A. FOREWORD
The European Commission for the Efficiency of Justice (CEPEJ) held its 25th plenary meeting in Strasbourg on 2-3 July 2015. The meeting was chaired by Mr Georg STAWA (Austria), President of the CEPEJ.
The agenda appears in Appendix I.
B. LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ
The CEPEJ:
§ took note of the information given by its President, its members and its Secretariat who had participated in various fora where the work of the CEPEJ had been presented and discussed;
§ expressed its support to the Tunisian delegation and, through it, to the people of Tunisia, following the attack suffered by their country;
§ took note of the information given by representatives of Austria, Azerbaijan, Bulgaria, Croatia, Germany, Greece, Ireland, Latvia, Malta, the Netherlands, the Russian Federation, Serbia, Slovakia, “the former Yugoslav Republic of Macedonia”, Turkey, Ukraine and the United Kingdom on recent domestic developments in the judicial field and invited its members to forward to the Secretariat written information and useful references which could be included in the area "country profiles" of its website;
§ welcomed the progress made in the on-going cooperation programmes, which allow the practical implementation of the methodology and tools of the CEPEJ and thus provide strong added value to the work of the Council of Europe in the beneficiary states, in particular:
- in Albania, in the framework of the on-going Joint Programme with the European Union for the "Support to the Efficiency of Justice" (SEJ),
- in Croatia, in the framework of the programme funded by the EEA/Norway Grants for improving the quality and efficiency of the judicial system,
- in Azerbaijan and the Republic of Moldova, as part of the new Programmatic Cooperation Framework with the European Union, following the regional programme for the Eastern Partnership countries, aimed at continuing cooperation for the efficiency and quality of judicial systems,
- in Turkey, as part of the cooperation programme with the Swedish authorities (SIDA) to promote civil mediation on the basis of the relevant CEPEJ Guidelines,
- in Kosovo*, to improve the efficiency and quality of the service delivered by the Basic Court of Pristina, in the framework of a pilot project;
- in Morocco, Tunisia and Jordan, as part of the neighbourhood policy and the ongoing Joint Programmes with the European Union for the reforms of the judicial systems;
§ regretted that the activities initially planned in Ukraine within the framework of the Joint Programme with the EU for the countries of the Eastern partnership had been cancelled at the request of the EU Delegation in Ukraine;
§ underlined that the implementation of these numerous programmes by the CEPEJ requires the availability of members and experts of the CEPEJ and called upon its members and experts to inform the Secretariat of their willingness to participate in these programmes;
§ noted the amendments to the Evaluation Scheme (CEPEJ(2015)1) and its Explanatory note (CEPEJ(2015)2), completed by a specific questionnaire on Information Technologies in court (CEPEJ(2015)5) and an explanatory note (CEPEJ(2015)6), proposed by the CEPEJ-GT-EVAL and adopted through a written procedure;
§ reminded its members to appoint national correspondents entrusted with responding to the Evaluation Scheme and to provide their contact details to the Secretariat as soon as possible; national correspondents would be invited to discuss the data collection and consistency on 5 November 2015 and to exchange on the draft 2016 report in spring 2016;
§ took note that the electronic version of the Evaluation Scheme and the specific questionnaire on IT, including the explanatory notes, were open, to be completed by the national correspondents before 31 December 2015, and urged the national correspondents to comply with this timeframe, in order for the data to be processed from January 2016 and the report to be adopted by the CEPEJ at its 27th plenary meeting (mid 2016) ; recalled that it is topical for the analytical work to respond to all the questions, where appropriate by indicating explicitly that the data is not available (NA) or is not appropriate (NAP) in the national judicial system;
§ instructed the Secretariat, under the authority of the CEPEJ-GT-EVAL and the Bureau, to prepare, in full cooperation with the EU member states, the new Study on judicial systems to be forwarded to the European Commission at the end of 2015 as part of the preparation of the "EU Justice Scoreboard"; therefore underlined, in the framework of the preparation of this Study, for the member states of the European Union, that the responses to those questions of the Evaluation Scheme appearing in colour in the electronic document should already be submitted to the Secretariat by 1 October 2015 and urged the relevant national correspondents to comply with this timeframe;
§ instructed the CEPEJ-GT-EVAL to propose a new way of analysing and presenting the data collected, including:
- a general report including key data and comments (key facts and figures) which make it possible to evaluate the state of judicial systems and their evolution;
- a specific report focused for each cycle on one topical issue to be selected and containing an in-depth analysis of the situation; for 2016, this topic could be the consequences of the use of ICT on the work and the human resources of courts;
- a dynamic data base opened to a scope of users to be defined, including a data processing system;
§ took note of the report, presented orally, of the peer evaluation visits to Lithuania (27-28 May 2015), agreed to pursue the cycle of peer evaluation visits on judicial statistics in Slovakia (September 2015) and possibly in Serbia, and invited the member states to confirm before the end of the year their willingness to organise such visits in 2016;
§ took note of the on-going work within the CEPEJ-GT-QUAL to prepare guidelines for the promotion of cyber-justice to improve the quality of court work, a handbook and a glossary on the enforcement of judicial decisions, as well as the on-going reflections related to the right to an effective remedy within the framework of the European Convention on Human Rights;
§ instructed the CEPEJ-GT-QUAL to pursue also its work on the definition of indicators for the quality of justice and on the issue of public access to legislation and court case-law;
§ welcomed the draft “Handbook on access to justice in Europe” introduced by the EU Agency for Fundamental Rights (FRA) which strengthens the knowledge of the principles governing the exercise of this fundamental right and the relevant European case-law; agreed to follow the proposal of the CEPEJ-GT-QUAL not to be further involved in this particular project given its academic character which does not correspond to the necessary practical orientation that the CEPEJ wishes to give to its work so as to improve the service of the court users ;
§ took note of the on-going work within the Steering Group of the SATURN Centre, especially to define targets for judicial timeframes and the subsequent collection of definitions of the key terms of the CEPEJ for judicial time management;
§ adopted the updated version of the “Study on Council of Europe Member States Appeal and Supreme Courts’ Lengths of Proceedings - Edition 2015 (2006-2012 data)” (CEPEJ(2015)7), prepared by Marco Velicogna (Italy), scientific expert, subject to possible data changes that would be made by its members before 31 August 2015, and decided to forward it to the Committee of Ministers so that it may take note of it, as well as to the relevant Committees and bodies of the Council of Europe so that they can make use of it when appropriate;
§ took note that a court coaching programme for judicial time management was being implemented with the administrative court of Thessaloniki, Greece, and that court coaching programmes could be implemented with several courts in France; reiterated its invitation to the volunteer courts in the member states to indicate to the Secretariat their candidature for organising within their courts a coaching programme aimed at implementing the SATURN tools for judicial time management based on the CEPEJ Guide and invited its members to inform widely the courts in their states of this opportunity;
§ took note of the information provided about the activities of the Consultative Council of European Judges (CCJE), the Consultative Council of European Prosecutors (CCPE) and the European Committee for Legal Cooperation (CDCJ), and confirmed its availability to pursue cooperation with them within the framework of their work;
§ took note of the information provided by the representatives of Latvia, speaking on behalf of the outgoing presidency of the European Union, about the recent and planned developments within the Union in the field of justice;
§ invited its members to forward to the Secretariat all information on the celebration of the European Day of Justice in October 2015;
§ invited its members to promote the candidature of courts or other judicial bodies to participate in the European Prize: “the Crystal Scales of Justice” before 6 July 2015, bearing in mind that the award ceremony would take place in October, within the framework of the European Day of Justice, possibly in Bosnia and Herzegovina;
§ took note of the information provided by its Observers, and in particular the European Association of Judges, the International Union of Bailiffs and Judicial Officers (UIHJ), the Council of European Bars and Law Societies (CCBE), the European Union of Rechtspfleger (EUR) ; thanked them for their concrete contribution to its activities, notably in the drafting of the report evaluating judicial systems, and invited them to contribute further to the implementation of its activity programme;
§ recalled that, according to its Rules of procedure revised following the last CEPEJ plenary meeting, and in order to ensure better continuity in the work of the CEPEJ and strengthen the network of the CEPEJ, considering the increasing number of tasks assigned to it, each member state is entitled to appoint a substitute member to the CEPEJ; therefore invited its members to indicate to the Secretariat as soon as possible the name and contact details of this substitute member;
§ warmly thanked the experts who had agreed to follow a training session in February on the methodology and tools of the CEPEJ in order to prepare their participation in cooperation activities and in this way help the CEPEJ with the growing demand for experts in the framework of the implementation of programmes; decided to renew this training session on 15 September 2015 and, therefore, called on its members to appoint experts wishing to participate in the cooperation work of the CEPEJ, if possible before 15 August 2015, and instructed the Secretariat to organise this training session;
*: All reference to Kosovo, whether to the territory, institutions or population, in this text shall be understood in full compliance with United Nations Security Council Resolution 1244 and without prejudice to the status of Kosovo.
