CDDECS

The European Committee for Social Cohesion, Human Dignity and Equality (CDDECS) is responsible for overseeing the Council of Europe’s intergovernmental work in the areas mentioned in its title. It will contribute to the protection of human dignity, equality and equal opportunities for all, and the prevention and combating violence and discrimination on any ground, in order to create societies that do not generate exclusion.

Introduction

The European Committee for Social Cohesion, Human Dignity and Equality (CDDECS) held its 1st meeting from 3 to 5 June 2014 in Strasbourg (France). The Agenda, as adopted, appears in Appendix I and the list of participants in Appendix II.

 

  1. Opening of the meeting and adoption of the Agenda

 

Opening address

The meeting was opened, in the absence of Mr Thorbjørn Jagland, Secretary General (SG) of the Council of Europe, on his behalf by Ms Snežana Samardžić-Marković, Director General of Democracy. The opening address noted that

 

 

 

Further remarks on the importance of the CDDECS, the need to address the transversal nature of the CDDECS’ themes in a way combining legal and social perspectives, and the need to translate expertise within the CoE and the CDDECS into political reality in the member states were made by Ms Marja Ruotanen, Director of Human Dignity and Equality Directorate, and Ms Michele Akip, Secretary to the European Committee for Social Cohesion, Human Dignity and Equality.

 

Adoption of the Agenda

The overarching mandate of the CDDECS and the human rights based legal approach was widely appreciated. However, some delegations expressed reservations on the agenda, as it failed to address the issue of social cohesion and concerns were raised on the possible overlapping work with CDDH.

 


 

  1. Election of the Chair and Bureau, appointment of the rapporteur for Gender Equality

 

After discussing various procedural options for the voting, the CDDECS proceeded with a vote on the chair, the vice-chair and the 7 members of the bureau, of which one member was elected for one year only, to allow rotation in the bureau.

 

 

 

 

 

  1. Round table I: Guaranteeing equality and equal dignity for all

 

 

 

 

 

 

 

Ms Tulkens, in her introductory words stressed the fundamental importance of ensuring equality and dignity for all and the need for eliminating all kinds of discrimination on any grounds. She introduced the term transformative equality which is used in academia and in some countries in increasing frequency. In effect it means removing systematic inequalities in the society and eradicating poverty and disadvantage by taking into consideration vulnerabilities and stereotypes and enabling all people to have the skills and abilities they need to participate in society and decision making as well as in productive activities.

 

Mr Muiznieks concentrated on three main issues that emerge frequently during his country visits, namely “equality and non-discrimination”, “austerity and its negative effects on society” and “deinstitutionalisation of persons with disabilities”. On anti-discrimination he noted that the most important factors in allowing discrimination to continue in a society is the social acceptance of it and the stereotypes and prejudices together with a very low risk of punishment. The legal standards on various levels in the international level are good, but on national level anti-discrimination legislation is often lacking and the equality bodies are not able to function independently with sufficient resources. The general knowledge of remedies is low and the authorities, including law enforcement officials, often fail to take discrimination cases seriously. This all requires enhanced legislative measures, training and raising awareness.

 

With regard to austerity, Mr Muiznieks noted that the measures taken have disproportionate effects on the most vulnerable groups of society, young and old, members of minorities, persons with disabilities, unemployed, sick, uneducated, migrants etc. He stressed the importance of NHRIs in ensuring that nobody is left behind in the society and pointed out that inequality in general is bad for economic growth. On deinstitutionalisation Mr Muiznieks wanted to draw attention to the fact that austerity has slowed down many deinstitutionalisation projects, even those funded by the EU, which is enough for the increased need to pay special attention to the implementation of the rights of persons with disabilities.

 

Ms Acar concentrated to the urgent need to put an end to violence against women and girls and family violence and end the widespread impunity. Seven out of 10 women experience violence at some point of their live. She offered a look into the history behind the creation of the Istanbul Convention, which will enter into force on 1 August 2014. The convention will bring a rights based approach with social dimension to table and provide binding legal guidelines on how to address the issue of domestic violence. She stressed the importance of the 4 “P”s= prevention, protection, prosecution and integrated policies that are part of the convention together with effective monitoring mechanism.

 

Ms Scheele drew attention to issues relating to gender equality and non-discrimination, especially of the LGTBI persons. An important factor to pay attention to in the equality discussion is the financial independence, including during pension, of women, which is directly influenced by women working part time or not at all outside their homes. Also different stereotypes and for example religious communities have a direct effect on how women and LGTBI persons are regarded in the society. The law enforcement and judicial authorities have to be trained to take complaints about discrimination and related violence seriously and in all the awareness on equality and understanding discrimination related issues need to be brought to a higher level in all of the society.

 

Mr Biedron noted that when public discussion about LGTBI persons has become more open and accepted with an increasing amount of persons “coming out” and more countries accepting same sex marriage etc, at the same time the hate speech, discrimination and violence against LGTBI persons has also increased. Countries have enacted legislation banning homosexual propaganda or forcing NGOs to register as foreign agents, public institutions are included in stigmatisation of minorities, intolerance is increasing within all age groups in general and objective education on minority related issues is not available as widely as necessary. Horizontal approach is needed, comparable data needs to be collected and societies need to become more tolerant ones where discrimination is not accepted and where people do not need to live in fear.

 

The CDDECS exchanged views with high level panellists on the effects of austerity on the protection  of human rights, on combatting discrimination, stereotypes and violence, on the ways to effectively ensure dignity, equality and the full enjoyment for all of all - civil, political, social, economic and cultural - human rights, paying special attention to vulnerable persons among women, children, persons with disabilities, the elderly, LGBTI persons and others that might have difficulties in enforcing their fundamental rights and freedoms;

 


The committee took note of the need for political leadership for change, the importance of multidisciplinary approaches and research, the need for increased capabilities of equality bodies, the necessity for training and public awareness and increased participation and representation in the public sphere by vulnerable groups;

 

  1. Round table II: Making justice accessible for all

 

Obstacles to access to justice persist, notably for victims of violence and discrimination. These obstacles discourage the victims from seeking redress and from pursuing justice.  

 

Mr Stavros listed various forms of obstacles to access to justice, namely lack of relevant information, cost of the proceedings, fear of various consequences and the lacking capacity to act, be it due to disability, young or old age, or other reason. Despite the good level of normative basis to counter discrimination, violence against women, trafficking in human beings etc. and the large amount of recommendations, decisions and judgments on these issues many problems persist: Discrimination is not recognised, sometimes the victim status is not recognised even by the victim, legal aid and other support mechanisms do not guarantee sufficient assistance or coverage and secondary victimisation is not prevented effectively.

 

Ms Nussberger divided the obstacles to access to justice in three categories: legal, factual and moral/emotional. Legal obstacles exist when the formalities, such as the need to use a lawyer or overly complicated forms and the strict admissibility rules diminish the possibilities and willingness of victims to seek justice. Factual obstacles exist when persons do not know about their rights and have no knowledge or access to the persons who could help. Moral obstacles include lack of hope in a change of one’s situation due to the long proceeding times or non-implementation of previous decisions by the authorities. To remedy these obstacles, cooperation is needed by the authorities, victims and their relatives, the NGOs and the lawyers who represent cases. Also the persons seeking access to justice must be provided with a realistic view on their possibilities to succeed, and if there is a valid case, all the necessary assistance and support needs to be given. As the ECHR has pointed out in its decisions many times over “the rights must not be illusory but real and effective”.

 

Ms Tulkens addressed discrimination and the situation of especially vulnerable groups/persons as well as the under-use of the available resources in access to justice. She noted the low level of female applicants, only 15 %, among those seeking justice before the ECHR. Women often face more challenges in access to their rights and justice than men. This is not only because women often have claims with regard to social rights, but also for psychological and economic reasons together with stereotypes prevalent amongst the judicial actors. The austerity diminishes social rights, the poor become poorer and end up more vulnerable as a result of poverty. The poor need more assistance to have access to all human rights. No new special rights are needed. Important factors are the legal aid and cost of justice, i.e. the cost of implementation of the rights for the victim. A holistic approach with gender perspective is needed in access to justice with equal treatment to both civil and political rights as well as social, cultural and economic rights.

 

Mr Kjaerum highlighted the cooperation between Council of Europe and the European Union Agency for Fundamental Rights (FRA). One of the FRA’s most important tasks is evidence based information and advice on challenges in the fulfilment of the fundamental and human rights in all member states. Recently surveys have been published on antisemitism, violence against women and discrimination of the LGTBI persons. The surveys prepared and conducted by FRA aim at making decision makers aware of problems in the implementation of the rights and create positive change for individuals. The surveys are based on large amount of personal interviews in all EU member states. One common challenge in access to justice is the lack of knowledge where to go, who can help and on what issues. For example national equality and anti-discrimination bodies are not known to most people. Such bodies should be made more accessible and visible, their independence, powers and funding need to be increased, the distance between the institution and the victims needs to be shortened and the limits to their activities, such as inability to bring forward cases on behalf of victims or cases involving important issues without a specific victim, needs to be removed. In general states should do more to provide easier access to justice for victims, to train national law enforcement and judicial authorities on access related issues and in general benefit from increased cooperation between various national and international actors.

 

Mr Coz gave a presentation on GRETA (Group of Experts on Action against Trafficking in Human Beings) and its monitoring activities, the anti-trafficking convention and the obligations it creates both on the identification, support and protection of the victim as well as on the prosecution of the persons responsible for the trafficking and prevention of the trafficking in the future. Anti-discrimination and other measures are necessary to ensure that all and especially the most vulnerable victims are recognised, gain access to justice, receive the assistance and support they need and are not exposed to the danger of continued victimisation due to the proceedings. States must work against stereotypes to allow everyone to enjoy their full human rights. In addition, political strength and will is needed to enhance the ability of GRETA and the member states to get better results in fight against trafficking.

 

The CDDECS exchanged views with the high level panellists and took note of the conclusions by the panel insisting on the universality and indivisibility of human rights and the need for their better implementation; more trust and confidence of citizens, namely from vulnerable groups, in police, in justice and other available redress mechanisms. The cap between the laws and people’s experiences is still there, the change is needed in the mind set and authorities’ willingness and ability to interfere when they recognise problems in the realisation of persons’ rights. Independent bodies tasked at helping victims and monitoring implementation of rights must be enabled to work effectively.

  1. CDDECS Work Programme 2014-2015

 

The CDDECS had first exchange of views on the draft Work Programme 2014-2015, which was prepared by the Secretariat based on the panel discussions and the exchange of views that followed.

 

The committee expressed support for the priorities outlined by the Commissioner of Human Rights for the work of the committee in his presentation earlier, namely

 

It was generally agreed that the draft needed further developing, especially as work on social cohesion was not directly reflected in the draft (nor in the panel discussions). Furthermore, it will be necessary to limit to few priority actions and to avoid duplication with the work of the CDDECS’ subordinate bodies. Several members stressed the three mechanisms that the Commissioner of Human Rights had noted as essential for social cohesion, and that did appear on the agenda, namely

 

Some members considered the proposed line of work to be too legalistic, involving conventions and their monitoring mechanisms. There was a concern that the work would overlap with that of the CDDH. The Secretariat drew attention to the Terms of Reference set up for the CDDECS by the CM which does set up a goal to enhance the implementation of the conventions and follow up on the recommendations made by the monitoring mechanisms.

 

The CDDECS decided that

Gender Equality Commission (DECS-GEC)

The CDDECS took note of the information provided by the Gender Equality Commission’s chair on the GEC and its 2014-2017 strategy’s focus areas. To benefit the work of the GEC, in addition to its 47 members, there are national gender focal points, sometimes the same person, and also rapporteurs in all steering committees of the CoE. The focus areas of the GEC include combating gender stereotypes and sexism, preventing and combatting violence against women, guaranteeing equal access to justice for women, achieving equal participation for women and men in political decision making and achieving gender mainstreaming in all policies and measures.

The next meeting of the DECS-GEC will be held 19-21 November 2014 in Strasbourg.

 

Committee of Experts on the Council of Europe strategy for the rights of the child (DECS-ENF)

The CDDECS took note of the information provided by the Secretariat on the progress of the implementation of the Council of Europe strategy for the rights of the child (2012-2015), on the remaining challenges such as austerity’s effect on children, hyper-sexualisation and child poverty exclusion and on the actions suggested, namely child friendly services, child participation, empowerment, protection, anti-violence measures, transversality and open consultation and of the information on the process of preparing the next CoE strategy;

The first meeting of the DECS-ENF will be held 12-14 November 2014 in Strasbourg.

 

Committee of Experts on the Rights of People with Disabilities (DECS-RPD)

The CDDECS took note of the information provided by the chair of the previous RPD on the progress of the implementation of the Council of Europe Disability Action Plan 2006-2015. The key areas in the action plan are independent living, education, employment, mobility and awareness raising. In addition, the Action Plan includes cross cutting aspects, such as women/children/migrants with disabilities. The new RPD will concentrate on evaluating the implementation of the current Action Plan and prepare a draft for a next CoE action frame for 2016-2020 for the protection of persons with disabilities taking into account the activities in this field within other organisations;

The first meeting of the DECS-RPD will be held 1-3 October 2014 in Strasbourg.

 

  1. Membership of the DECS-GEC and reimbursement of  travel and subsistence expenses by the Council of Europe

 

In accordance with the terms of reference of the DECS-GEC, the 47 member States of the Council of Europe are full members of the DECS-GEC. However, only 16 representatives of member states have their travel and subsistence expenses reimbursed by the Council of Europe.

 

The CDDECS took note of the proposal by the Austrian delegation to consider the possibility to reimburse the expenses of all 47 members during the following mandate period.


 

 

  1. Membership of the DECS-ENF and reimbursement of travel and subsistence expenses by the Council of Europe

In accordance with the terms of reference of the DECS-ENF, the 47 member States of the Council of Europe are full members of the DECS-ENF. However, only 16 representatives of member states have their travel and subsistence expenses reimbursed by the Council of Europe.

 

The CDDECS decided that

The members of the CDDECS gave information on the latest legislative changes in their respective countries and on the recent seminars and conferences held in the area of competences of the CDDECS. The committee thanked the government of Azerbaijan for its invitation to hold a conference in Baku on 10 and 11 September 2014, under the aegis of the Azerbaijani Chairmanship of the Committee of Ministers, with a view to taking stock of national policies towards social cohesion and actions taken by the Secretariat as whole, in the light of the New Strategy and Action Plan for Social Cohesion as adopted by the Committee of Ministers in 2010.  The Chair and/or Vice-chair of the CDDECS will represent it in this event and the result of this conference will be discussed in the next meeting of the CDDECS in November 2014.

 

  1. Issues relating to the work of the CDDECS – comments to the CM

The CDDECS discussed the two draft replies, prepared by the Secretariat on CDDECS’ behalf to the Parliamentary Assembly Recommendation 2044 (2014) “Ending child poverty in Europe” and Committee of Minister’s draft Recommendation CM/Rec(2013) on intercultural integration.
