Decisions

The Deputies

1.         recalled that the European Court found that the legal framework in the respondent State did not provide quick, transparent and accessible procedures to change the transgender applicant’s sex/gender as recorded on his birth certificate;

As regards individual measures

2.         noted with satisfaction that the Civil Status Registry modified the applicant’s sex/gender marker in official records; considered therefore that no further individual measures are necessary and decided to close the supervision of individual measures;

As regards general measures

3.         noted with satisfaction that in response to the European Court’s findings the authorities prepared draft amendments to the Civil Status Registration Act with a view to regulating the conditions and procedures for the legal recognition of gender;

4.         welcomed in particular the authorities’ constructive engagement with civil society and close
co-operation with the Secretariat during the drafting process;

5.         noted further with interest that following the approval of the above draft amendments by the government, on 6 May 2021 they were tabled in Parliament for adoption; strongly encouraged the authorities to take all necessary measures to ensure that this legislation is adopted without delay;

6.         invited the authorities to keep the Committee of Ministers informed of all relevant developments in this regard and to submit an updated action plan by 1 March 2022 at the latest.
