   agreed to publish on the web site the document “Implementation of SATURN time management tools - synthesizing report from seven test projects” (CEPEJ-SATURN(2011)2) as well as a Handbook on methodology based on the works of the SATURN Steering Group, to be prepared under the responsibility of the Group;

§   invited the courts in the member states to indicate to the Secretariat their wish to organise a coaching session for implementing the SATURN Guidelines and other tools on judicial time management;

§   reminded its members of the importance of translating the SATURN tools into national languages so that they can be directly used within the courts and invited its members to take the appropriate measures accordingly;

§   invited its members to control the key data and provide comments on the draft “Study on Council of Europe member states appeal and supreme courts’ lengths of proceedings“ (CEPEJ-SATURN(2011)3) before 15 August 2011 and instructed the SATURN Steering Group to finalise the draft study accordingly so that it can be submitted to the next plenary meeting for approval;

7.     Evaluation of judicial systems, 2010 - 2012 cycle

§   welcomed the essential work of the national correspondents in collecting the answers of the member states to the evaluation scheme and reminded the members that replies to the evaluation scheme, under its electronic form, can be sent until 31 December 2011;

§   invited the national correspondents to provide answers to the Scheme while fully taking into account general and specific guidance for each question indicated in the explanatory note as well as the answers submitted for the last evaluation exercise (such information appears online in the electronic version of the questionnaire, after each question), so as to ensure the homogeneity and the consistency of the answers given by all the member states.

8.     Cooperation between the CEPEJ and the Lisbon Network

§  took note of the informal meeting report by the Lisbon Network’s Bureau held in Strasbourg on 27 June 2011;

§  decided that a Bureau, composed of four members, be established for the Lisbon Network by the members of the Network in order to prepare and manage the Network’s activities between two plenary meetings of the Network; entrusted its Bureau to discuss with the Lisbon Network's Bureau further modalities of cooperation;

§  agreed that the Lisbon Network should have the opportunity to provide the CEPEJ with proposals for activities;

§  invited the Lisbon Network to express concrete proposals allowing a proper use of the CEPEJ tools within the training of judges and prosecutors;

§  invited the CEPEJ national correspondents to cooperate with the Network’s members when replying to questions in the Scheme for the evaluation of judicial systems regarding the training of judges and prosecutors and instructed the CEPEJ-GT-EVAL to consult the Network when drafting parts of the Report on the Evaluation of judicial systems on such training matters;

9.     Relations between the CEPEJ and the other bodies of the Council of Europe

§  took note of the information given on the activities of the Consultative Council of European Judges (CCJE), the Consultative Council of European Prosecutors (CCPE), the European Committee of Legal Cooperation (CDCJ) and commended on the good cooperation with these bodies;

10.   Cooperation with the European Union

§  took note of the information given by the representatives of Hungary and Poland, speaking on behalf of the outgoing and incoming presidencies of the European Union, on the recent and foreseen developments within the Union in the field of justice;

§  invited its members to forward to the Secretariat all the information on the celebration of the

9th European Day of Justice in October 2011;

11.   Observers to the CEPEJ

§  took noteof the information given by its Observers, thanked them for their concrete contribution to its activities and invited them to further contribute to the implementation of its activity programme;

12.   Election of a member of the Bureau

§  elected Mr Audun BERG (Norway), as member of the Bureau, replacing Ms Eva FERNQVIST, until the end of 2012.
