Date of signature: date on which the agreement has been signed.
Date of entry into force: date on which the agreement started to become applicable.
Personal scope:
Indicate with an “X” in the table:
whether the agreement is covering only national of the countries which are party to the agreement; or
whether the agreement is open to all citizens, whatever their citizenship/nationality, as long as they are/have been insured in the concerned countries (party to the agreement).
In case the agreement is of a mixed type – some clauses only for citizens, some other clauses for all socially insured regardless of their citizenship - try to indicate shortly for which clauses you apply the one or the other method for delineating your scope.
Material scope
Applicable legislation:
Indicate with an “X” in the table whether the agreement includes a section on rules governing the applicable legislation.
Give the main principle governing these rules (e.g. lex loci laboris, lex loci domicilii, ….).
Indicate whether exceptions to the rules apply, and in particular whether you have foreseen in the exception of posting provisions.
Anti-discrimination:
Indicate with an “X” whether the agreement includes a general rule on non-discrimination.
If not foreseen as a general rule, try to indicate shortly for which coordination sections a non-discrimination clause is guaranteed.
Pensions
Indicate with an “X” whether the principle of exportation (acquired rights) is guaranteed for the coordination of pensions.
Indicate with an “X” whether use is made of the principle of aggregation of insurance records for the coordination of pensions.
