A. FOREWORD
The Council of Europe’s European Commission for the Efficiency of Justice (CEPEJ) held its 30th plenary meeting in Strasbourg on 27-29 June 2018. The meeting was chaired by Mr Georg STAWA (Austria), President of the CEPEJ.
The agenda appears in the Appendix.
B. LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ
The CEPEJ
§ thanked the Deputy Secretary General of the Council of Europe, Gabriella BATTAINI-DRAGONI, for having opened the plenary meeting, thus showing the commitment of the highest authorities of the Organisation to its work;
1. Study session on “Artificial Intelligence and judicial systems”
§ welcomed the discussion on “Artificial Intelligence and judicial systems” which was the topic of the opening study session organised within the framework of its 15th anniversary, warmly thanked the key note speakers and agreed to pursue the work on this issue, including predictive justice; agreed that these issues are fully within the scope of the expertise of the CEPEJ and that this is an area where the work of CEPEJ must become a reference;
2. Information by the President of the CEPEJ and the Secretariat
§ warmly thanked Ramin GURBANOV (Azerbaijan) and Noel RUBOTHAM (Ireland) for the drafting of the brochure recalling 15 years of CEPEJ work, and for having marked this anniversary by a specific award ceremony ; welcomed the presence of its former presidents Eberhard DESCH and John STACEY and its former Vice-president André POTOCKI;
§ welcomed Guatemala and Kazakhstan as new observer States;
3. Recent developments in the judicial field in the Council of Europe Member states
§ took note of the information provided by Azerbaijan, Bosnia and Herzegovina, Estonia, France, Georgia, Germany, Greece, Latvia, Luxembourg, Malta, Republic of Moldova, Norway, Serbia, Slovenia, Spain, “the former Yugoslav Republic of Macedonia”, Turkey, Ukraine, United Kingdom, on recent developments in the judicial field ; invited its members to forward to the Secretariat written information and useful references which could be included in the area "country profiles" of the CEPEJ web site;
4. Evaluation process of judicial systems
§ welcomed the work achieved jointly by the members of the CEPEJ-GT-EVAL chaired by Jean-Paul JEAN (France) and the Secretariat, with the valuable support of the scientific experts: Julinda BEQIRAJ, Caroline FOULQUIER-EXPERT, Fotis KARAYANNOPOULOS, Hélène PAULIAT,. Francesco PERRONE, Federica VIAPIANA, Jaša VRABEC, within the framework of the 2016 – 2018 evaluation cycle, in preparing the draft report which evaluates the functioning of judicial systems in Europe and thanked them warmly for the efforts devoted to this exercise within a strict timeframe; thanked the national correspondents who had coordinated the national replies to the evaluation scheme and had fully cooperated with the experts so that they could submit a preparatory contribution of high quality;
§ noted with satisfaction that the reports and the data base include the results of a survey carried out in 45 European states, and Israel and Morocco as observers, and that his can be considered as an essential reference tool to guide reforms of public policies of justice;
§ adopted: the "Report on European judicial systems – Efficiency and quality of justice - Edition 2018" (CEPEJ(2018)5), subject to written comments to be communicated by the delegations to the Secretariat before 8 July 2018, through the specific form, and taking into account the discussions during the present meeting; agreed that no new data would be accepted beyond this deadline;
§ agreed that all the data provided by the states concerned would be made available to the public on the CEPEJ website through the CEPEJ-STAT data base; welcomed the development of this data base which is a major step forward in providing policy makers, justice professionals, researchers and the public with unprecedented interactive information to guide public policies of justice;
§ instructed the experts of the CEPEJ-GT-EVAL, under the authority of the CEPEJ Bureau, to finalise the definitive version of the report which would be made available to the members of the CEPEJ in the collaborative workspace of the CEPEJ website no later than 27 August 2018, bearing in mind that no further amendments would be made after 7 September 2018;
§ decided that the report would remain confidential until its official publication, to take place on 4 October 2018 within the framework of a press conference and invited all its members and observers to strictly respect this rule of confidentiality so as to ensure the relevance and coherence of the publication by the Council of Europe;
§ decided to forward the report as soon as possible to the Ministers' Deputies so that they may take note of it, possibly on 3 October 2018;
§ instructed the experts of the CEPEJ-GT-EVALto prepare an overview of the report to facilitate its understanding and reading; this overview would be submitted on 17 August 2018 to the CEPEJ for approval, through a written procedure, and published together with the report;
§ instructed the Secretariat to organise the appropriate publication and dissemination of the report, including through its website, as from 4 October 2018;
§ agreed to pursue the evaluation exercise within the framework of a new cycle, while keeping a biennial timeframe;
§ agreed that Kazakhstan may participate in this evaluation exercise as an observer, alongside Israel and Morocco;
§ agreed, in accordance with its medium-term activity programme, to pursue the analysis of the facts and figures presented in the report, including by opening the use of the data to researchers who wish to benefit from the scientific support of the CEPEJ, according to modalities to be defined with the CEPEJ-GT-EVAL, under the authority of the CEPEJ Bureau;
§ welcomed the contributions of the Council of the Notariats of the European Union (CNUE) and the International Union of Judicial Officers (UIHJ) carried out on the basis of the CEPEJ evaluation exercises, as part of the specific studies on legal professions and agreed to submit to the Observers (professional associations) the 2016 data for the purpose of updating contributions or preparing other contributions;
§ took note of the information provided by its experts on the peer evaluation visits to Georgia and Montenegro on judicial statistics, agreed to pursue the cycle of evaluation in Andorra and in “the former Yugoslav Republic of Macedonia” and invited member States to propose to the Secretariat candidatures for further visits;
§ welcomed the continuation of the cooperation with the European Commission to provide it annually with a Study on the functioning of judicial systems in the EU member states, based on the CEPEJ’s own methodology; took note of the “EU Justice Scoreboard” published by the European Commission in May 2018; instructed the CEPEJ-GT-EVAL to pursue this cooperation which strengthens the CEPEJ’s preeminent role as regards justice evaluation, as well as the synergies between the European Union and the Council of Europe in this field;
5. Quality of justice
§ took note of the work carried out by the CEPEJ-GT-QUAL, in particular in the field of Artificial Intelligence and justice, of case management systems with regard to the needs of the users, and of court communication; it also took note of the ongoing development of a "toolkit" for the implementation of the Guidelines for leading change towards cyberjustice adopted by the CEPEJ in 2016, as well as a discussion paper on knowledge sharing tools among judges;
§ warmly thanked the outgoing President of the CEPEJ-GT-QUAL, François PAYCHERE for his long-standing commitment to the Group and welcomed the appointment of Joao ARSENIO DE OLIVEIRA as Chairman of the Group;
6. Judicial time management
§ took note of the work carried out by the Steering group of the SATURN Centre, in particular in the field of case weighting, to prepare a Dashboard for court management, to manage judicial time regulations for criminal cases in ECHR Articles 5 and 6, and as regards the role of the parties and the practitioners in preventing delays in court proceedings;
7. Mediation
§ adopted the Mediation Development Toolkit (CEPEJ(2018)7) and invited the CEPEJ-GT-MED to develop additional tools to complete it;
§ took note of the other ongoing work within the CEPEJ-GT-MED to promote the development of the use of mediation in Europe and confirmed the CEPEJ-GT-MED Roadmap (CEPEJ(2018)8);
8. Definitions used by CEPEJ
§ took note of the work carried out by the Ad hoc working group on the definitions used by the CEPEJ;
9. CEPEJ’s participation in Council of Europe cooperation programmes
§ welcomed the on-going cooperation programmes:
§ welcomed the concrete results achieved with the judicial authorities and courts in Latvia as part of the Programme "Evaluation of the Latvian judicial system" that ended in April 2018 and warmly thanked the Latvian partners for the efficient cooperation that would be continued;
§ welcomed the results achieved in Tunisia and Jordan as part of the Programme “Towards strengthened democratic governance in the Southern Mediterranean", conducted with the European Union and agreed to pursue this cooperation with Tunisia;.
§ agreed to cooperate within the framework of it Activity Programme to support judicial reforms through new programmes jointly organised with the European Commission Structural Reform Support Service,
§ invited its members and expertswishing to participate in such programmes to make it known to the Secretariat;
§ thanked the Council of the Bars and Law Societies of the European Union (CCBE) for its explanations as regards Recommendation 2121(2018) of the Parliamentary Assembly of the Council of Europe on "The case for drafting a European convention on the profession of lawyer";
§ adopted its comments on Recommendation 2121(2018) of the Parliamentary Assembly of the Council of Europe on "The case for drafting a European convention on the profession of lawyer" (CEPEJ(2018)6) and decided to forward them to the Committee of Ministers;
11. Relations between the CEPEJ and other bodies of the Council of Europe
§ took note of the information about the activities of the Consultative Council of European Judges (CCJE), the Consultative Council of European Prosecutors (CCPE) and the European Committee of Legal Cooperation (CDCJ);
12. Latest developments within the European Union in the judicial field
§ took note of the information given by the representatives of Bulgaria and Austria, on behalf of the outgoing and incoming presidencies of the European Union, on the recent developments within the Union in the field of justice;
13. European Day of Justice and Crystal Scales of Justice
§ invited its members to forward to the Secretariat all information on their celebration of the European Day of Justice on 25 October 2018;
§ welcomed the cooperation formalised in the field of the functioning of judicial systems with the Law Faculty of Strasbourg, hosting city of the Council of Europe’s Headquarters, and committed itself to contributing to this cooperation, including within the framework of the specific curriculum on cyberjustice ;
§ agreed to implement with the Law Faculty the Prize of the « Crystal scales of Justice junior » and instructed its Secretariat to define the modalities of this Prize, under the authority of the Bureau;
§ welcomed the 2018 Report by the Secretary General of the Council of Europe: “The state of democracy, human rights and the rule of law in Europe”;
§ took note of the information given by its Observers, and in particular the European Association of Judges (EAM), Magistrats Européens pour la Démocratie et les Libertés (MEDEL), the International Union of Bailiffs and Judicial Officers (UIHJ), the European Union of Rechtspfleger and court clerks (EUR), the Council of the Bars and Law Societies of the European Union (CCBE), the International Institute of Expertise and Expert (IIEE), the Association of European Administrative Judges (AEAJ),the Council of the Notariat of the European Union (CNUE), thanked themfor their concrete contribution to its activities, in particular in the drafting of the report evaluating judicial systems, and invited them to further contribute to the implementation of the CEPEJ activity programme.
§ recalled the invitation for its member States to appoint substitute members of the CEPEJ;
§ recalled that the implementation of the numerous cooperation programmes by the CEPEJ requires the availability of members and experts of the CEPEJ and calledupon its members and experts to inform the Secretariat of their willingness to participate in such programmes;
18. 2016-2017 Activity Report of the CEPEJ
§ instructed its Secretariat to finalise its 2016-2018 Activity Report, under the authority of the Bureau, and agreed to adopt it through a written procedure before 15 August 2018 so that it can be forwarded to the Committee of Ministers for approval;
