ABRIDGED MEETING REPORT
of the 44th meeting
21 – 23 September 2009
1. Opening of the meeting
The CDLR met in Strasbourg on 21-23 September 2009 for its 44th meeting with Mr Paul van Kalmthout (The Netherlands) in the Chair. The list of participants appears at Appendix 1.
Mr Alfonso Zardi, Secretary of the CDLR, introduced to the Committee Mr Pierre Schreiber who has been seconded to the Secretariat by France as per September 2009 to head up the Strategy for Innovation and Good Governance at Local Level.
2. Adoption of the agenda
The Agenda as adopted appears at Appendix 2.
3. Bureau of the CDLR
Mr Van Kalmthout thanked Mr Paul Rowsell (United Kingdom), the vice-chair, for chairing the Bureau meeting on 3 July in his absence. The CDLR took note of the report
(CDLR-Bu(2009)14).
4. Decisions taken by the Committee of Ministers concerning the CDLR
The CDLR took note of the decisions of the Committee of Ministers as they appear in document CDLR(2009)26. It asked the Secretariat to follow and, as appropriate, report on developments in the Committee of Experts on participation of people with disabilities in political and public life (CAHPAH-PPL).
The Committee noted the Committee of Ministers’ favourable assessment of its functioning, made in the framework of its review of intergovernmental committees, based on two yearly meetings, a focussed agenda and the value of its work. It was recalled that the effective functioning of the Committee depends on the efforts of all its members.
In addition the Committee noted with satisfaction that the Committee of Ministers had on 9 September 2009 adopted the Additional protocol to the European Charter of Local Self-Government on the right to participate in the affairs of a local authority and Protocol No 3 to the European Outline Convention on Transfrontier Co-operation between Territorial Communities or Authorities concerning Euroregional Groupings and opened them for signature at the 16th session of the Ministerial Conference in Utrecht.
The Committee also encouraged members to take the necessary steps at domestic level in order to ensure that as many ministers as possible would be in a position to sign one or both protocols in Utrecht. It noted that the Committee of Ministers would hold a tour de table on prospects for signature at its meeting on 21 October.
Finally the Committee noted that the GR-DEM would hold an exchange of views on the 16th session of the Ministerial Conference, including on the draft Utrecht Declaration at its meeting on 13 October 2009.
5. Implementation of the programme of activities for 2005-2009
The CDLR took note of the information provided in CDLR(2009)27 and agreed that in the new document further to the new Utrecht Agenda a column on communication aspects should be included.
5.1 Activities on legal framework and institutional structure
The Committee noted that both the survey among delegations and the discussion at the meeting showed that governments currently have no interest to engage in developing provisions for a (further) additional protocol to the European Charter of Local Government. It emphasised that, in keeping with its commitment to making the best possible use of resources, priority should be given to implementing the agenda that will be determined by the 16th session of the Ministerial Conference (Utrecht Agenda).
It agreed to inform the Committee of Ministers of the above, in response to the ad hoc terms of reference given to it.
5.2 Activities on local and regional finance and public services
5.2.1 The impact of the economic downturn on local authorities
Mr Ken Davey, representing the LGI (the Open Society Institute’s Local Government and Public Service Reform Initiative) presented the joint Council of Europe/LGI report on “The impact of the economic downturn on local authorities: what is happening and what can be done about it?” (document CDLR(2009)29 Addendum).
The CDLR warmly welcomed this report and felt that it should be presented again to the ministers themselves, at the start of the discussion on item 7(a) of the conference agenda. To this end, it decided to invite the Open Society Institute to attend the conference as an observer, and to notify the Committee of Ministers accordingly.
The Committee further agreed that the delegations would have until 15 October to submit comments and additional information for inclusion in the report, which would then be finalised and forwarded to the ministerial conference, for information (in English only).
The CDLR went on to discuss and adopt document CDLR(2009)29 – subject to a number of amendments to be incorporated by the Secretariat – for submission to the ministerial conference.
5.2.2 Workshop in St. Gallen: Regional finance adapted to regional competences: assuring coherence on a long-term basis
The Committee took note of the Workshop held in St Gallen set out in document CDLR(2009)30.
5.2.3 Workshop in Iceland: Rules and regulations for borrowing by local authorities
The Committee took note of the workshop that is to be organised in Iceland, probably in January 2010, on the rules and requirements for borrowing by local authorities and other aspect of the fiscal position of local authorities. CDLR members will all receive an invitation to participate in the workshop (at their own expense) as soon as the programme and dates have been finalised.
6. Preparation of the 16th Session of the Ministerial Conference
The Committee adopted, with modifications, the draft agenda and draft programme as they appear in Addendum I, underlining that some flexibility in the timing will probably be necessary.
Members were given information about the practical arrangements (hotels, transport, etc.) and were urged to ensure registration of participants in the Session as soon as possible on the conference website (www.minconf16.com).
Members were also requested to inform the Dutch delegation and the Secretariat as soon as possible of the items to which their ministers would wish to speak, in particular if their minister would wish to be among the first to speak to a topic.
The Committee noted that during the Secretary General’s luncheon, guests will be seated at tables arranged on a linguistic basis. The luncheon will commence with short speeches by the Secretary General, the President of the PACE and the President of the Congress (or their representatives). These speeches will be made available in writing at the luncheon in English and French.
Ms Elise Cornu of the Treaty Office explained the way in which the signing ceremony for the new additional protocols would take place in Utrecht and the need for the minister or other persons signing to have full powers for doing so. (See also item 4 above).
Further to her question, the representative of the Conference of International NGO’s (COINGO), Mrs Chavanon, was informed that the COINGO would in principle be able to speak under each item on the agenda – subject to availability of time and priority for ministers.
The Committee took note of the letter from Minister Kyibida (Ukraine) offering to host the 17th session of the Conference in Kyiv in 2011.
Finally, the Committee approved the list of documents for the 16th session as it appears in CDLR(2009)33.

The Committee discussed and adopted the draft reports under the references CDLR(2009)34 to 40, making a number of changes which it instructed the Secretariat to incorporate in the final versions for the Ministerial Conference.
6.9 The impact of the economic and financial crisis on local and regional government: what policy responses by governments?
The CDLR discussed and revised document CDLR(2009)41 which would be incorporated in the draft Utrecht Declaration. The guidelines that were appended thereto would be revised by the Secretariat, sent to the delegations and adopted – prior to being included in the draft Declaration – at the meeting of the LR-IC Committee on 12 and 13 October 2009.
6.10 Transfrontier co-operation: the role of central government in removing obstacles
The Committee discussed, revised and adopted the document “Transfrontier Co-operation: the role of central government in removing obstacles” as it appears in CDLR(2009)42.

The Committee took note of the final declaration of the Conference on Practical Approaches Towards Effective European Transfrontier Co-operation held in Maastricht (The Netherlands) on 6-7 July 2009.
The Committee discussed the ministerial voting arrangements and the challenges and actions to be included in the future Utrecht Agenda on the basis of document CDLR(2009)45.
With regard to the voting arrangements, the Committee agreed on the electronic voting option. It also agreed that the voting should be conducted in a single round and should focus solely on the “challenges” identified by governments as needing to be addressed in the future. The list of “challenges” was discussed and agreed, subject to finalisation of the precise wording, entrusted to the LR-IC Committee at its meeting on 12-13 October 2009. Delegations were invited to send any proposals they might have to the Secretarait by 5 October 2009.
The Committee did not think it was appropriate, however, that ministers should have to prioritise by means of voting the “actions” being undertaken by them at national level, but agreed that a list of “actions” should be sent to ministers so that they could identify the ones being undertaken at national level and accord them a degree of priority. The Secretariat would revise the list of actions set out in document CDLR(2009)45 and would forward it to the national delegations for a reply by 23 October 2009. The results of this consultation exercise would be brought to the attention of the conference.
6.13 Council of Europe Reference Framework for Regional Democracy
Mr Paul-Henri Philips (Belgium), CDLR rapporteur for the reference framework for regional democracy, briefly presented the draft, which had been prepared over the course of two meetings of an open-ended working party, one of which had been held in Brussels. The Committee approved the draft and proposed it be appended to the Utrecht Declaration.
France noted the non-binding character of the document and emitted an interpetative reservation as to the scope of the reference to Article 29 and following of the draft charter appended to Congress Recommendation 240 [document CDLR(2009)46] This delegation considers that the list of regional competences included in that reference serves as an example only and under no circumstances has an obligatory or exhaustive character.
6.14 Draft Utrecht Declaration
The Committee examined the Utrecht Declaration as a whole and its appendix on the further steps and measures to be taken in follow up to the Kiviniemi report (document CDLR(2009)47) during a discussion in which the Congress – which had prepared several amendments – took an active part. It adopted the draft Declaration (See Addendum II), subject to its decision under item 6.9.
7. Communication and new working methods
7.1 Secretariat memorandum on LOREG
The Committee reviewed the 3 alternatives for the future of the LOREG database proposed in document CDLR(2009)48. It was agreed to adopt solution 3 to discontinue LOREG and the Network of Correspondents, whilst transferring certain functions to the Local and Democracy Website, budget permitting.
7.2 Communication strategy for local and regional democracy work in the Council of Europe – Report prepared by Kimmo Collander (Finland) and Kjersti Barsok (Norway)
Mr Kimmo Collander (Finland) spoke of the main points in the document on a communication strategy for local and regional democracy work (CDLR(2009)49 Addendum). Ms Kjersti Barsok (Norway) said that the key point of the Strategy was to bring together the various existing capacities to ensure success in this area. The representative of the Conference of INGOs indicated it was ready to be involved in future discussions on a communication strategy. A CDLR Bureau rapporteur as proposed by the report will be elected at the next Bureau meeting (2010).
The Committee agreed with the Norwegian proposal to set up a communication network, budget permitting.
The Committee reviewed the core text prepared for the Ministerial Conference. It was agreed that this text, taking into account the suggestions for improvements by delegations would be sent out shortly and would be used for making publicity for the ministerial conference on the web-sites of ministries and other such channels of communication.
8. Recent developments in member States in the field of local and regional democracy
Mr David Chichinadze (Georgia) provided information on recent developments in his country.
9. Other activities in the field of local and regional democracy
9.1 Forum for the Future of Democracy
The Committee took note of the information provided in documents CDLR(2009) 25. It noted that Mr Paul-Henri Philips would be one of the speakers of the Forum and that he would also represent the CDLR, following the invitation sent to the chair of the CDLR.
9.2 Information on the activities of other Council of Europe bodies
The Committee took note of the information provided in document CDLR(2009)51.
9.3 Strategy for Innovation and Good Governance at Local Level – Draft report of the 3rd meeting of the Stakeholders’ Platform (Strasbourg, 19 June 2009)
The Committee took note of the information contained in document CDLR(2009)54. It agreed that a questionnaire would be sent to all members in order to gather information on the eventual implementation of the Strategy in Council of Europe’s member states and the state of play, so that the information to be brought to the attention of the ministerial conference could be updated. The deadline for the replies was set at 15 October 2009.
Mr Tolkovanov, on behalf of Ukraine, invited the representatives of the states involved in the Strategy to a meeting at which the state of play could be discussed and experiences shared.
9.4 Centre of Expertise for Local Government Reform – Report of the 5th meeting of the Advisory Board (Strasbourg, 19 June 2009)
The committee took note of the information contained in documents CDLR(2009)55 and CELGR(2009)1 rev.

The Committee elected its chair and vice-chair and four members of its Bureau. Its composition as per 1 January 2010 is as follows:

11. Draft terms of reference of the CDLR and the sub-committees
The Committee adopted the specific terms of reference of the CDLR and its subordinate committees (LR-IC, LR-GG and LR-FS) as they appear at appendices 3-6 to this report.
The Committee agreed to add a paragraph to the draft terms of reference of all sub-committees instructing them to ensure communication in line with the CDLR’s new communication strategy (see item 7.2)

Within the framework of the Programme of Activities, under Programme III.1.2 – “Local and regional democracy”, the Committee is instructed to: Pursue the implementation of the Budapest Declaration, Utrecht Declaration and Agenda in accordance with the Intergovernmental Programme of Activities established by the Committee of Ministers; Advise the Committee of Ministers on questions concerning local and regional democracy; Maintain and develop dialogue with the Congress, Parliamentary Assembly and Conference of INGO’s on issues of common concern in the field of local and regional democracy; Participate, through its designated representatives, in the Stakeholders’ Platform on the Strategy for Innovation and Good Governance at Local Level; Participate, through its designated representative, in the Advisory Board of the Centre of Expertise for Local Government Reform; Participate, through its designated representatives, in the Joint Working Group (with Congress) on the European Local Democracy Week; Prepare the sessions of the Council of Europe Conference of Ministers responsible for Local and Regional Government and ensure the follow up thereto, having regard to the relevant decisions of the Committee of Ministers. Implement its communication strategy. |

The Council of Europe budget will bear the travel and subsistence expenses of one representative from each member state (two in the case of the state whose representative has been elected Chair) |
