A. FOREWORD
The European Commission for the Efficiency of Justice (CEPEJ) held its 16th plenary meeting in Strasbourg on 9 – 10 December 2010. The meeting was chaired by Mr Fausto de SANTIS (Italy).
The agenda appears in the Appendix.
B. LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ
1. Information by the President of the CEPEJ and the Secretariat
The CEPEJ
§ took note of the information given by its President, its members and its Secretariat who participated in various fora where the work of the CEPEJ was introduced and discussed;
2. Study Session
§ welcomed the presentations and the discussions on some conclusions drawn from the Report: "European judicial systems – Edition 2010" and instructed the CEPEJ-GT-EVAL and possibly other relevant working groups to further their work by taking into account the content of this debate;
§ agreed to post these presentations on the CEPEJ's website, specifying that such presentations are not the responsibility of the CEPEJ but only of their authors’;
3. Recent developments in the judicial field in the Council of Europe member states
§ took note of the information given by representatives of Armenia, Austria, Azerbaijan, Croatia, Finland, Germany, Latvia, Monaco, Montenegro, Spain, Sweden, Turkey and United Kingdom on recent domestic developments in the judicial field and invited its members to forward to the Secretariat written information and useful references which could be included in the area "country profiles" of its web site;
4. Evaluation of European judicial systems
§ noted with great satisfactionthe excellent welcome by the Committee of Ministers to the Report as well as the positive responses received as regards this Report, in several member states, from policy makers, justice practitioners and the media;
§ recalled that the Report must be presented and analysed while fully taking into account the methodological information that it includes includes, in particular when information from member states are compared;
§ invited its members to disseminate the Report to the competent authorities and judicial professionals of their country, in particular by facilitating its translation, where appropriate, and to forward as soon as possible to the Secretariat information on the way the Report is used by the state authorities and any press articles, written on a national level, that concern the Report;
§ instructed the CEPEJ-GT-EVAL to launch calls for projects to external researchers who might benefit from a CEPEJ label on the basis of a specific protocol and to manage this process, under the authority of the Bureau, while ensuring proper coordination with the other working groups;
§ decided to launch the next evaluation process in 2011 on the basis of data of the year 2010, in view of publishing a new evaluation report during 2012;
§ adopted the revised version of the Evaluation Scheme (CEPEJ(2010)11) and its subsequent explanatory note (CEPEJ(2010)12), subject to possible changes to be proposed by the CEPEJ-GT-EVAL, under the authority of the Bureau; the CEPEJ members will be invited to give their final approval through a written procedure before 1 May 2011;
agreed that the electronic Scheme should be opened for reply by national correspondents as from 15 May 2011 until 31 December 2011 and urged the national correspondents to comply with such timeframe, in order for the data to be processed from January 2012, while taking into account the specific difficulties faced by federal states in collecting data;
instructed the Secretariat to bring the necessary improvements to the electronic version of the questionnaire and to organise appropriate modalities for the implementation of this new assessment cycle;
§ invited the Committee of Ministers to grant the CEPEJ with appropriate means for enabling this evaluation cycle to rely on proper expertise in matters of statistical data processing and analysis, and noted that such a scientific expertise could also guarantee statistical analysis within the framework of the SATURN Centre if this expertise was provided on a permanent basis;
§ took note of the report by the experts on the peer evaluation visits on national systems of judicial statistics in Malta, the Russian Federation and Norway (together with Denmark, Finland, Iceland and Sweden), agreed to pursue the cycle of evaluation visits in 2011 in Austria, the Netherlands, Turkey; took note that a visit to the United Kingdom could be proposed at a later stage;
5. Quality of justice
§ invited the CEPEJ-GT-QUAL to rely on the Network of Pilot courts, the Lisbon Network, the Observers with the CEPEJ and the academia to test on a large scale the implementation of the "Handbook on the satisfaction surveys aimed at court users of justice" and to enable the proper use of the results of such surveys both at member state and at European levels;
§ discussed the Report on "Contractualisation and judicial processes in Europe" prepared by the scientific expert Julien Lhuillier (CEPEJ (2010)10Prov) under the authority of the CEPEJ-GT-QUAL, invited the member states to provide to the Secretariat further comments on national situations before 15 January 2011 and instructed the CEPEJ-GT-QUAL to review the report accordingly so that the report can be submitted, together with the relevant appendices, to the 17th plenary meeting of CEPEJ for approval;
invited the CEPEG-GT-QUAL to further work on the elements of this study regarding "contractualisation" and judicial proceedings;
6. SATURN Centre on judicial time management
§ welcomed the Resolution No. 1 of the 30th Council of Europe Conference of Ministers of Justice (Istanbul, 24 - 26 November 2010) "on a modern, transparent and efficient justice" which "invite the Committee of Ministers to build on the work of the SATURN centre within CEPEJ, further developing its capacity to acquire better knowledge of the time required for judicial proceedings in the member states, with a view to developing tools to enable the member states to better meet their obligations under Article 6 of the ECHR regarding the right to a fair trial within a reasonable time" and instructed the Steering Group of the SATURN Centre to draft concrete recommendations to member states in order to make progress in such a way;
§ on this basis, invited the member states to do the utmost so that they are able to provide data on lengths of proceedings and court case flow management for the four case categories defined in the EUGMONT Appendix, which appears both in the GOJUST Guidelines on judicial statistics and in the SATURN Guidelines on judicial case management;
invited the CEPEJ members representing the member states which would have difficulties to provide such data to discuss possible solutions with the Steering group of the SATURN Centre in order to try to find solutions;
§ instructed the Steering Group of the SATURN Centre to continue its work in order to set up a European observatory on judicial timeframes, both on quantitative and qualitative levels, and design the appropriate tools, while drawing in particular on the expertise of the Network of pilot courts;
§ instructed the Steering Group of the SATURN Centre to follow the concrete implementation within the courts of the member states of the SATURN Guidelines on judicial time management;
7. CEPEJ Network of Pilot Courts
§ welcomed the conclusions of the 5th plenary meeting of the Network of Pilot Courts and invited the Network to pursue its cooperation with the CEPEJ working group according to their terms of reference;
8. Targeted co-operation with member states
§ approved its experts' report on the "Analysis of rationalisation of the court network" in Montenegro (CEPEJ-COOP(2010)2);
§ agreed to organise a follow up to the report on "Reduce backlogs and timeframes of proceedings of the Maltese judicial system" (CEPEJ-COOP(2010)1) with a view to facilitating the proper implementation of the experts' recommendations;
§ agreed to cooperate with Azerbaijan on the organisation of the court system (including administrative courts) and the process for selecting judges;
§ agreed to cooperate with Armenia on the issue of rotation of court presidents;
9. Integration of the Lisbon Network within the CEPEJ's activity programme
§ decided to organise a meeting of the Lisbon Network on 17 February 2011, in particular to define how the tools developed by the CEPEJ on the quality of justice could be integrated into the judicial training, namely as regards court users' satisfaction surveys;
§ underlined the need to ensure synergies between the work of the Lisbon Network and the work of the European Judicial Training Network;
10. The role of the CEPEJ in the follow-up of the Interlaken Conference concerning the future of the European Court of Human Rights
§ reiterated its full willingness to cooperate with the European Court of Human Rights and the CDDH to contribute to improving respect for Article 6 of the Convention within the member states;
§ invited its members to provide an answer, if possible before 17 January 2011, to the questionnaire of the DH-GDR on judicial fees at the level of the higher judicial instances sent by the scientific expert Julien Lhuillier, to the extent considered feasible;
11. Activity programme of the CEPEJ
§ adopted its 2011 activity programme (CEPEJ (2010)9) and decided to forward it to the Committee of Ministers so that it can take note of them;
§ invited the member states, through the CEPEJ members, where appropriate, to propose to the Secretariat before 15 January 2011 qualified experts to participate in the working groups and entrusted its Bureau to appoint the members of these working groups taking into account these proposals;
12. Relations between the CEPEJ and the other bodies of the Council of Europe
§ took note of the information on the activities of the Consultative Council of European Judges (CCJE), the Consultative Council of European Prosecutors (CCPE) and the European Committee of Legal Cooperation (CDCJ);
§ welcomed in particular the adoption by the Committee of Ministers of the Recommendation Rec(2010)12 on "judges: independence, efficiency and responsibilities", drafted with the support of the CEPEJ, on the basis of a proposal by the CEPEJ;
13. Cooperation with the European Union
§ took note of the information given by the representatives of Belgium and Hungary, speaking on behalf of the outgoing and incoming presidencies of the European Union, on the recent and foreseen developments within the Union in the field of justice, as well as the information given by the representative of the Fundamental Rights Agency of the European Union;
§ reiterated its full availabilityto cooperate with the relevant bodies of the European Union for the implementation of the Stockholm Programme as regards evaluation of judicial systems, drawing on its specific expertise;
§ welcomed the success of the European Day of Justice in 16 member states and especially thanked the Ministry of Justice of Slovenia for hosting the main event in Ljubljana on 25 October 2010; it thanked the French authorities for their proposal to host the main event of the European Day of Justice in 2011;
§ welcomed the success of the European Prize: "the Crystal Scales of Justice" and congratulated the winner: the Administrative Court of Yambol (Bulgaria) for its initiative: "Everyone is equal before the law, but not before the language! Improving communication between courts and citizens", as well as the three institutions which were granted a special mention by the jury: the Regional Court of Linz and FMG Amor (Austria) for their "Alternative measures for young drivers convicted of driving under the influence of alcohol", the University of Technology and Ministry of Justice (Finland) for their "New way of systematic management of delay reduction projects in courts" and the Supreme Court of Slovenia for the "Automated validation of authentic documents";
it invited its members to promote candidacies for the next edition of the "Crystal Scales of Justice";
14. Observers with the CEPEJ
§ took noteof the information given by its Observers, thanked them for their concrete contribution to its activities and invitedthem to further contribute to the implementation of its activity programme;
15. Election of the Bureau
§ elected Mr John STACEY (United Kingdom) as President of the CEPEJ and Mr Georg STAWA (Austria) as Vice-President of the CEPEJ for a two year period and elected Mr Irakli ADEISHVILI (Georgia) and Ms Eva FERNQVIST (Sweden), as members of the Bureau for a two year period;
§ expressed its warm thanks to Mr Fausto de SANTIS for his four years as President of the CEPEJ and for his leading action towards further developing the Commission and endowing it with a preeminent role within the Council of Europe, as well as to Ms Elsa GARCIA MALTRAS de BLAS, for her commitment and her active role which has largely contributed to the success of the activities of the CEPEJ.
