Follow-up given by the authorities of Azerbaijan to the independent experts’ report: prisoners pardoned on 17 August and on 29 December 2001

Some introductory  remarks

1.         “Mutatis mutandis” cases

- The Azerbaijan authorities must apply the experts’ conclusions to “mutatis mutandis” cases.

- The list of 716 names appended to the experts’ report (the most extensive list) must be the list of reference when speaking about “mutatis mutandis cases”

- This list must be tidied-up. That can only be done with the assistance of the Azerbaijan authorities.

- We would need the names of all persons pardoned in August 2001 and in December 2001, as well as the exact nature of the pardon (liberation; reduction of sentence and details about it etc….)

2.         Re-trial or liberation

- Is a simple reduction of sentence ‘acceptable’ for the CoE in the light of the Azeri commitment contained in PACE Opinion (re-trial or liberation) ?

- Re-trials should be observed: either by PACE members and/or by international NGOs (as AI). This would need to be added in the Assembly draft Resolution.

3.         Additional background information

- Major difficulties encountered by experts in (not) obtaining required information from Azerbaijan authorities: see paragraph 7 of the experts’ report.

- “Comments” on the experts’ report  provided by the the  Human Rights Center of Azerbaijan on 29.12.2001 (See Appendix 2).

I.                 “Pilot” cases

-  Pardon of 17 August 2001: 6 liberations and 1 reduction of sentence

- Pardon of 29 December 2001: 1 reduction of sentence  (see letter of Mr Alasgarov, Chairman of the Milli Majlis, to the President of the PACE, of January 2002) . Besides, 3 re-trials have been initiated.

The experts’ opinion was formulated before the end of Mr. Samedov’s trial, on 11 July 2001, in which he was sentenced to six years’ imprisonment.

The Case No. 12 (RAMAZANOV Avaz) was struck off the list due to a lack of information.

II.      Other cases to which the experts’ conclusions apply “mutatis mutandis”  (list of 716 names referred to the experts and appended to their report)

i.          Application of the experts’ conclusions mutatis mutandis, to the other cases: See paragraph 16 of the experts’ report [SG/Inf (2001) 34], emphasis added:

15.         The experts were provided with several lists of alleged political prisoners. The most comprehensive list was that of the Human Rights Center of Azerbaijan, transmitted by the Parliamentary Assembly to the Secretary General of the Council of Europe. It contained over 700 names (see Appendix).

16.         Given the amount of cases submitted, the time-frame within which the experts had to work and the difficulties encountered in obtaining the necessary information, the experts felt compelled to limit their attention to a restricted number of cases. Also, preference had to be given to cases for which some information was initially made available to the experts. This decision was taken and the selection of cases was made on the assumption that the experts conclusions would apply, mutatis mutandis, to the other cases. Thus, if the examination of specific cases has led to the conclusion that persons concerned were political prisoners, it follows that other persons held in the same or in similar circumstances are also political prisoners. It is then for the detaining State to prove that the detention is in conformity with the ECHR (see, in this connection, the last sentence of the established criteria in paragraph 10 above).

ii.         Pardons applied to these cases following the transmission of the report to the authorities of Azerbaijan

a.      Pardon of 17 August

No list of names/cases to which the experts’ conclusions apply “mutatis mutandis” was provided by the authorities of Azerbaijan. However, some names have been provided by local NGOs.

  1. Pardon of 19 December

A list of 54 names was provided by the authorities of which: 47 appear in the list of 716 names appended to the experts’ report (1 pilot case and 46 “mutatis mutandis” cases). It is not clear whether these persons have been released or whether their sentence has only been reduced. This should be clarified.

According to information submitted by an NGO (Mr and Mrs Sadaddinov), from these 54 persons, some have been released (29) and the sentences of others (25) have been reduced.

If the information submitted by this NGO is correct, among prisoners listed in the Appendix to the experts’ report, 23 persons have been released (“mutatis mutandis” cases)  and the sentences of 24 others (1 pilot case and 23 “mutatis mutandis” cases)  have  been reduced(see the Table below).

Appendix 1:

The report of the Independent experts: chronology

-           31 January 2001: the Ministers’ Deputies decided that cases of alleged political prisoners in Armenia and Azerbaijan be transmitted to the SG by Delegations to the Committee of Ministers [...]”.They also approved the SG initiative to refer these cases to a group of independent experts, mandated to prepare “a confidential opinion on the said cases indicating whether the persons in question may be defined as political prisoners on the basis of objective criteria in the light of the case-law of the European Court of Human Rights and Council of Europe standards” (deadline: 16 July 2001)

-           February 2001: the SG appointed  three experts (Professor Stefan Trechsel, Professor Evert Alkema and Mr Alexander Arabadjiev (whose participation terminated - upon his request - subsequent to his election as a member of the Bulgarian Parliament).

-           18 July 2001:  the Secretary General informed the Ministers’ Deputies that he had received the experts’ report. He also provided the two States concerned with relevant extracts from it for comments (both States submitted their comments in August).

-           17 August 2001: presidential decree of Amnesty: pardon of 6 prisoners considered as political prisoners by the experts (out of 17) in their list of 23 ‘pilot cases’ concerning Azerbaijan.

-           31 August: The report and the relevant exchange of correspondence were transmitted, in confidence, to the CM Monitoring Group GT-SUIVI.AGO.

-           14 September: the same documents were transmitted to the Ministers’ Deputies.

-           21 September: the Ministers’ Deputies adopted a Declaration on this report.

-           27 September: in a press release, the Secretary General further urged the Azerbaijan authorities to honour their commitments to release or to grant a new trial to ‘political prisoners’ and to guarantee freedom of expression.

-           18 October (10th anniversary of the independence of Azerbaijan): no political prisoners were released.

-           24 October: the Secretary General informed the Ministers’ Deputies of his intention to put the report into the public domain and that an experts’ meeting (SG experts with Azeri experts) would take place in November. A press release on political prisoners in Azerbaijan (“One political prisoner is one too many”) was also issued.

The report was also transmitted to the Parliamentary Assembly

-           7-8 November 2001: Meeting in Strasbourg between SG independent experts and experts nominated by the Azerbaijan authorities. The ‘objective criteria’ are generally accepted by the Azeri side but the existence of political prisoners is denied.

 

-           29 December 2001:  Presidential pardon of several prisoners (we lack of information on the persons liberated)

SOME COMMENTS

on the report of experts of Council of Europe

on alleged political prisoners in Azerbaijan Republic

The experts' report has positive effect at the situation of political prisoners of Azerbaijan:

1.              There was confirmed existence of political prisoners in Azerbaijan.

2.              The process of examination had accompanied by the pardons of alleged political prisoners, last time in August 17, 2001.

3.              In listing of political prisoners, they used as much sources as possible. The expert group forced the government to react for so named "long list" since 1998 repeatedly submitted to it by the Human Rights Center of Azerbaijan and permanently ignored by authorities.

The government considered a fact of selection of the "pilot group" of prisoners as indirect indicator that they are political prisoners, and quickly liberated some of them even before the experts' decision. The opinion that some of liberated prisoners are not considered as political ones resulted in end of mass pardons of [alleged] political prisoners.

Simultaneously, the experts' report has some other negative impact to the situation of some groups of political prisoners and some individuals. In particular, decision that pilot case #21 (Sadiq Samedov) is not a political prisoner resulted in most severe punishment of him in the comparison with majority of defendant of so named "Sheki Case". Allegations on tortures of defendants during the investigation period and on ill-treatment of ill defendants were ignored, and 18 defendants were imprisoned.

Also, there was some "slight" reaction of the authorities of Azerbaijan for proposed list of political prisoners. In particular:

A. There are some mistakes in reports of liberation of some political prisoners. Some of them can be explained by confusion in cases of two and more political prisoners with similar names, different transliterations of Azeri names in Russian and English languages:

#11. Abbasov Shamshir, arrested in 1996 for participation of "October Coup" 1994 - recorded as pardoned on 25 June 2000.

            Mistake: In 2000 was liberated another Abbasov Shamshir (Aslan oglu), bodyguard of prosecutor Mahir Djavadov, arrested for participation of "March Coup" 1995 and sentenced on 19 March 1997 for 5 years imprisonment.

#18. Abdullayev Muzakir Imran oglu, arested in 1996 on participation of "October Coup" 1994 - recorded as pardoned on 10 July 1999.

            Mistake: Pardoned was his brother, Abdullayev Muzamil Imranoglu

#47. Ahmedov Jamaladdin [Khudush oglu], member of Azerbaijan Democratic Party, arrested in 1998, sentenced for 9 years imprisonment - recorded as pardoned on 25 June 2000

Mistake: Pardoned was Ahmedov Aladdin Djamaladdin oglu, sentenced on July 20, 1995

#112. Aliyev Siradj Mammed oglu, policeman, arrested in 1995 for participation of  "March Coup" 1995 - recorded as liberated on March 27, 1995

            Mistake: This person was sentenced in April 1996 by the Supreme Court (see "Panorama" newspaper, 13.04.1996). According to the mother of prisoner, Sabina Aliyeva, he had been tortured and sentenced at the basis of self-confessions.

172. Bakhshaliyev K., arrested in 1994 for participation of "October Coup" 1994 - recorded as pardoned on October 5, 2000

            Mistake: Pardoned was Bakhshaliyev Qarib Telman oglu, while Bakhshaliyev K. is Bakhshaliyev Keyan Djalil oglu serving now his term in the Colony #11.

#379. Maherramov Elbrus Ilyas oglu, policeman of the Special Police Squad, arrested for participation of "March Coup" - recored as liberated on January 1, 1994.

            Mistake: He had been arrested on January 26, 1996 in Quzanli village, Azerbaijan. Sentenced in 1996 (see, e.g. Zerkalo newspaper on 10.02.96 г.) Last information about him as imprisoned one was received from the Azerbaijani Association for Defence of Women's Rights in March 1997.

#404. Mammedov Hasan, activist of Popular Front Party, arrested reportedly in late May 1996 - recorded as released on 27.07.1995

            Mistake: He really got the suspended sentence before, i.e. possibly released in the date mentioned. However, in late May, his house had been searched by police, and hand granade was reportedly discoved. At least in Mid-October 1996 he had been in detention as the Azerbaijani Association for Defence of Women's Rights informed.

#479. Mustafayev Sattar Mustafa oglu, activist of Popular Front Party, arrested in 1994 (was mentioned date of sentence 1995) and sentenced for 6 years - recorded as liberated on 22 February 1993.

            Visible mistake in dates. Fortunately, prisoner is really liberated.

#547. Qasimov Tofiq, former Colonel of the Special Administration of President, arrested for participation of terrorist act organized by Special Police Squad against Shamsi Rahimov, a Chief of the Special Administration of President in 1994 - recorded as pardoned on 5 October 2000.

            Mistake. The amnested person, also named as Qasimov Tofiq, is former policemen, Commander of Patrol Service of the Special Police Squad was arrested for participation of "March Coup" 1995. There also was third Tofiq Qasimov, Scientist also arrested for alleged participation of "March Coup" and liberated in 1996.

B. Some military servicemen from the list were sentenced for imprisonment but liberated from detention with condition to go at the front-line (Article 42 of old Crime Code). So, they must be excluded from the list of imprisoned persons. But without abolishment of their sentence they can be imprisoned again. They are, e.g.:

#90. Aliyev Faiq, sentenced in January 29, 1997 on case of "Plot of Generals".

#573. Qurbanov Ajdar Mammed oglu, arrested in 1993 on the case of "Talysh Mugan Autonomous Republic"

C. The same situation of the persons who got suspended sentence. Until end of their term, they can be imprisoned again if they would be accused of some other crime. Some of they were included into list because of lack of information about sentence. But majority never were mentioned by human rights defenders as the persons under danger of new arrest, because their situation considered as much more confortable than status of detained persons.

D. There are two kinds of pardon: liberation from serving the rest of term and cutting in twice the rest of unserved term. Some people from the list were mentioned as pardoned but there is still uncertain are they in detention of liberated before the end of term. E.g.,

#248. Hasanov Eldar Zeynaladby oglu, arrested in October 1994, sentenced for 10-years imprisonment.

In October 1999 the unserved part of term, i.e. 5 years was decreased in twice, up to 2.5 years. So, the end of new 7.5-years term is April 2002, and to the moment when the government reported about the liberation by pardon he had to serve one year. Of course, he can be liberated before the end of his term by court decision because of good behaviour, but not because of mentioned pardon. So, here is some uncerntainty.

#548. Qasimov Vuqar Qasim oglu, former policeman of Special Police Squad, arrested in 1995 and sentenced for 11 years - recorded as pardoned on 16.11.1999

The pardon did not release him from detention, but decreased the rest of term. So, the scheduled end of sentence is around January 2003. At least in August 2000, the relatives appealed for his liberation.

E. Some well-known cases like the case of "Sadval" which were tried publicly and covered by mass media were marked as "No Information" (see e.g. #177). Taking into account that two main defendants on the case died being in death row, there is a fear that reference for lack of information hiddens a physical death of these prisoners.

F. Already after accession in Council of Europe, the President issued a new instruction about the order of pardon. For political prisoners-lifers it means that now they must serve at least 10 years to have a right to appeal for pardon. So, cases of the "political" lifers majority of whom were sentenced for capital punishment after 1996 could be reviewed only in 2 to 9 years. For example, the pilot case #2 (Alakram Hummatov) would be reviewed in 2 years, pilot case #5 (Elchin Amiraslanov) in 5 years and so on.

G. Through entire year of 2001, the politically motivated arrests continued, and tens people were added to the initial list which size is almost constant despite several pardons. These new names never were examined by any independent foreign experts.

Some conclusions

It is self-evident that experts' mission couldnot answer number of vital questions on the matter:

1.         Who should check the correctness of lists and governmental response?

2.         If there are some "non-political prisoners" in the list, who should identify and separate them fom "truely political" ones?

3.         What is a fate of alleged political prisoners whose cases are not "Under Consideration" (U.C.) or "Under Retrieval" (U.R.)?

4.         How about new arrests of conspirators, terrorists, hooligans who faces the same problems of unfair trials? Etc.

Taking into consideration a number of political prisoners in Azerbaijan and openly negative reaction of government for implementation already accepted recommendations of Council of Europe, there is necessary to continue the work of expert group until exhausting of entire problem.

To simplify a work of PACE Monitoring Group on the implementation of obligations on political prisoners, the newly appointed representative of CoE must be provided the certain instructions on the cooperation with local non-governmental organizations. According to the Opinion 222, they should regard the prisoners as “political”  ones.
