Legal support and conducting payment for trainers work on trainings for investigators of the National police of Ukraine

Description of services

Joint Programme between the European Union and the Council of Europe “Strengthening the Implementation of European Human Rights Standards in Ukraine” (herein after “the Project”), implemented as part of the Programmatic Cooperation Framework for Eastern Partnership countries, is providing expert and technical support to the National police of Ukraine in the police reform process. Within police component of the Project, the Council entrusts the Service Provider with provision of the legal support and financial reimbursement for trainers carrying out initial and further trainings for investigators of the National police of Ukraine in Kyiv and 8 regions of Ukraine.

The Service Provider shall provide the following services:

a. Collection and/or verification of bank details and personal data of the trainers. Bank details and limited personal information (name, mobile phone numbers) will be provided by the Project

b. Drafting the civil-type contract for provision of training services

Requirements: draft contract should be prepared in compliance with national legislation, should be brief but comprehensive, should be clear and transparent for tax checks.

c. Communication and exchange of documents with trainers in Kyiv and 8 regions of Ukraine

Sending of contracts to trainers, using post services, couriers etc. to be defined by service provider.

d. Conducting of payments under the above-mentioned contracts for trainers completed their tasks in full or periodically

Tasks completed by trainers should be reimbursed by one payment or several tranches in accordance with the Project’s instructions after provision of registries of trainers’ presence and completed work and on the basis of  certificates of acceptance of services.

Fees are calculated as 100 UAH for one academic hour provided.

Information on number of trainers and hours per region is as following:

Up to date communication with the Project, update of information is mandatory.

Payment

In return for the fulfilment by the Service Provider of its obligations under the contract, the Council undertakes to pay the Service Provider a fee in UAH.

·         The fee shall be payable within 60 calendar days upon receipt of the services of the contract (listed in Appendix II) and its acceptance by the Council and on presentation of an invoice.

·         Advance payment of 30% or payment in tranches is possible.

After advance payment is received and used by the Service Provider, the package of documents (copies) proving the payments has been provided to trainers should be sent to the Council. Transfer of next tranche will be possible only after mentioned package of documents is received and approved by the Council.

Service Provider Exclusion

Criteria

Bidders:

·         Have not been sentenced by final judgment on one or more of the following charges: participation in a criminal organisation, corruption, fraud, money laundering;

·         Are not in a situation of bankruptcy, liquidation, termination of activity, insolvency or arrangement with creditors or any like situation arising from a procedure of the same kind, or is not subject to a procedure of the same kind;

·         Have not received a judgment with res judicata force, finding an offence that affects its professional integrity or constitutes a serious professional misconduct;

·         Do comply with its obligations as regards payment of social security contributions, taxes and dues, according to the statutory provisions of the country where it is established.

Service Provider Adjudication Criteria ((Selection Criteria)

Bidders will be assessed against the following criteria:

·         Proven working experience in providing similar services.

·         Financial offer.

·         Operational capacity of the company.

·         А good record of similar services provided to big organisations/companies, international organisations would be an advantage.

Documents to be provided by the Bidders

All bids should be sent via e-mail to [email protected] indicating TENDER BH4435/2016/01 in a subject line by 21 November 2016, 12:00 Kyiv Time. The deadline is compulsory.

The following documents should be presented:

1.      Cover letter for the offer containing information about proven working experience in providing similar services and a good record of similar services provided to big organisations/companies, international organisations would be an advantage;

2.      a provisional budget (using the template reproduced in Appendix I). Proposed budget in UAH should be duly  signed, provided on the Company’s letterhead
