Decision

The Deputies adopted the following reply to CLRAE Recommendation 42 (1998) on "Nuclear safety and local/regional democracy":

"The Committee of Ministers has examined CLRAE Recommendation 42 (1998) on "Nuclear safety and local/regional democracy" and forwarded it to governments of the Council of Europe member States and to the European Commission.

The Committee of Ministers shares the Congress's concerns as to the problems that might be caused to people and their environment by the peaceful use of nuclear energy. It, nevertheless, considers that it is not in a position to "initiate the setting up of a genuine procedure for monitoring the implementation of the Convention on Access to Environmental Information and Public Participation in Environmental Decision-Making…", as this Convention is not part of the corpus of Council of Europe Conventions.

Ratification by member States of the Council of Europe's "Convention on Civil Liability for Damage resulting from Activities dangerous to the Environment" and further development of the activities of the EUR-OPA Major Hazards Partial Agreement can also contribute to reducing the possible adverse effects of the peaceful use of nuclear energy."
