Rule No. 1380 of 15 December 2016 amending Rules Nos. 1232, 1234, 1277 and 1344

The Secretary General of the Council of Europe,

HAVING REGARD to Articles 4, 5, 6, 6 bis, 7 and 12 of the Regulations governing staff salaries and allowances (Appendix IV to the Staff Regulations) (“the Regulations”) and Articles 4 bis, 5 bis, 5 ter and 12 bis of those Regulations, as introduced by Resolution CM/Res(2016)18 adopted by the Committee of Ministers on 18 October 2016, at the 1268th meeting of the Ministers’ Deputies;

CONSIDERING the need to amend Rules Nos. 1232, 1234, 1277 and 1344 to take account of the changes in the Regulations;

HAVING CONSULTED the Staff Committee in accordance with Article 5, paragraph 3, of the Regulations on Staff Participation (Appendix I to the Staff Regulations);

D E C I D E S:

Article 1

In Rule No. 1232 of 15 December 2005 laying down the conditions of recruitment and employment of temporary staff members in France from 1 January 2006, Article 25 shall henceforth read as follows:

“25. The allowance in respect of dependent children, the indemnity for handicapped child, the dependent child supplement and the supplements for disabled or severely disabled child shall be payable to holders of M contracts on the conditions laid down for staff members on fixed-term or indefinite-term contracts, except for the additional supplement for single-parent families provided for in Article 5 bis, paragraph 6, of the Regulations governing staff salaries and allowances (Appendix IV to the Staff Regulations).”

Article 2

In Rule No. 1234 of 15 December 2005 laying down the conditions of recruitment and employment of locally recruited temporary staff members working in Council of Europe duty stations located outside of France, Article 16 shall henceforth read as follows:

“16. Remuneration shall comprise a basic salary and, where appropriate, one or more of the following indemnities, allowances or supplements, payable on the conditions set out in the Regulations governing staff salaries and allowances (Appendix IV to the Staff Regulations):

§  the allowance in respect of dependent children or the dependent child supplement, except for the additional supplement for single-parent families provided for in Article 5 bis, paragraph 6, of the Regulations governing staff salaries and allowances (Appendix IV to the Staff Regulations).

§  the indemnity for handicapped child or the supplements for disabled or severely disabled child.

Locally recruited temporary staff members will be required to provide the necessary documentary evidence (translated into one of the official languages of the Organisation), as well as a declaration on their honour indicating what allowances in respect of dependent or handicapped children they receive from any other source.

Any such amounts will be deducted from the indemnities, allowances and supplements payable under this article”.

Article 3

In Rule No. 1277 of 25 June 2007 on the education allowance, Article 6 shall henceforth read as follows:

“Article 6

For the purpose of Article 7 of the Regulations, the dependent child allowance, or where appropriate, the supplement for dependent child shall mean those of the salary scale of the Co-ordinated Organisations in the country where the studies are pursued.  In the absence of a salary scale established by the Co-ordinated Organisations, reference shall be made to the United Nations scale or, with regard to children who live with a staff member attached to an external duty station, the scale for Belgium.”

Article 4

In Rule No. 1344 of 23 April 2012 on the status, recruitment and conditions of employment of the secretaries and assistants of the political groups of the Parliamentary Assembly of the Council of Europe, Article 7, paragraph 2, shall henceforth read as follows:

“2.      Remuneration shall comprise a basic salary and, where appropriate, one or more of the following allowances, payable on the conditions set out in the Regulations governing staff salaries and allowances (Appendix IV to the Staff Regulations): expatriation allowance, household allowance, basic family allowance, allowance in respect of dependent children, dependent child supplement and indemnity for handicapped child or supplements for disabled or severely disabled child.”

Article 5

This Rule shall enter into force on 1 January 2017.
