Convention on the Transfer of Sentenced Persons (ETS No. 112)

Request by Kyrgyzstan to be invited to accede

Item to be considered by the GR-J at its meeting on 3 February 2022

 

1.         By a letter dated 21 September 2021, received and registered at the Secretariat General on 28 September 2021, Mr. Muktar Djumilaev, Ambassador of the Kyrgyz Republic to the Kingdom of Belgium, expressed to the Secretary General of the Council of Europe the interest of the Government of the Kyrghyz Republic to be invited to accede to the Convention on the Transfer of Sentenced Persons (ETS No. 112) (see Appendix 1).

2.         According to Article 19, paragraph 1, of the Convention and in line with the practice of the Council of Europe, the Secretariat proceeded to a consultation of member States of the Council of Europe and non-member States which are Contracting States to the Convention, requesting them to communicate to the Secretariat whether their authorities would object to the accession of Kyrgyzstan to the Convention on the Transfer of Sentenced Persons if the request to be invited to accede was formally submitted to the Committee of Ministers. The deadline for replying was 15 November 2021. Following requests from delegations, the original deadline was extended to 15 December 2021. No objection was communicated to the Secretariat.

3.         The relevant provisions of the Convention on the Transfer of Sentenced Persons can be summarised as follows.

a.         Summary of the Convention

4.         The Convention on the Transfer of Sentenced Persons was opened for signature by the member States of the Council of Europe and non-member States which have participated in its elaboration, in Strasbourg, on 21 March 1983. It entered into force on 1 July 1985. The chart of signatures and ratifications appears in Appendix 2.

5.         The Convention on the Transfer of Sentenced Persons is primarily intended to facilitate the social rehabilitation of prisoners by giving foreigners convicted of a criminal offence the possibility of serving their sentences in their own countries. Transfer may be requested by either the State in which the sentence was imposed (sentencing State) or the State of which the sentenced person is a national (administering State). It is subject to the consent of those two States as well as that of the sentenced person. The Convention also lays down the procedure for enforcement of the sentence following the transfer.

6.         The Convention has been complemented by an Additional Protocol (ETS No. 167), which was opened for signature on 18 December 1997 and entered into force on 1 June 2000. States having acceded to the Convention are entitled to accede to the Protocol thereto.


b.         Procedure for accession

7.         Article 19, paragraph 1, of the Convention on the Transfer of Sentenced Persons provides that:

"After the entry into force of this Convention, the Committee of Ministers of the Council of Europe, after consulting the Contracting States, may invite any State not a member of the Council and not mentioned in Article 18.1 to accede to this Convention, by a decision taken by the majority provided for in Article 20.d of the Statute of the Council of Europe and by the unanimous vote of the representatives of the Contracting States entitled to sit on the Committee".

8.         Given the above, the Deputies may wish to invite Kyrgyzstan to accede to the Convention on the Transfer of Sentenced Persons.
