[1] The present final draft Agenda and Order of Business takes into account changes that have taken place, to the Secretariat' knowledge, since the provisional draft Agenda and Order of Business on 19 January 1998.
* Those items marked with an asterisk were added after approval of the Draft Agenda (Appendix 2 to the volume of Decisions of the 610th meeting) in accordance with the Rules adopted by the Committee of Ministers for the application of Articles 32 and 54 of the European Convention on Human Rights and with the European Convention on Human Rights.
[2]It is proposed that all the Resolutions concerning the cases which appear in this section be adopted without debate by collective decision model A as appended, both for sub-section A1 (Article 32 of the ECHR) and for sub-section A2 (Article 54 of the ECHR).
[3] In the cases appearing under sub-section B1, the Committee of Ministers is called upon to decide whether there has been a violation or violations of the Convention and, if need be, to adopt the draft interim resolution appended to the Notes on the Agenda. It is proposed, for each of these cases, to adopt decision model B1 as appended, it being understood, however, that for grouped Notes on the Agenda, there will be a single decision per group.
[4] Among cases appearing under sub-section B2 the Committee of Ministers is called upon to decide whether there has been a violation or violations of the Convention and to adopt, if need be, the draft interim resolution appended to the Notes on the Agenda. Is is therefore proposed to adopt for each of these cases the relevant model decision as it appears attached, it being understood that for grouped Notes on the Agenda, there will be a single decision per group.
[5] As these cases require the adoption of a specific decision combining elements from the model decision B2 and C, it is proposed to deal with them into a separate section, named BC. A new model decision for this section is appended to the present draft Agenda and Order of Business.
[6] In the cases appearing in this sub-section, the Committee of Ministers is called upon to consider new judgments delivered by the European Court of Human Rights. It is proposed to adopt the decision model B3 as appended, for each of the items in this section.
[7] It is proposed to adopt the model decision C as appended for each of the items in this section.
[8] It is proposed for all the cases appearing in this section to adopt the draft collective model decision D, except for the cases appearing in sub-section DI.2 (Article 32, supervision of payment of default interest) for which the draft collective model decision DI.2 should be adopted. This section being examined in principle without any debate, it is recommended that all the information concerning the payment of just satisfaction be sent in writing to the Secretariat after the meeting.
[9] This section contains all cases for which payment of just satisfaction should have taken place at least six months ago. Each item must be considered individually and be the object of a separate decision according to the relevant model decision as appended.
[10] It is proposed to adopt a collective decision model E as it appears in the appendix, both for cases under sub-section E1 (Article 32 of the ECHR) and for cases under sub-section E2 (Article 54 of the ECHR). Each item is nevertheless considered individually.
[11] In this section are presented all the cases of which a separate examination has been requested by a Delegation and cases that, for one reason or another, cannot be included in any of the other sections. Obviously, there is no model decision for the cases appearing in this section.
[12] In these cases, the Commission will submit ex officio the complementary proposals on just satisfaction without waiting for the Committee of Ministers to make a request, in accordance with the Decision taken by the Deputies at their 484th meeting (November 1992).
