Rule No. 1349 of 18 December 2012 amending Rule No. 1234 of 15 December 2005 laying down the conditions of recruitment and employment of locally recruited temporary staff members working in Information and Field Offices

The Secretary General of the Council of Europe,

HAVING REGARD to Article 1 of the Staff Regulations;

HAVING REGARD to Rule No. 1234 of 15 December 2005 laying down the conditions of recruitment and employment of locally recruited temporary staff members working in Information and Field Offices (hereinafter referred to as ''Rule No. 1234'');

CONSIDERING that certain provisions of Article 4 of Rule No. 1234 should be specified as regarding locally recruited temporary staff members in host countries which are not Council of Europe member States;

HAVING CONSULTED the Staff Committee in accordance with Article 5, paragraph 3, of the Regulations on Staff Participation (Appendix I to the Staff Regulations);

D E C I D E S:

Article 1

In Rule No. 1234, the second sub-paragraph of Article 4 shall become Article 4 bis.

Article 2

In Article 4 bis of Rule No. 1234 as amended by Article 1 of this Rule the following terms shall be added as a new sub-paragraph after the second bullet point:

“Following negotiations pertaining to Offices in host countries which are not Council of Europe member states, the Secretary General may decide, where appropriate and on a case-by-case basis, that one or both of these exemptions shall not be granted to locally recruited temporary staff members of certain Offices in such countries.”

Article 3

This Rule shall enter into force on the day of its signature by the Secretary General.
