Introduction
At the start of the meeting, the Deputies observed a minute’s silence, in sympathy and solidarity with Turkey following the attacks in Ankara. The Chairman then bade farewell to Ms Irina Beglaryan, Deputy to the Permanent Representative of Armenia, and Mr Demian Podolskyi, Deputy to the Permanent Representative of Ukraine, and thanked them for their contribution to the work of the Committee. He also welcomed Mr Piero Vaira, Deputy to the Permanent Representative of Italy, and Ms Ann Marie Bolin Pennegård, Deputy to the Permanent Representative of Sweden, and wished them a pleasant stay in Strasbourg and a successful mission within the Committee.

1. took note of the synopsis of the GR-DEM meeting held on 6 October 2015 (document GR‑DEM(2015)CB7);
Concerning the role and functioning of NGOs in the Council of Europe
2. took note of the report of the discussions on the role and functioning of NGOs in the Council of Europe submitted orally by the Chair of the GR-DEM;
Concerning Azerbaijan
3. took note of the report “State of implementation of the commitments entered into by Azerbaijan” (document GR-DEM(2015)15);
4. expressed serious concerns at the alarming deterioration of the legal and administrative framework in which civil society and independent media operate, and at the increased number of prosecution procedures against human rights defenders and journalists, along with an increased recourse to detention;
5. reiterated their call to Azerbaijan to implement its commitments, paying special attention to the shortcomings and concerns identified in the aforementioned report;
6. welcomed the progress in some areas, as illustrated by the adoption of a number of measures mentioned in the said report;
7. took note of the sustained efforts by the Azerbaijani authorities to promote intercultural and interreligious dialogue, in particular through the “Baku process”;
8. stressed the particular importance and urgency of taking effective measures to ensure respect for fundamental freedoms and the democratic functioning of institutions, in particular in view of the forthcoming parliamentary elections to be held on 1 November 2015;
9. reiterated their commitment to continue to provide assistance to Azerbaijan to this end and, in this connection, stressed the importance they attach to the effective implementation of the 2014-2016 Action Plan;
10. called on Azerbaijan to implement the recommendations as specified in the report;
11. invited their Rapporteur Group on Democracy (GR-DEM) to report back to them in one year.

1. adopted Recommendation CM/Rec(2015)7 of the Committee of Ministers to member States on pedagogical material for landscape education in primary school, as it appears at Appendix 7 to the present volume of Decisions ;
2. adopted Recommendation CM/Rec(2015)8 of the Committee of Ministers to member States on the implementation of Article 9 of the European Landscape Convention on Transfrontier Landscapes, as it appears at Appendix 8 to the present volume of Decisions ;
3. in the framework of the session 2014-2015 of the Council of Europe Landscape Award of the European Landscape Convention:
a. attributed the Landscape Award to the following achievement:
“Borderless co-operation of local communities for the landscape heritage of ‘Fabulous’ Hetés”, Local government authorities, the Greenways Methodological Association and the Iron Curtain Trail Association, Hungary, and all the Slovenian villages of the Hetés Region – Project presented by Hungary;
b. attributed identical special mentions of the Landscape Award to the following achievements:
- “Service tree, the tree of the Slovácko Region”, Municipality of Tvarožná Lhota and INEX voluntary
service Bílé Karpaty – NGO, Czech Republic;
- “Liptovská Teplička: protection of unique types of historical landscape”, Village of Liptovská Teplička, Slovak Republic;
- “The Sénia Territory Millennium Olive Tree Landscape”, Taula del Sénia Commonwealth, Spain;
c. acknowledged and praised the great value of all the other projects presented and recommended to make them well-known to the general public for their exemplary value and as sources of inspiration:
- “Enhancement of the natural landscape of Hof ter Musschen”, Committee on the environment of Brussels and surroundings, Belgium;
- “Ecomuseum Blaca Hermitage”, Cultural Centre of Brač, Croatia;
- “Development of the historical centre of Agios Athanasios Municipality”, Municipality of Agios Athanasios, Cyprus;
- “Bull by the Horns: grazing in nature and landscape management”, The Centre for Economic Development, Transport and the Environment for Central Finland, Finland;
- “Agricultural Park of Paduli”, Open Urban Laboratory, Italy;
- “The town of Kuldīga in the Venta Valley: preserving a unique landscape for the next generations”, Kuldīga Municipality, Latvia;
-“New Dutch Waterline”, Board of the New Dutch Waterline, Netherlands;
- “Biodiversity and natural resources management in Camili Basin”, Camili Environmental Protection and Development Association, Turkey;
4. agreed to transmit the draft European Convention on Cinematographic Co-production (revised) and its Explanatory Report, as they appear in documents CM(2015)139 and CM(2015)139-add, to the Parliamentary Assembly and invited the Assembly to give its opinion on the draft Convention;
5. agreed to transmit the draft Protocol amending the European Landscape Convention (ETS
No. 176), as it appears in document CM(2015)140, to the Parliamentary Assembly and invited the Assembly to give its opinion on the draft Protocol;
6. in the light of decisions 1 to 5 above, took note of the abridged report of the 4th meeting of the Steering Committee for Culture, Heritage and Landscape (CDCPP), as it appears in document CM(2015)135, as a whole.

Decisions
The Deputies
Concerning the 25th session of the Council of Europe Conference of Ministers of Education
1. noted that the conference would be held in April 2016 in Brussels, Belgium;
2. agreed to entrust the preparation of the conference to the Steering Committee for Educational Policy and Practice (CDPPE);
3. noted that the theme of the conference would be: “The role of education for the development of competences for democratic culture”;
4. noted that the sub-themes of the conference would be:
- “Development of competences for the strengthening of the culture of democracy”;
- “The effectiveness of current education policies, curricula and training programmes on democratic culture and citizenship, in particular with regard to the fight against violent extremism and radicalisation leading to terrorism”;
- “European vs Global challenges in citizenship education – implementation of the UN Agenda for Education 2030 “Ensure inclusive and equitable quality education and promote lifelong learning opportunities for all””;
5. noted that the following would be invited to participate in the conference:
- States Parties to the European Cultural Convention;
- Committee of Ministers;
- Parliamentary Assembly;
- Congress of Local and Regional Authorities of the Council of Europe;
- Education and Culture Committee of the Conference of INGOs of the Council of Europe;
- European Union;
- European Steering Committee for Youth (CDEJ);
- Advisory Council on Youth (CCJ);
6. noted that the following States would be invited to attend the conference as observers:

Declaration by the Committee of Ministers on the death penalty

at the 1238th meeting of the Ministers’ Deputies)
The Committee of Ministers welcomes the joint declaration by the High Representative of the European Union and the Secretary General of the Council of Europe on the World Day against the Death Penalty and, in view of the recent executions in the United States of Ms Kelly Gissendaner, in the State of Georgia, and Mr Alfredo Prieto, a citizen of El Salvador, in the State of Virginia, reiterates its unequivocal opposition to capital punishment and once again calls on the United States, an observer country to the Council of Europe which shares our principles, to introduce a moratorium on the application of the death penalty as a first step towards its total abolition.

on pedagogical material for landscape education in primary school

The Committee of Ministers of the Council of Europe, under the terms of Article 15.b of the Statute of the Council of Europe,
Considering that the aim of the Council of Europe is to achieve greater unity between its members for the purpose of safeguarding and realising the ideals and principles which are their common heritage;
Having regard to the European Landscape Convention (ETS No. 176, 2000);
Believing that the landscape is a key element of individual and social well-being and that its protection, management and planning entail rights and responsibilities for everyone;
Considering the aims of the European Landscape Convention and wishing to encourage its implementation;
Referring to Article 6.B of the European Landscape Convention on specific measures for training and education, which states that “Each Party undertakes to promote: ... school ... courses which, in the relevant subject areas, address the values attaching to landscapes and the issues raised by their protection, management and planning”;
Recalling the principles laid out in Recommendation CM/Rec(2008)3 of the Committee of Ministers to member States on the guidelines for the implementation of the European Landscape Convention, according to which school curricula should foster children’s awareness of and sensitivity to landscape;
Having regard to Recommendation CM/Rec(2014)8 of the Committee of Ministers to member States on promoting landscape awareness through education which considers that one of the aims of education is to train young people and equip them with a set of skills necessary for citizenship and democracy;
Asserting that educational activities in the landscape field are an excellent way of giving meaning to the future,
Recommends that the governments of member States make the document “Landscape teaching activities for primary education”[1] available as a source of inspiration and facilitate its dissemination and translation into other languages as appropriate.

on the implementation of Article 9 of the European Landscape Convention on Transfrontier Landscapes

The Committee of Ministers, under the terms of Article 15.b of the Statute of the Council of Europe,
Considering that the aim of the Council of Europe is to achieve a greater unity between its members for the purpose of safeguarding and realising the ideals and principles which are their common heritage;
Having regard to the European Landscape Convention (ETS No. 176, 2000);
Considering Article 9 of the said Convention on Transfrontier Landscapes which states that “The Parties shall encourage transfrontier co-operation on local and regional level and, wherever necessary, prepare and implement joint landscape programmes”;
Referring to the European Outline Convention on Transfrontier Co-operation between Territorial Communities or Authorities (ETS No. 106, 1980) and its additional protocols;
Bearing in mind the European Charter of Local Self-Government (ETS No. 122, 1985);
Considering that transfrontier landscapes bear witness to geographical continuity, historic events and the human and cultural relationships that have been forged over time;
Eager to raise greater awareness on both sides of the border of the landscape values of the areas concerned and to promote transfrontier co-operation focusing on landscapes;
Wishing to involve and bring together elected representatives, professionals, the local population and other stakeholders taking action for the protection, management and development of these transfrontier landscapes;
Considering that it is important for appropriate consideration to be given to landscape and its environmental, cultural, social and economic values as a development factor for local societies,
1. recommends that the States Parties to the European Landscape Convention promote co-operation focusing on transfrontier landscapes by encouraging local and regional authorities to work together to draw up, where appropriate, joint landscape-enhancement programmes for implementation of Article 9 of the European Landscape Convention on transfrontier landscapes;
2. calls on the Parties concerned to inform the other Parties to the Convention, in the framework of the Council of Europe Information System on the European Landscape Convention, of the co-operation programmes drawn up and put in place in order to foster an exchange of experience between the Parties.

on the evaluation of the British Overseas Territory of Gibraltar by the Committee of Experts on the Evaluation of Anti-Money Laundering Measures and the Financing of Terrorism (MONEYVAL)

The Committee of Ministers,
Recognising the importance of the fight against money laundering, the financing of terrorism and other forms of serious proceeds-generating crimes for the purpose of which the Council of Europe has adopted a variety of instruments, in particular the 1990 Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime (ETS No. 141) and the 2005 Council of Europe Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime and on the Financing of Terrorism (CETS No. 198);
Having regard to Resolution CM/Res(2013)13 on the Statute of the Committee of Experts on the Evaluation of Anti-Money Laundering Measures and the Financing of Terrorism (MONEYVAL), adopted by the Committee of Ministers on 9 October 2013, and to the status of the Council of Europe/MONEYVAL since June 2006 as an associate member of the Financial Action Task Force (FATF);
Underlining the importance of MONEYVAL as a leading international partner in the global network of anti-money laundering and combating the financing of terrorism (AML/CFT) assessment bodies and its role in strengthening the global AML/CFT network;
Bearing in mind Article 2 (2) d of the Statute of MONEYVAL by which member States of the Council of Europe which are members of the FATF may request evaluations by MONEYVAL to cover territories for whose international relations they are responsible or on whose behalf they are authorised to give undertakings, provided these territories are not evaluated by the FATF;
Considering the United Kingdom's request under Article 2 (2) d of the Statute of MONEYVAL, dated 19 May 2015, for the British Overseas Territory of Gibraltar to be evaluated by MONEYVAL:
1. agrees to the request of the United Kingdom that the British Overseas Territory of Gibraltar be evaluated by MONEYVAL and be subject to its procedures without voting rights;
2. decides that all operational implications of the adoption and implementation of this resolution shall be resolved in consultations with the Secretariat of the Council of Europe and in full respect of Articles 2 (2) d and 3 (1) of the Statute of MONEYVAL.
