A. FOREWORD
The Council of Europe’s European Commission for the Efficiency of Justice (CEPEJ) held its 27th plenary meeting in Strasbourg on 30 June – 1 July 2016. The meeting was chaired by Mr Georg STAWA (Austria), President of the CEPEJ.
The agenda appears in the Appendix.
B. LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ
The CEPEJ
1. Information by the President of the CEPEJ and the Secretariat
§ took note of the information given by its President, its members and its Secretariat, and in particular of the Council of Europe Plan of Action on strengthening judicial independence and impartiality (CM(2016)36;
2. 2014-2015 Activity Report of the CEPEJ
§ adopted its 2014-2015 Activity Report (CEPEJ(2016)3) and decided to forward it to the Committee of Ministers for approval;
3. Evaluation process of judicial systems
§ welcomed the work achieved jointly by the members of the CEPEJ-GT-EVAL chaired by Jean-Paul JEAN (France) and the Secretariat, with the valuable support of the scientific experts: Julinda BEQIRAJ, Didier MARSHALL, Sophie SONNTAG-KOENIG, Ludivine ROUSSEY, within the framework of the 2014 – 2016 evaluation cycle, in preparing the draft reports and the dynamic data base which evaluate the functioning of judicial systems in Europe and thanked them warmly for the efforts devoted to this exercise within a strict timeframe; thanked the national correspondents who had coordinated the national replies to the evaluation scheme and had fully cooperated with the experts so that they could submit a preparatory contribution of high quality;
§ noted with satisfaction that the reports and the data base include the results of a survey carried out in 45 European states, and Israel as an observer, and that his can be considered as an essential reference tool to guide reforms of public policies of justice;
§ adopted:
- the "Report on European judicial systems – Efficiency and quality of justice - Key facts and figures - Edition 2016" (CEPEJ(2016)1),
- the thematic report “European judicial systems – Use of information technology in courts” (CEPEJ(2016)2
subject to written comments to be communicated by the delegations to the Secretariat before 11 July 2016, through the specific form, and taking into account the discussions during the present meeting; agreed that no new data would be accepted beyond this deadline;
§ agreed that all the data provided by the states concerned would be made available to the public on the CEPEJ website through the new dynamic CEPEJ data base; welcomed the development of this data base which is a major step forward in providing policy makers, justice professionals, researchers and the public with unprecedented interactive information to guide public policies of justice;
§ instructed the experts of the CEPEJ-GT-EVAL, under the authority of the CEPEJ Bureau, to finalise the definitive version of the report which would be made available to the members of the CEPEJ on the CEPEJ restricted website no later than 12 August 2016, bearing in mind that no further amendments would be made after 9 September 2016;
§ decided that the report would remain confidential until its official publication, to take place on 6 October 2016 within the framework of a press conference and invited all its members and observers to strictly respect this rule of confidentiality so as to ensure the relevance and coherence of the publication by the Council of Europe;
§ decided to forward the report as soon as possible to the Ministers' Deputies so that they may take note of it, possibly on 5 October 2016;
§ instructed the experts of the CEPEJ-GT-EVALto prepare an overview of the report to facilitate its understanding and reading; this overview would be submitted on 12 August 2016 to the CEPEJ for approval, through a written procedure, and published together with the report;
§ instructed the Secretariat to organise the appropriate publication and dissemination of the report, including through its website, as from 6 October 2016;
§ agreed to pursue the evaluation exercise within the framework of a new cycle, while keeping a biennial timeframe; therefore instructed the CEPEJ-GT-EVAL, in cooperation with the CEPEJ other working groups, to explore the possibility of revising some questions of the evaluation scheme and entrusted its Secretariat with adapting the evaluation scheme so as to take into account the comments by the national correspondents and the CEPEJ's members;
§ entrusted the Secretariatwith setting up a new electronic form for data collection, so as to ensure an optimum linkage with the electronic system used for data processing and analysis;
§ agreed, in accordance with its medium-term activity programme, to pursue the analysis of the facts and figures presented in the report, including by opening the use of the data to researchers who wish to benefit from the scientific support of the CEPEJ, according to modalities to be defined with the CEPEJ-GT-EVAL, under the authority of the CEPEJ Bureau;
§ took note of the information provided by its experts on the peer evaluation visits to Serbia on judicial statistics, agreed to pursue the cycle of evaluation and invited member states to propose to the Secretariat candidatures for further visits;
§ welcomed the continuation of the cooperation with the European Commission to provide it annually with a Study on the functioning of judicial systems in the EU member states, based on the CEPEJ’s own methodology; took noteof the “EU Justice Scoreboard” published by the European Commission in April 2016; instructed the CEPEJ-GT-EVALto pursue this cooperation which strengthens the CEPEJ’s preeminent role as regards justice evaluation, as well as the synergies between the European Union and the Council of Europe in this field;
4. Quality of justice
§ took note of the work carried out by the CEPEJ-GT-QUAL on driving changes towards cyberjustice, enhancing the right to an effective remedy through a better organisation of the courts, and completing the work on court users satisfaction surveys;
§ reiterated its invitation to volunteer courts in the member states to indicate to the Secretariat their candidature for organising a coaching programme aimed at organising user satisfaction surveys based on the CEPEJ Handbook and invited its members to inform the courts in their states of this opportunity;
5. Judicial time management
§ took note of the work carried out by the Steering group of the SATURN Centre to develop indicators on judicial timeframes, as well as specific cooperation conducted by the Group with the First Instance Court of Avignon (France), the Administrative First Instance Court of Thessaloniki (Greece) and the proposed cooperation with the courts in Malta;
§ reiterated its invitation to volunteer courts in the member states to indicate to the Secretariat their candidature for organising within the court a coaching programme aimed at implementing the SATURN tools for judicial time management based on the CEPEJ Guide and invited its members to inform the courts in their states of this opportunity;
6. Relations between the CEPEJ and other bodies of the Council of Europe
§ took note of the information about the activities of the Consultative Council of European Judges (CCJE) and the Consultative Council of European Prosecutors (CCPE);
7. CEPEJ’s participation in Council of Europe cooperation programmes
§ welcomed the on-going cooperation programmes:
§ welcomed the concrete results achieved with the judicial authorities and courts in Albania as part of the Programme "Increase the efficiency of the Albanian justice system, in line with European standards" conducted in cooperation with the European Union that ended in April 2016 and warmly thanked the Albanian partners for the efficient cooperation that will be continued and strengthened in the framework of the “Horizontal Facility for Western Balkans and Turkey";
§ welcomed the concrete results achieved with the judicial authorities and pilot courts in Croatia as part of the Programme "Improvement of the way cases are handled by the judicial system and introduction of SATURN time management tools in the courts " conducted in cooperation with the EEA/Norway Grants that ended in June 2016 and warmly thanked the Croatian and Norwegian partners for the efficient cooperation;
§ agreed to cooperate specifically with the Latvian authorities, at their request, to evaluate the functioning of their judicial system and instructed the Secretariat to implement this cooperation with members and experts of the CEPEJ; thanked Latvia for the voluntary contribution that would be given to the Council of Europe for this purpose;
§ took note of the interest of the authorities of the Slovak Republic in cooperating specifically with the CEPEJ and instructed the Secretariat to implement this cooperation with members and experts of the CEPEJ if so requested;
§ invited its members and expertswishing to participate in such programmes to make it known to the Secretariat;
8. Latest developments within the European Union in the judicial field
§ took note of the information given by the representative of Slovakia, speaking on behalf of the presidency of the European Union, on the recent developments within the Union in the field of justice;
§ took note of the “Handbook on access to justice” published jointly by the Fundamental Rights Agency of the European Union and the Council of Europe;
9. European Day of Justice and Crystal Scales of Justice
§ invited its members to forward to the Secretariat all information on the celebration of the European Day of Justice in October 2016;
10. Renewal of members of the Bureau
§ elected Ramin GURBANOV (Azerbaijan) as Vice-President of the CEPEJ in replacement of Irakli ADEISHVILI, until the end of 2016; elected Noel RUBOTHAM (Ireland) as member of the Bureau until the end of 2016 in replacement of Ramin GURBANOV;
11. Observers to the CEPEJ
§ took note of the information given by its Observers, and in particular the European Association of Judges (EAM), the International Union of Bailiffs and Judicial Officers (UIHJ), the European Union of Rechtspfleger and court clerks (EUR), Magistrats Européens pour la Démocratie et les Libertés (MEDEL), the Council of the Bars and Law Societies of the European Union (CCBE) thanked them for their concrete contribution to its activities, in particular in the drafting of the report evaluating judicial systems, and invited them to further contribute to the implementation of the CEPEJ activity programme.
12. Any other business
§ agreed that the next plenary meeting (Strasbourg, 6-7 December 2016) would be preceded on 5 December 2016 by a one-d ay public forum on cyberjustice.
