The Rapporteur Group on Education, Culture, Sport, Youth and Environment (GR-C) considered the question of WADA funding at its meetings of 13 December 2001 and 10 January 2002. At their meeting of 13 February 2002, the GR-C considered and agreed on the draft decisions on this item as well as on the addition of an amendment proposed by one delegation.

Decisions
The Deputies:
A. with regard to Governmental funding of WADA
1. reaffirmed the Council of Europe and its member states’ support for the work of the World Anti-Doping Agency (WADA) as expressed at their 692nd meeting (15 December 1999) and at the 10th to 14th meetings of the Monitoring Group on the anti-doping Convention (October 1999 to November 2001) ;
2. affirmed their commitment to the principle of equal funding to the World Anti-Doping Agency (WADA) from the side of the Olympic Movement and from the side of the public authorities;
3. took note, in this context, of the agreement reached at the meeting of the International Intergovernmental Consultative Group on Anti-Doping in Sport (Cape Town, 30 and 31 May 2001), that the European region should contribute 47.5% of the sum due from the side of the public authorities;
4. decided that the liability for the payment of contributions to WADA would be that of each individual state and not that of the Council of Europe as an Organisation;
5. decided, with regard to the contribution due in 2002 for the WADA 2002 budget ($ 4,037,500 or € 4,502,297 1 ), to recommend to their governments and to the governments of non-member states party to the European Cultural Convention:
a) to apportion the $ 4,037,500 contribution to the WADA 2002 budget between themselves according to the indicative scale of contributions (Appendix I) calculated for states party to the European Cultural Convention on the basis of Resolution (94) 31 of the Committee of Ministers with the derogation that rates of contributions be calculated to four decimal places;
b) to make their contributions directly to WADA, or, via the Special Account (see under decision below) set up for the purpose of receiving and transferring to WADA the respective contributions, it being understood that any shortfall in contributions made via the Special Account arising from exchange rate differences and/or bank transfer charges shall be met by the individual states concerned and not by the Council of Europe;
6. noted that the representatives of the European region on the WADA Board have requested:
a) that WADA should present more detailed, and consistent budget expenditure proposals for 2002, and clearer budget plans, within the limits of the budgetary ceilings stated at the WADA Board meeting on 3 December, for the period 2003/2006;
b) further work by the competent WADA authorities on the transformation of WADA into an organisation recognised by international public law;
7. noted that the Monitoring Group of the Anti-Doping Convention had decided at its 14th meeting to take action to draft an international public-law instrument capable of facilitating and ensuring recognition for WADA’s action vis-à-vis the public authorities (T-DO (2001)26, decision 7.iii);
8. a) authorised the opening on ... ... 2002 of the Special Account entitled “World Anti-Doping Agency” on the same basis as that governing the opening and management of Special Accounts approved by the Committee of Ministers at the 431st meeting of the Ministers’ Deputies (CM/Del/Concl(89)431, item 42a) to receive and forward to WADA the contributions to the WADA budget due from those participating states which wish to effect the payment of their contributions to WADA via the Council of Europe;
b) agreed that no lump-sum deduction would be made to cover overheads and the cost of managing this Special Account;
c) decided that there would be no fixed closing date for this Special Account.
9. invited their Rapporteur Group (GR-C) to continue to follow this question and to report to the Deputies as appropriate;
B. with regard to Governmental Representation
10. supported the request from the European representatives to the WADA and from the Monitoring Group for the allocation of a 5th seat for Europe on the WADA Foundation Board (cf T-DO (2001)26, decision 5.i) ;
11. noting the agreement reached at the International Intergovernmental Consultative Group on Anti-Doping in Sport (Cape Town, 30 and 31 May 2001) which recommends to the WADA Board to ensure “to represent more effectively the geographic and cultural diversity of the regions of the world”, invited the Secretary General to propose models for European representation on the WADA Board ensuring adequate representation, on an equal footing, of all member States of the Council of Europe and asked the GR-C to continue its study of this question and report back to the Committee of Ministers;
12. instructed the GR-C to draw up draft terms of reference for the representatives of the Council of Europe member states on the WADA Foundation Board and to submit in good time proposals for the nomination of representatives of the Council of Europe member states with effect from 2003.
