Decisions

 

The Deputies

concerning Recommendation 38 (1998) on the situation of local and regional self-government in the Republic of Moldova

1. took note of this Recommendation ;

2. transmitted this Recommendation and its Appendix to the Government of Moldova ;

3. transmitted this Recommendation to the Steering Committee of Local and Regional Democracy (CDLR) for information ;

4. decided to bear Recommendation 38 (1998) in mind for the purpose of monitoring the commitments entered into by Council of Europe member States under the heading of local democracy ;

5. took note that Commission on Democracy through Law, in co-operation with the Congress of Local and Regional Democracy of Europe, provided assistance to regional authorities of Gagauzia in elaboration of the "Legal Code" stipulated by Article 12 of the Statute on Autonomy of Gagauzia ;

6. agreed to study, within its Rapporteur Group for Democratic Stability (GR-EDS), the possibility of allocating financial resources to training for local and regional government staff, if the Moldovan authorities express their wish for this, and to examine the possibility of including such assistance in the LODE Programme, or in the special programme for Moldova, co-financed by the European Union ;

7. adopted the following reply to Recommendation 38 (1998) :

"The Committee of Ministers considered CLRAE Recommendation 38 (1998), addressed to the Moldovan authorities. It welcomes the efforts of the Congress to monitor the compliance of member States’ legislation and practice concerning local and regional democracy with the European Charter of Local Self-Government.

The Committee of Ministers will bear this Recommendation in mind for the purpose of monitoring the commitments entered into by the Council of Europe member States under the heading of local democracy. It also agreed to study within its Rapporteur Group for Democratic Stability (GR-EDS) the possibility of allocating financial resources to training for Moldovan local and regional government staff, if the Moldovan authorities express their wish for this, and on the basis of detailed proposals to this end. The Committee will also bear in mind this proposal while examining the draft budget of the Council of Europe for 1999.

The Committee of Ministers decided to forward this Recommendation to the Government of Moldova and to the Steering Committee on Local and Regional Democracy for information."

 

Concerning Recommendation 39 (1998) on the incorporation of the European Charter of Local Self-Government into the legal systems of ratifying countries and on the legal protection of local self-government

8. decided to transmit the third report of the Working Group responsible for monitoring the implementation of the European Charter of Local Self-Government concerning the Committee of Ministers’ reply to Recommendation 2 (1994), based on the CDLR’s report (see CDLR (96)8 Addendum revised) to the Contracting Parties to the European Charter of Local Self-Government ;

9. asked its Steering Committee on Local and Regional Democracy (CDLR) to study Recommendation 39 (1998) as a whole and in particular item 7, to draw up a draft reply to this Recommendation and to report back at one of their forthcoming meetings (see Decision No. CM/699/120598 as it appears in Appendix 3 to the present volume of Decisions).

10. took note of Resolution 59 (1998).
