Abridged report of the 40th meeting (Strasbourg, 26-28 May 1999)

The European Committee on Migration (CDMG) held its 40th meeting from 26 to 28 May 1999 with Mrs Nadia MAROT in the chair. The list of participants is set out in Appendix 1 and the agenda in Appendix 2.

The Committee took note of the progress of the work of the Specialist Group on Integration and Community Relations (MG-S-INT) and particularly of the seminar on strategies for implementing integration policies, held from 4 to 6 May 1999 in Prague at the invitation of the Czech government. The Group’s final meeting will be held in the autumn (date to be arranged).

The Committee examined the 4th draft of the new report on community relations, which bears the provisional title "Diversity and cohesion in a changing Europe" and is due to be finalised by the end of 1999, and gave the MG-ED instructions for the pursuit of its work. It agreed to organise an event in 2000 to launch the publication of this important report.

The Committee took note of information on the national round tables on community relations which had been organised at the end of 1998. It was also informed of plans for a Round Table to be held in Ukraine from 6 to 8 July 1999. It agreed to pursue the round table process by organising thematic regional round tables (see proposals for the intergovernmental programme of activities for 2000). It agreed to be more involved in the preparatory work and to ensure the participation of one or two CDMG members in the round tables.

The Committee was informed about the ongoing activity on the role of employment services in promoting equal opportunities for migrants and disadvantaged ethnic groups.

The Committee agreed to pursue the work done to promote the Convention on the legal status of migrant workers on the basis of Ms Guild’s report. It also agreed to pursue a more general exercise on the legal status of migrants.

The Committee agreed to entrust examination of the draft recommendation concerning the security of residence of long-term immigrants, drafted by the MG-R-RES, to a Working Party and gave it the terms of reference reproduced in Appendix 3. The Committee of Ministers is invited to approve the specific terms of reference given to the Group. The Committee was informed that, following the decision taken at its last meeting to carry out a study on the treatment of admitted family members, Professor Groenendijk had been invited to write a report on family reunion. It decided to set up a Committee of Experts to prepare a draft recommendation on this subject and asked its Bureau to prepare terms of reference for it (see proposals for the intergovernmental programme of activities for 2000).

 

The Committee was informed that, following the seminar on managing migration in the wider Europe (12 -13 October 1998), a Working Group had been set up to prepare a revised and expanded version of the report ("Towards a managing migration strategy") submitted at the Seminar and to draw up a preliminary text of a succinct document for submission to a future Conference of Ministers.

The Committee was informed of the results of the meeting of the Specialist Group on Roma/Gypsies (MG-S-ROM) held on 29 and 30 March 1999. Following a request from the delegate of the Russian Federation, the Committee decided to propose to the Committee of Ministers that the Group be enlarged to include one more member. It decided to ask the Bureau to examine, in co-operation with the MG-S-ROM, a rotation system that would enable additional countries to participate in the Group’s work without increasing the number of members.

The Committee held an exchange of views on its role and medium-term strategy, and identified priorities to be implemented, keeping in mind the strategy for social cohesion and the need for a regional approach on certain issues (variable geometry) while ensuring the coherence in the Committee. Taking into account the publication in 2000 of two major reports ("Diversity and cohesion" and "Towards a managing migration strategy"), the CDMG considered appropriate that they be launched during a major event (colloquy, symposium, seminar). It gave the Secretariat instructions on activities to be proposed for the draft intergovernmental programme of activities for 2000.

The afternoon of 27 May 1999 was devoted to a Seminar on "the political rights of long-term immigrants at local level".

The Committee was given information on various related activities under way within the Council of Europe and other international bodies.

The Committee agreed to hold its 41st meeting from 1 to 3 December 1999.

APPENDIX 3

SPECIFIC TERMS OF REFERENCE

 

1. Name of committee: WORKING PARTY OF THE EUROPEAN COMMITTEE ON MIGRATION (CDMG) ON SECURITY OF RESIDENCE OF LONG-TERM IMMIGRANTS

2. Type of committee: Working Party

3. Source of terms

of reference: European Committee on Migration (CDMG)

4. Terms of reference:

The Working Party shall revise the draft "Recommendation of the Committee of Ministers to member States concerning the security of residence of long-term immigrants" drawn up in 1998 by a Select Committee of Experts, in the light of the written comments and proposals of amendments submitted by member States. The Working Party shall take into account relevant legal instruments in the field as well as developments taking place in the framework of the European Union. The revised version of the above mentioned text shall be submitted to the CDMG at its spring meeting in the year 2000.

5. Membership:

The Working Party shall consist of fourteen experts designated by the governments of the following member States: Belgium, Finland, France, Germany, Greece, Italy, Lithuania, Norway, Poland, Portugal, Romania, the Russian Federation, Switzerland and Turkey. The governments of the Czech Republic and the Netherlands shall designate substitute experts.

The Council of Europe budget will bear the travel and subsistence expenses of these fourteen experts.

These experts shall be persons having responsibility for legislation and policy on the residence status of long-term immigrants.

The European Commission shall be invited to be represented at the meetings of the Working Party.

The Working Party will hold two meetings before the first meeting of the CDMG in the year 2000.
